Cops beat up 12 year old honor student, then arrest her 3 weeks later.

Who can blame Galveston plainclothes police who thought a 12-year-old girl standing outside her house (flipping the switch on the circuit breaker as her mother has asked her to do) was a prostitute? After all, she was wearing "tight shorts" according to the vigilant officers, and she happened to live only two blocks away from a location where someone had complained that prostitution was taking place.

So the three brave officers did the natural thing: they allegedly jumped the girl and beat her up, according to Courthouse News and the Houston Press.

As Dymond headed toward the breaker, a blue van drove up and three men jumped out rushing toward her. One of them grabbed her saying, “You’re a prostitute. You’re coming with me.”

Dymond grabbed onto a tree and started screaming, “Daddy, Daddy, Daddy.” One of the men covered her mouth. Two of the men beat her about the face and throat.

As it turned out, the three men were plain-clothed Galveston police officers who had been called to the area regarding three white prostitutes soliciting a white man and a black drug dealer.

After the incident, Dymond was hospitalized and suffered black eyes as well as throat and ear drum injuries.

I guess the silly family expected an apology from the police. Like I said, silly. Instead, here's what happened.

Three weeks later, according to the lawsuit, police went to Dymond’s school, where she was an honor student, and arrested her for assaulting a public servant. Griffin says the allegations stem from when Dymond fought back against the three men who were trying to take her from her home. The case went to trial, but the judge declared it a mistrial on the first day, says Griffin. The new trial is set for February.

UPDATE: This case was filed on 22nd August 2008, and the alleged attacked occurred in August 2006, according to this court document. Here is the Courthouse News article.

I emailed Radley Balko about the apparent age discrepancy that some commentator have brought up. On a couple of social networking pages, the girls says she's 17, which would have made her 15 in 2006, not 12, as the article indicates. Radley says:

My guess would be that she exaggerated her age on her profile for those pages (as teen girls will do). This track results page puts her birth year at 1993. If her birthday comes later than August, she'd have been 12 when the incident took place.

    • It shouldn't matter what she was wearing as long as she wasn't breakling a public decency law. Police priorities in this country are totally screwed up. Of course this is a reflection of extreme conservative elements of our society which are also screwed up.

    • That's crazy. I go to Galveston monthly during the summer, and the cops usually are just cruising around. I rarely see them doing anything. As for the "plains clothes" pigs that assaulted the girl, they're damn lucky they weren't blown away by someone in the neighborhood protecting their own, as most of Galveston is the "Barrio." No offense. Idiots, it's still Texas and everyone is armed.

    • This is really sad news....I live in Houston, which is within an hour of Galveston, and this story is terrible....after all the crap the residents of Galveston have had to endure with hurricane Ike this year, the police harrass, beat up, and falsly accuse a 12-year old honor-roll student.....I do hope the right authorities bring these terrible officers to justice and if that does not, I hope the streets find them so that noone else ever does...

      ....and this story is far too in the it doesn't make sense category. Too much stupid that just myers the entire thing into absurdity.

      If she yelled Daddy what did they think? She was calling for her pimp?

      She suffers pain from their brutality and they get scratches from a scared little girl and they are upset enough to drag her out of school?

      This is one reason why it's hard for some people to like cops....those that it happens to. I'm not excuse those that read it.

    • WTF This story reads so strange, what should I believe?

      We can't hit those cops back but I say we go viral on their asses. Use the internet, snail mail, even texting and harass them about the incident with the understanding that it stops when they resign.

      Send their pics to prisoners with love notes, make sure everyone in their family knows what they did, over and over. Then maybe cops will start thinking twice, and they will live with the fear that they put in civilians.

    • The media turns a blind eye to storys that show abuse of power. Three grown men have to beat a 12 year old with a flashlight to have her submit to an arrest. From this story it doesn't even sound as if they civilian clothed officers informed the terrified girl of who they were, just blurting out that she was a prostitue. As the internet access becomes the wave of the future the media is losing it's readers who want the truth and with video everywhere are starting to realize that the media does not want to report on real human intrest stories.

    • i think that these cops should be brought to trial. for them to just grab someone off the street like this is unheard of.if they did this to my child,they would have alot more to worry about.it looks like the city where they live should find better people to protect them than these morons. i for one would sue that entire city,and take my case all the way to the top of the chain. sounds like that city really needs better people in office.

