What questions would you like to see Supreme Court nominee Elena Kagan answer?

Today is the second day of Senate confirmation hearings for Obama's second Supreme Court nominee, Elena Kagan. With the 2010 elections approaching, plenty of Senators are expected to use this as an opportunity to do a little campaigning before a national audience. But outside of partisan positioning - what questions would you like to see her answer? What are the biggest questions facing out Supreme Court these days?

      1) Do private citizens have the right to possess firearms?
      a) If so, will you oppose any decision that would limit this right?
      b) What did Thomas Jefferson mean when he wrote the 2nd Amendment?
      2) What rights does the Constitution extend to illegal immigrants?
      3) Does the Constitution grant the government the right to censor or close the internet or any other media outlet?
      a) If so, when? Please make citations, excluding existing case law.
      4) Should suspected terrorists be tried in military or civilian courts?
      a) What about home grown terrorists?
      5) How do you feel about legislation from the bench?
      6) Do you honestly feel that you are qualified for the job?
      a) What qualifies you? Please cite commissions, posts and other positions.
      7) Do you think there is a double standard for Mexican immigrants over immigrants from other countries?
      8) Would you overturn a law passed by referendum that outlawed gay marriage?
      9) As a Justice, is there a case or type of case in particular that you would like to hear?

      The fact of the matter is that this undeserving, liberal monster is going to be confirmed by Obama's puppets. The socialist agenda will be furthered doing irreparable harm to our nation. She must not be allowed to sit on the Supreme Court.

      Is there any chance of the Supreme Court making a decision on the possibility of Homosexual men being allowed to donate Blood and other medical donations in your lifetime?

    • Who is your favorite president? (Corny, I know, but it shows how much one actually cares to delve into a president's ACTUAL policies. Responding with Lincoln (one of the most common answers) would be a position she would have to defend very well (similar to an actual Supreme Court argument), because Habeus Corpus is apparently a big freaking deal).

      (edit. thought of another one (less corny, I swear): Does a state have the right to secede from the union if they feel that the government is not fulfilling their needs?

    • The current manner in which political districts are periodically changed has resulted in what can only be described as a sweetheart deal between Republican and Democrats in which the majority of Congressional seats rarely if ever switch parties. Thus control of Congress tends to be determined by a couple dozen closely-watched races each election cycle. Do you think this practice is consistent with the vision of the founding fathers for representational democracy? If not, can you suggest an alternative method for determining such boundaries?

      Because of the partisan nature of the Supreme Court, there was never any doubt that George W. Bush would defeat Al Gore when the matter came before the Court. Do you agree that this kind of political activism has damaged the Court's credibility as an objective decision-maker? Assuming the Court is called upon again in similar circumstances, on what record should the Court's decision be based?
