That the House of Representatives has moved swiftly on anything is stunning in and of itself. More stunning, this is in response to a single independent report by conservative activists, with no follow-up investigation, no hearings, not even being provided a copy of the full, unedited video tapes shot by conservative activists James O’Keefe and Hannah Giles at a couple of ACORN offices.
This is serious stuff here. This is not a game of gotcha, of cheap political points, of practical jokes — not when this is money that helps in many real ways in impoverished communities around our country.
It is vital to assess how this backlash was accepted so quickly in light of videos that were from someone whose films are funded by conservative backers, videos that misrepresented ACORN through editing and not disclosing other failed attempts at their desired response, and may well have been dubbed over, if O’Keefe would dare to release the unedited tapes in their real context to prove otherwise.
A significant reason that this ACORN backlash has moved through Congress like Montezuma’s Revenge is that this particular hidden camera stunt had the ring of “child prostitution” in it, which most politicians of either party would run from rather than dispute its irrelevance. “Anyone defending ACORN is for child prostitution” is an immediate fallacious meme. It’s not like we’re talking about the Catholic Church here, which still gets federal funding.
Noteworthy is that there have not been any previous allegations between child prostitution and ACORN. In this weekend’s LA Times, O’Keefe himself asserts that this ruse had nothing to do with prostitution, importing underage sex workers, or tax help for starting up a business.
“Politicians are getting elected single-handedly due to this organization,” he said. “No one was holding this organization accountable. No one in the media is putting pressure on them. We wanted to do a stunt and see what we could find.”
That’s what this is really about: the elections, and the threat that has been hyped tirelessly that ACORN is in some way stealing your vote.
Before I digress into the long campaign to smear ACORN because of its successful voter registration, I don’t want to be accused to changing the subject to the elections. O’Keefe clearly stated that is what these stunts were about from the beginning.
There is much to dispute in O’Keefe’s quote. There is no evidence whatsoever that politicians are getting elected single-handedly by ACORN, and it is a wild exaggeration. Many claims of voter fraud are made, few instances ever occur.

It is worth noting here that what transpired on O’Keefe’s videotape were conversations about hypothetical situations–not actual prostitution, no actual crime, and not proof of an agency-wide policy or program involving prostitution or illegal immigrants. In fact, O’Keefe’s experiment proves this–that several other ACORN offices would not be ensnared by their absurd scenario, and turned away these provocateurs. One office in Philadelphia filed a police report because they were alarmed by the pair.
Ironically, the only thing illegal in some of these tapes is that O’Keefe is filming illegally. States like California and Maryland have strict consent laws about surreptitious recording, which is why the news and entertainment industries have long figured out workarounds for hidden cameras. (Hint: Vegas.)

In Food Lion v. ABC , a store was shown in an undercover segment engaging in unsanitary techniques and accused Food Lion of selling rat-gnawed cheese, meat that was past its expiration date and old fish and ham that had been washed in bleach to kill the smell. Food lion denied the allegations and sued ABC for trespass. A jury ruled against ABC and awarded Food Lion punitive damages for the investigation involving ABC journalists lying on their application forms and assumed positions under false pretenses. (here). The Fourth Circuit however wiped out the punitive damage award while upholding the verdicts of trespass and breach of loyalty with awards of only $1 for each.
This case would come closest to a case out of the Seventh Circuit. Judge Richard Posner wrote the decision in Desnick v. ABC where investigative reporters went undercover in 1993 to show that employees of the Desnick eye clinic had tampered with the clinic’s auto-refractor, the machine used to detect cataracts so that the machine produced false diagnoses to find cataracts (and require procedures). The court rejected wiretapping claims (based on the state’s one-party consent rules) as well as trespass and defamation claims. On trespass, the court noted that the reporters were allowed into areas open to new patients. Posner relied on the consent to the entry to negate the trespass claim even when the entrant “has intentions that if known to the owner of the property would cause him . . . to revoke his consent.”
That seems quite close to the ACORN case. Maryland does appear to be a state requiring the consent of all parties, which would allow for a criminal charge and a difference with the Illinois case. Such charges are being called for by some in Maryland, here.
It would make a difficult civil case. More importantly, ACORN will have to decide whether the powder is worth the prize in keeping this scandal alive while it is also facing various charges of illegal practices related to voter registration.

