As I have said before the u.n. is useless. Our government should be the first to bring criminal proceedings against the bush admin. That alone would boost our standing int he worlds view.

i don't condone torture, but it has been established as fact that the more "aggressive interrogation" techniques employed by the bush administration yielded a great deal of information and directly prevented further plots to maim and murder more lives. it's not impossible one of your own lives was saved by the waterboarding of a high level terrorist.
the questions at hand are not whether bush committed war crimes, but what constitutes "torture"? is waterboarding torture or not? where do we draw the line between "aggressive interrogation" and "torture"? how do we balance our ideals with the urgent need to save lives? and who makes that decision in a time of war if not the commander-in-chief?
some of you probably don't believe in any type of interrogation that doesn't include a pillow and a cup of tea. i hope my safety never rests in your hands!

Imagine a world where American troops are tortured by Afghan and Iraqi troops, and their excuse is "this guy knows when the Americans are going to strike next, so we'll torture the info out of him... to save the lives of our countrymen."
The other problem is, nothing is going to happen, even if they should be prosecuted. The political system in the US is so badly f'ed up that if Obama were to prosecute anyone who supported these actions, the republicans in the House and Senate would block everything Obama tries to do, so he looks like a failure of a president. It's a catch-22...

The U. N. will have to wait in line. Obama is filling the Justice Dept with people who believe Bush and other prominent members of his Administration must be prosecuted for their blatant disregard of our Constitutution - as well as war crimes.
Good people like Colin Powell need to be prosecuted, too. It is not okay to knowingly lie to the world on the President's behalf.

The United Nations is a corrupt and useless institution. It is a lofty, idealistic notion but a worthless one in the reality of today. When despotic regimes and countries that are gross violators of human rights exist and vote on equal footing with the free, democratic nations of the world (like the US, contrary to many of your opinions), it shows itself to be a farce. How can a country like North Korea head up the UN committee on human rights, for example? Yet in the UN senseless things like this are commonplace.
The UN has no real military force of it's own and never will. Therefore the mandates passed are meaningless and everyone knows this. When it comes time to back up the mandates of the UN, it is always the US that actually puts soldiers lives on the line. Without the US, the UN would be completely benign. Therefore it is wise of us to choose when and how we will use this institution to our benefit and when to ignore it outright. It's a joke, a charade.
Without our dollars it wouldn't even exist. The only reason we haven't withdrew our funds and let it die is world politics, not because it has any real value.
The US should NEVER hand over our sovereign ability to decide what is right or wrong to an institution packed with 3rd world countries that blame us for all their problems. Most of them have populations living in squalor due to the ineffectiveness and injustices of their leaders and think of us as the Great Satan, yet we should abide by their collective idea of "justice"?

See, what sucks about this so bad for Obama is, the GOP (Guild of Pussies) has already made it clear that they will make his life a living hell and block all of his policies etc if he goes after Bush et al. So now Obama is stuck between a rock and a hard place: does he go for justice, or does he go for the change he wants for his country? I feel for Obama and the place he's in, the decisions he has to make BUT!!!! If the UN prosecutes Bush and his buddies, Obama will not have the blowback as it was not his action. The Republicans will not be able to blame Obama (tho they probably will still try to) and therefore, not take their cowardly vengeful actions (such as delaying confirmation of a much needed Attorney General). I think there were crimes committed, and some of them will be swept under the rug. All presidents get a pass at wartime to do things they shouldn't. Bush went too far, though. And then bragged about it. We can't, as a civilized nation, prosecute water boarding of Japanese, Korean, and even our own troops in the past, then do nothing now. It opens the door for more Nixonian "if the president does it, it's not illegal" crap.
To all the folks shouting "try them and hang them", DROP IT. First, we don't hang people anymore, really. Second, no one has been convicted. If we want the justice system to work FOR us, we have to let it take it's course. If you need a battle cry, use this one:
"Try them, and if they're convicted, allow them to appeal, then if the appeal is denied, let them languish in prison, then euthanize them through lethal injection or electric shock"

Impartial or not the rule of law must be maintained. I do not care if you think he broke the law or if you think its a load... thats fine but let a judge and jury decide that given all the evidence available and people who know the law fully please. In history Stalin and Hitler were arch enemies yet they were virtual clones of each other (manipulative, sociopathic, sadistic and megalomaniacs) I wonder how much Sadaam, Osama, Bush and Cheny differ from one another? My guess....not much. The world suffers greatly when people like that get into positions of power and nobody has the courage to stand up to them.

Its not that nobody has the courage. Its that nobody wants to stand up alone against a tyrant. The nail that sticks up gets hammered down. And under leaders like the ones you listed the nail gets hammered down hard. Tell someone that they have a hundred-thousand people backing them up, then they will stand up. Or maybe I just don't have enough faith in humanity to believe that someone would stand up. Like the unknown man in Tiananmen square.

Close. In 1947, Yukio Asano, a Japanese officer, was charged with warcrimes for waterboarding a U.S. civilian. He was sentenced to 15 years of hard labor. There may be other cases; this is the only one I know of.

Former Bush officials know they will be subject to arrest in many foreign capitals just as Pinochet was. And, after all that, there is the court of public opinion. That includes US soldiers in Iraq who are now missing parts of themselves. It will be an interesting series of events unfolding. There will be no peace without justice.
