Feds Declare Tennessee Gun Law Invalid

It is yet another example of the federal government running roughshod over the states.

Last month, the state of Tennessee’s General Assembly passed House Bill 1796, the “Tennessee Firearms Freedom Act,” which states that any firearms or ammunition manufactured within the state and legally owned and kept within the state by citizens are “not subject to federal law or federal regulation, including registration” due to provisions in the Second, Ninth, and Tenth Amendments to the United States Constitution.

But according to Assistant Director Carson W. Carroll of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the U.S. Constitution is little more than a g.d. piece of paper, as George W. Bush so infamously deemed it during his reign as the decider-in-chief.

On July 16, Carroll dispatched his agency’s official response to the law passed in Tennessee — the BATFE asserts that “Federal law supersedes the Act, and all provisions of the Gun Control Act and the National Firearms Act, and their corresponding regulations, continue to apply.”

It will be interesting to see how Tennessee reacts to this official proclamation.

    • Note, the letter doesn't attempt to explain why Fed law 'supersedes' state law. If they had attempted to do so, they would have just dug themselves an even deeper hole in their violation of the 10th Amendment.

    • In the police state Bush Created the elite don't want anyone but the police and the army to have guns cause we might fight the New World Order! The Constitution has been torn to shreds and the rights granted to us by that wonderful document are being taken away! The democrats are no different! its all run by the same elite! Did you know that the Patriot Act allows them to brand those who oppose the New World Order terrorists and the concentration camps staffed by the military wait any foolish enough to try? Do you know that troops both ours and foriegn are going to be used against us if we resist and fight? That no longer do the police need a warrent to bust into your home or business? Wake up people!

    • BATFE has no authority to interpret the constitutional legality of a state law. I knew the supreme court would get involved and claim that authority, but BATFE? Who the hell do they think they are?

      So, If i could say something to the Federal Government on behalf of Tennessee it would be this, "Dear, Federal Government.
      We, the state of Tennessee and it's people, do hereby tell you to stay out of the affairs of this sovereign state. Should you continue your meddling we will consider succeeding from the Union.
      Yes, you read correctly, we will SUCCEED from the United States as it is our right granted by the Constitution. It is not treason, it is sovereignty."

    • Yep. Tennessee was right on this one. It's nice to see some of the states trying to get big government off their backs, especially as we have socialism spreading like an epidemic in our government. Tennessee was the home of Sgt. Alvin York- it would be quite interesting to see what they do, since this is a part of their culture.