ABC: Rehnquist’s interpretation laid the groundwork for an entity to sue after being “punished” by Congress-in ACORN’s case cutting off their federal funds-which ACORN may claim legislation deemed “punishment” without the benefit of a trial, and thus, a bill of attainder.
This could be construed as ACORN inadvertently or overtly throwing down a gauntlet to Congress, as Congress has the power to open up widespread investigations, hearings, and the power to subpoena ACORN.
The President, through his Department of Justice, has the same power to investigate ACORN. Even so, Obama’s response to ACORN and Congress voting to cut off their funds was rather revealing: Obama, when pressed, stated that he “wasn’t following closely” what was “going on” with ACORN, that it wasn’t a “big priority”.

The funny part about your "civics lesson" is that it is misinformation. Congress does have the jurisdiction to investigate and determine whether or not ACORN is liable for these allegations. Their powers may not include criminal action, which would require judicial jurisdiction. However, they do have the power to revoke funding. Where do you think impeachment comes from? The legislature.
A civics lesson for you. The executive branch executes the laws set forth by the legislative branch. The legislative branch also determines the fiscal policy of the federal government. Finally, the judicial branch maintains the constitutionality of the laws set forth by the legislature.

If he was dressed like that in the video I'm guessing the ACORN employees caught on tape took it as a practical joke and were playing along.

The unedited video is definitely something I'd like to see. This was NOT a vigilante act - it was political move funded by a political party. We all know the Republican Party has dogged determination when they decide something is to be trashed via the echo machine aka tv news.
That said, I can understand why an extremely active political organization would shy away from an investigation. No doubt it's full of routes for politicians to get money where they think it should go quietly (and probably illegally). This one just happens to belong to the Democratic Party.
The most appalling part of this whole thing is that this video was swallowed wholesale as investigative reporting by "news" stations and even the Daily Show.
I hope this kind of thing (done well) happens in more places more often! Just, you know, to more Republican organizations than Democratic ones... :-\

ACORN's being cast out is due to its rocky past and questionable motives. Start by looking at its birth and founders. This agreement was reached quickly from both sides b/c Democrats in office with ties to the organization do not want an investigation. It's sad we are victims of our own liberal media which is based on what you can insinuate and not the truth.
It's interesting that both the Republicans and Democrats have used various organizations for the same motives of "A Home for Every Family." But these organizations have been used to produce plenty of campaign $ and support for their favored party.

I've been looking at Big Government.com, and it's leans to the right in a lot of issues. It's also ran by Andrew Breitbart who happens to be a conservative journalist and commentator.
I also have yet to see a FULL and Unedited view of all tapes, just the edited full versions. There is no indication on what persuasive measures were used to get these people to say or react the way they have. As I am sure, there is no unedited versions available. This kind of Gotcha Journalism could be used to make the president look Anti-American or Faxed News Liberal.
The fact they only have 5 ACORN offices on tape is not decisive proof every office is corrupt; only proof that there is a fraction of offices who might be engaged in less than favorable activity. It's not guaranteed that every ACORN conducts business in the same way.
As said before, I continue to reserve judgment on this situation.

I see no "secret" motive that is exposed, they wanted to bust acorn wasting the endless supply of money they get from us.
The networks did this kind of hidden video all the time and were above reproach.
The rule as i understand it is that 2 people have to know about the hidden cam which is clearly the case here.
And this post implies that the videos were overdubbed or edited --- can you prove that?
No you can't because it didn't happen.

i can, and I'm not a lawyer. First, I want all the outtakes and I will require all witnesses on both sides to testify under oath.
I don't need a law degree to proclaim that the so-called expose video falls fall short of the burden of proof in a court of law. Surely you don't think this POS hit-peice has a legal leg to stand on?
Furthermore, the action taken is illegal in several states, including some of the states in question.
You'd be naive to believe that ACORN is not preparing to sue O'keefe and his Jesus Ho.

Exactly its a crime to unknowingly videotape Law Enforcement....for that reason. They don't follow the law and the backlash by the public would be tremendous if we were allowed to tape and point out poor ethics by municipalities and up.
I actually know a guy who hid in a bush with his camera, videotaped a police officer and a young man which escalated to the young man fleeing and being shot in the back by the officer.....because he did not identify that he was there and recording, the locals and fed jumped his ass and threatened hard time in the pen if the vid was used.....solely because it showed what ACTUALLY happened and incriminated the local LE for shooting and killing an unarmed man who was fleeing.
And on the ACORN subject, its just a money filtering/fraud source anyway. They close this one quickly because they do not want people looking into the 200 some odd business that officials use ACORN for to funnel that money. Eliminate the need to dig deeper and start a new charity to funnel through....thats politics.