    • Wait... this was in texas and on the family's property. The father has full rights to walk out there with a shotgun and take all three of them down.

      WTF? He should have exited his house with guns blazing. It would have been a bad ending all around, but I think it's warranted to save your daughter.

    • You know....as I think about it, I'm reminded of a story my mom told me a long time ago. When she worked in the rag trade and everyone was on lunch this particular day, many people were crossing the street. An elderly lady was there crossing as well, and she got hit by a police car. While they were loading her into the ambulance, THEY ISSUED HER A CITATION.

      And this was easily 30+ years ago.

    • We should expect nothing less when it has been shown continuously that those in a position of authority are somehow above the law. The United States was formed to stand against the abuses of authority. That is why this was to become a land of law. No man was to be above the law.

      We now live in a land of taxation without representation, abuses by authority, and the checks and balances of our government have been circumvented by the two-party system. Something must be done to make those responsible pay for their actions, and something must be done to hold government accountable to the people once again.

      What happened to "Government of the people, by the people, for the people"?

    • Of course the father and daughter were arrested, otherwise the department would be admitting that they were wrong to arrest in the first place and therefore would lose in a lawsuite (cover your ass).Anytime they have been caught doing something like this (which is common) they arrest the victim as in the icedents of them being recorded assauting an innocent victim. How many times does this happen and there is no proof? If a police department wants to keep its members safe, they need to reform. As it is many have simple become a thug squad.

    • This is AWFUL. And another example of authority gone awry. I would expect nothing else than the quote the police department gave. They have to save their butts. But really I can't get over the mistrial. And of course it's not played up in the media. What can ordinary citizens do to stop this when the odds are against us.

    • I just watched this video about this woman being forcibly strips searched after having called 911 for being assaulted and then ran into this story. I know the cases aren't very similar but they both make me wonder, what do you do when you're being forced by police and you're innocent? Do you just let them do what they want to you, or do you fight back? The Hope Steffey case in this video is up for debate about whether she was a danger to herself or not, but I think the video speaks for itself.

      "Yeah sure, sounds like a ton of fun!!"

      We had a guy die in police custody, and there were protests for years. How messed up is the system that shit like this happens all the time? How much worse does it need to get before even the officers realize how fucked up their actions have become? I could never be an officer, because I could never, ever be okay with shit like this. I would be run out of the force in the first month, guaranteed.

    • 3 men jump out of a van and attack my daughter right in front of my house? you better believe im going to try and protect her by any means necessary-for all he knew, it was an abduction or rape. this is totally unacceptable. outrageous.

    • Update: This is from the officers' lawyer, William Helfand:

      Both the daughter and the father were arrested for assaulting a peace officer. "The father basically attacked police officers as they were trying to take the daughter into custody after she ran off."

      Also, "The city has investigated the matter and found that the conduct of the police officers was appropriate under the circumstances," Helfand says. "It's unfortunate that sometimes police officers have to use force against people who are using force against them. And the evidence will show that both these folks violated the law and forcefully resisted arrest."

      These were undercover cops. They weren't in uniform. I have three daughters. If I saw three men in civilian clothes trying to cart one of my daughters away, at the tender age of twelve, claiming she's a prostitute, well, that's three more corpses in the morgue.

      Seriously. As far as that guy knew, these three guys were trying to kidnap and rape his little girl. Had I been him, I'd have literally killed all three of them, or died trying.

      I still can't figure why they can use assault on them as an excuse when they failed to identify themselves. Even if they were in civilian dress, they would have had their IDs on them. Why not identify themselves? I would have done the same thing for my daughter, and a few would have had major injuries. Where is the justice in the world? This only makes me feel more justified in my distrust in humanity as a whole.

      definitely if these 3 plainclothes cops did not show their ID's and identify themselves as detectives.. this father and daughter would have the right to resist kidnapping.

      the daughter, no doubt aware of the amount of kidnapping of young girls going on these days would be freaked at this .. even with ID's which can be faked.. you still never know.. and the father would stand by and watch 3 unidentified men take his 12 year old daughter away in an unmarked van?
      i mean seriouisly??
      these cops were nuts? their initial approach should have been identifying themselves and expressing their reasons to question the girl.. not rushing at her and accusing and attempting to put her in their van.. even if verbally claiming the were "the law"

      girl must have feared for her life .. being beat up and hauled off in a van.. from her home? these cops are not public servants.. they are serving their own sick
