According to Greenwire,
The birds died from exposure to natural gas well reserve pits and waste water storage facilities at Exxon Mobil drilling and production facilities in Colorado, Kansas, Oklahoma, Texas and Wyoming between 2004 and 2009.
In addition to paying around $7,000 for each bird killed, Exxon has agreed to make corrective measures to its facilities in order to prevent future deaths from occurring. The oil company has stated that it's already spent an estimated $2.5 million on such efforts.
From Greenwire:
"The environmental compliance plan that Exxon Mobil has agreed to in this multi-district plea agreement is an important step in protecting migratory birds in these five states," said John Cruden, acting assistant attorney general for the Justice Department's Environment and Natural Resources Division.
Exxon has also been used as an example for companies who might currently be in violation of the Migratory Bird Treaty Act--an act that mandates preventative measures to protect migratory birds. And, for Exxon's part, the company has evidently been cooperative and willing to take corrective action.

Oh wow. I didn't even know about this. How about they pay $600,000 per bird? This fine is a slap on the wrist and it's going to keep happening. It's no different than the wildlife that dies from mine runoff. There was recently a 30 mile stretch of streams near me that is essentially dead. The mining company is dodging the bullet, of course, saying there is too little proof that they are the "sole" cause. What a load of bullshit. It's just disgusting.
Exxon is most definitely in violation with the Migratory Birds Act. I hope they make an example of them. At least Exxon is admitting fault.
I've also wondered how logging companies don't fall under the Act when they clearcut hundreds of acres of habitat.

which group is supposed to be monitoring this? it sounds like some other people might be dropping the ball. or were people aware. i would be interested in seeing if there was some documentation prior to this discovery of letters or grievances made and how long officials knew about this.

How about using alternate means of transport so companies like this won't have the funds anymore to screw up the world?

A drop in the bucket for the multi billion dollar business? They spent 2.5 million dollars already to prevent future deaths? WTF, unreal how America works. You get a million dollar fine for downloading music, but killing 85 endangered animals gets you $600,000. Fucked up system.

Although this is sad and utterly inhumane, could a bit of that money go towards my college education? I'm nearly crying at the fact that I have 11k left on my 53k tuition and can't find a co-signer for a loan.
Exxon, do some good PR and help me go to school.

all companies in violation could be used as a unified example. or a myriad of examples, painting an honest picture of how invasive industry has been to our planet.

$600,000 isn't much for Exxon, but at least they have to take steps to improve their facilities for these birds.

Surprising, but they probably deduced it would be cheaper to plead guilty than fight the lawsuit.
