President-elect Barack Obama says closing down the detainee camp in Guantanamo Bay will be a top priority of his new administration. David Cole, author of Justice at War: The Men and Ideas That Shaped America's War on Terror, legal affairs correspondent for The Nation, and a professor at Georgetown University Law Center, reviews some of the dilemmas ahead. Should the U.S. continue to hold prisoners without charge? Should we prosecute the top Bush Administration officials responsible for detainee abuse? And how do we regain the respect of the world community?

darinK I do not watch Fox Noise at all. I oppose inhumane treatment for all POW and any prisoner no matter what the crime. You cannot have a just society while treating others with cruelty. Gitmo is a black mark on our society. There is never a justification for torture.

I'm sure u dont agree with a lot on Fox desert. Back to the issue a lot of terrorists dont even qualify for pow status under the geneva conv. It is a bad career with not much backing from any legal forces in the world. I wouldn't recommend it. I think humane treatment is a must in every case as long as there is such a thing as humane torture. Sometimes its a must.

I agree with you darinK, if the democrats falter and act like the repugs did then we should kick them out also. And keep kicking out those who do nothing but line their pockets. We have to take this country back from the do nothing politicians and big business. I do not agree that Dubya was never given a fair shake only by Fox Noise. Fox Noise gave a fair shake to repugs no matter what they did and treated everyone else like the poor stepchild.

Democrats never gave Bush a chance. Either did the media (except fox). I heard somewhere you cannot win a war wihout the support of the media. ( winston churchill). It was too bad how Bush became President in Florida but that was cnn's fault for confusing everyone. Keep blaming Bush for this financial crisis and you'll never figure it out. Greed is out of control! We all created this mess and some of us will get out of it. All you Bush bashers better shut-up and figure how to get everyone our health care (never gonna happen), fix immigration (gl), end all wars, and be loved by all in the world because you only have 4 years to do it. Democrats control the congress, senate and white house so there'll be no excuses.

Justice denied one is justice denied all. Those people in Gitmo have not been convicted of anything. They have been kidnapped from other countries, thrown in jail without their rights and denied council. Obama has to settle this matter as soon as possible and restore America's image before he can move on.
And we should not and can not expect him to solve all the problems left behind by the Bush administration. They are too many. What we have to do is support his efforts in his attempts to overturn the laws that we as citizens sat back and allowed Bush and his admin. pass without a word.
Remember for the last 8 years we allowed the government to commit crimes against humanity, war crimes, steal from the people and spy on us and we did nothing but sit at home and watch reality shows. Now we have a new president and we want changes overnight. It cannot be done. Give the man a chance to make the chances just like we did in allowing Bush to destroy the economy and everything else that crossed his path.

Amazing how so many people still think that just because people are in jail means they are guilty.........

Why aren't more Americans concerned about this issue? Our citizens & elected officials are burying their heads in the sand. Look at the media attention and the money spent on trying to impeach Clinton for an action that only affected a couple of willing participants (and made them wealthy). Why is the main stream media spending more time on stories like the future White House dog than how the leaders of our supposedly great nation have kidnapped, tortured, and killed so many fellow human beings? THINK...have we become a nation of SHEEPLE?

Ty wendy for that great point. Why is everyone so worried about 143 terrorists locked up in Cuba. Lets help the cubans that want out first. I wish Obama wanted to chang things like homelessness, social security , or a broken tax code. What happened to dealing with the homeless. Obama is worried about giving them health care before food and shelter. That is one thing a liberal president could help.

This is important stuff and will have no simple solution. I would love to waterboard the lot of them and see if they think it is torture or not. Now that Leiberman has retained his committee chair, I don't think there will be any investigation into it. I know that there are real criminals among those being held, but what about all those folks who did nothing accept fit a certain ethnic profile. I think Bush and Cheney and the lot should have to pay financial restitution to those folks, or their families since some of them did wind up dead or missing...wonder how that happened. Restitution should have to come from them personally and they should have to deliver it personally to these people and apologize to them. And if they get bitch slapped in the process, all the better:)

What is your point rhubarb? You want to free all the gitmo terrorists, and torture our president and staff. I wish people had as much hatred for the terrorists and islamic extremists as you do for republicans. Torture will never stop in a war because our soldiers will do what they have to, no matter what a president orders them to not to. After the Bush-whacking is over I wonder where you hatred will turn. I'm guessing Christians, straight people, parents and anyone who doesn't believe your conspiracy theories.

How do we regain the respect....
1. NEVER let this happen again.
2. Actually close gitmo
3. Reassert our belief in the Geneva Conventions.
4. Press charges where applicable to reinforce the idea that this is an unacceptable practice.
5. NEVER let this happen again. Pass laws that are clear and cannot be circumvented by anyone.
Just my two cents.

Seemed more like a dime. Too simple of a concept for our public servants to grasp. But I must agree in total.
