Stephen Kuehler, 30, a recruiter in St. Louis, was court-martialed Tuesday in San Diego, the San Diego Union-Tribune reported. The base there regional headquarters for recruiters in St. Louis.
Amy Patton testified that Kuehler got in touch with her after her husband, Michael Patton, was killed in Afghanistan last year, less than a year after their marriage. Patton joined the Marines in 2007 immediately after his high school graduation.
"He was very helpful," she testified. "I considered him kind of a big-brother type."
The sex occurred at Patton's house after she had drunk tequila on top of a prescription anti-depressant.
David Ahn, Kuehler's lawyer, said that his client made a "mistake" while he, like Amy Patton, was grieving over Patton's death. But Capt. Tyler Hart, the prosecutor, said that he was guilty of an act of betrayal.
"Most of all he betrayed the trust of a fellow Marine," Hart said.

Since when is adultery a legal crime? I understand rape, but adultery? Or this an offense that is observed under military law?

i stand corrected. However, while the details are juicy its not like it doesnt happen every day. It seems that he is being singled out for punishment and that prosecution is very arbitary.

values its traditions like they did during the tailhook scandal? Maybe this is less about adultery than the he man response to messing with another mans women, if that man is dead.

If you read the rest of the stories on the web you would see that the Recruiter is married, which is why this was a crime to the Marine Corps.
Oh, and HeriticHero - the Marine Corps values it's morals and tradition more than any other organization known to man. They are not "trained killers" as you say, but a group of men and women that have kept us out of harms way, despite the toll it takes personally.

Surely it was total douche but hardly criminal even in the military. No sure how he betrayed some guy that was dead nine months was his wife supposed to wear head to toe black for two years then marry his brother?

Michael Patton was not dead 9 months when she had sex with the recruiter. He was killed on 06/14 and she had the sex on 07/04. He had not been even buried for two weeks. What a way she showed her respect for her husband who fought and died for this country.

This was an odd story to read. Unless there is more information than was revealed in the article, I am not sure what the crime really consisted of. This seems to be the type of thing that someone should have been given a stern lecture on, not put in gaol for.

The military response is ridiculous. While it may seem slimy to some, jail time should be out of the question. I think even a court martial is wrong. This is nobody's business.

Marines agree to a code to live by and know ahead of time the consequences of those actions. So as harsh as you may think it is, the recruiter got what he deserved. The wife on the other hand, I hope this haunts her forever. Amy Patton does a great job "acting" as the devoted wife, plays the role quite well. She probably only spilled the beans to ease her mind.

It was an extremely douchy thing to do, but as for jail time? I don't much like the idea of the government legislating morality, but It depends on what the government considers to be the end of a marriage. Her husband is dead, and while I'm sure had be been alive he'd probably be mortified right now, he's still dead. Therefore, the marriage part is essentially done.
I'm glad he's getting retribution for it, but I really don't think stretching laws around like that is very healthy for the system.
