The indictment says Mr Cheney - who has invested $85m (£56m) in a company that holds shares in for-profit prisons - conspired to block an investigation.
The indictment has not been seen by a judge, who could dismiss it.
Mr Cheney's spokeswoman declined to comment, saying his office had not yet received a copy of the charges.
The indictment was overseen by county District Attorney Juan Guerra, an outgoing prosecutor at the end of his term of office.
He cites the case of Gregorio De La Rosa, who died on 26 April, 2001 inside a private prison in Willacy County, Texas.
The grand jury in Willacy County, near the US-Mexico border, accuses Mr Cheney of committing "at least misdemeanour assaults" of inmates by allowing other inmates to assault them.
It said there was a "direct conflict of interest" because Mr Cheney had influence over federal contracts awarded to prison companies.
The three-page indictment also alleges that former US Attorney General Alberto Gonzales "used his position...to stop the investigations as to the wrong doings."
The grand jury wrote that it made its decision "with great sadness," but said they had no other choice but to indict Mr Cheney and Mr Gonzales "because we love our country."

PressCore, while I agree with most of what you state, I fear that the incoming administration will not, in the end, be more "honest". Obama does not want to hold the Bush administration accountable for it's crimes, he will increase the war effort in Afganistan, and with every new administration appointee comes more disappointment from everyone who is hoping for real "change". I'm afraid that things will just continue to get worse. There is a growing consesus that true change will not occur unless we get out from under the two party duopoly which only serves as a smokescreen to prevent political accountability for the issues that matter most to Americans..and to humanity.

For those of you who were not around during the infamy of Richard Nixon, we used to have a saying about Mr.Nixon which could equaly apply to Mr.Cheny and which I will now adapt to the more current villian photoed above. "DICK CHENEY BEFORE HE DICKS YOU" And since Bush's 3rd crooked Attorney General of 3 will be leaving before too long to make way for an honest administration, I can't wait to see what they dig up on Ashcroft and the current fiend. What is realy sad is that the USA is hated in many countries because the official definition of torture as a U.S.legal standard was lowered so badly that the Geneva Convention is now too high a legal standard for some to recognize here in the States. And though that does not represent what decent citizens of our Country would demand, still it regrettably puts the USA in the same league as the 3rd Reich of Adolph Hitler. Every
day I pray to God that Bush & Cheny both do not escape the War Crimes punishment they deserve from the Hague. AND the criminal prosecution of the
DOJ & the U.S.Criminal Court to prove the rule of law still exists here in the USA. - 3 years ago
