Poland okays forcible castration for pedophiles

WARSAW (Reuters) - Poland on Friday approved a law making chemical castration mandatory for pedophiles in some cases, sparking criticism from human rights groups.

Under the law, sponsored by Poland's center-right government, pedophiles convicted of raping children under the age of 15 years or a close relative would have to undergo chemical therapy on their release from prison.

"The purpose of this action is to improve the mental health of the convict, to lower his libido and thereby to reduce the risk of another crime being committed by the same person," the government said in a statement.

Prime Minister Donald Tusk said late last year he wanted obligatory castration for pedophiles, whom he branded 'degenerates'. Tusk said he did not believe "one can use the term 'human' for such individuals, such creatures."

"Therefore I don't think protection of human rights should refer to these kind of events," Tusk also said.

His remarks drew criticism from human rights groups but he never retracted them.

"Introducing any mandatory treatment raises doubts as such a requirement is never reasonable and life can always produce cases that lawmakers could never have even dreamt of," said Piotr Kladoczny from the Helsinki Foundation of Human Rights.

"If somebody is of sound mind, we punish him. If he is sick, we try to cure him -- that's how it works in Polish law. This bill introduces both approaches. As far as I know, this makes our law the strictest in Europe on this issue," Kladoczny said.

The bill, which also increases prison sentences for rape and incest, must still be approved by the upper chamber of parliament. This is seen as a formality as Tusk's Civic Platform party holds a majority of its 100 seats.

    • While I'm not crazy of the idea of defending child rapist's, anyone who actually thinks this is justifiable is either a zealot or has a seriously archaic acceptance of all sorts of medieval violence whom children would be less safe around than actual rapists.

    • Two problems with this:

      1) Kids want to have sex--especially teenagers. Sure, some are raped or coerced or uneducated*, but aside from them--many know exactly what they are getting into. They make informed decisions to have sex. They consent in every way but legally. This is where cases of statutory rape get slippery. If an 18y/o has sex with a 16y/o, should this "pedophile" be castrated?

      2) Child molestation is a crime, and rightly so--particularly in cases of rape or coercion. But while pedophilia often leads to child molestation, it is important not to criminalize it. In doing so we criminalize sexuality as a whole. Pedophilia is difficult to classify because sexuality is so fluid. The concepts of "child" and "adult" are not culturally universal. The lines separating adoration and affection from lust and sexual intimacy are not so clear. Considering the... variety... of sexual fetishism, surely pedophilia is understandable, if not tolerable.

      Child molesters molesting children on a power trip should definitely be treated as criminals, but while pedophiles who lose control of their urges should be held accountable (we are responsible for our accidents), they deserve more pity--meaning less prison and alienation, and more counseling and rehabilitation. What a curse it is, and as a gay man, I can relate.

      *I am 100% for continued sex education starting at an early age. Knowledge is power. It's going to sound ridiculous, but I think people under 18 should be able to get a 'sex license' by passing an exam and with parental approval. In reality you can't stop kids from having sex anyway, but you can create an environment which promotes and fosters education and consideration.

Also, when you say "Kids want to have sex--especially teenagers", what do you mean by 'kids'? Specifically what age group do you refer to here? Just wondering since teenagers were mentioned in addition to 'kids'.

      Statutory rape and child molestation are really two totally different things. Yes, teenagers want to and will have sex. I don't know that anyone questions that. Young children however, while they are naturally curious about bodies and things, should not be preyed upon by adults.

      When I was very young I was interested in sex. This was largely due to the fact that a couple of adults in my life exposed me to things I wasn't quite ready for. It wasn't even necessarily a 'power trip' in both instances. The second time was more of a situation where the person took notice of a kid already too sexually advanced for her age and decided to "teach" her a little more. In retrospect I really do think this person saw the relationship as some sort of positive mutually beneficial thing, even though it was not.

      I don't agree with the idea of chemical castration (even if the libido is severely decreased, does the libidinal focus change? I'd guess no). But to say that pedophilia is just another fetish we should tolerate is absurd.

      At 4 I was sexualized by older boy and girl cousins (ages 9 - 14), this continued until I was 12. At age 12, having already had plenty of masturbation sessions, touchy feely "I'll show you mine if you show me yours" with older cousins and even had anal penetration with a couple of them, until a friend of my father's stayed the night, came into my bed, and he penetrated my rectum.

      Legally I was molested, I didn't say NO. I have pondered this event and been in counseling over this event for many years and in all honesty, I was terrified but I also enjoyed it. It did open Pandora's box for me and I began to be interested in seducing adults; both men and women.

      When I was 14 I began seeking out sex with adults. I was the one doing the seducing and the teasing and flirting. Sometimes I got "gifts" like cash, electronics, drugs, or alcohol. I seen several young people like myself at the time doing similar things in the rich Beverly Hilss, Hollywood, and Silverlake areas of Los Angeles. Mind you this was back in the 60's during the peak of the sexual revolution.

      Lots of adults were routinely having sex with kids. In the rich circle of friends that my father and mother belonged to (my father having owned a successful beauty salon in Beverly Hills and having movie producer's wives for clients), they even had cruises they put together so that the teenagers 14 and up could have their virginity taken by someone who was experienced and could teach the teens techniques. My parents drew the line on those parties on private yachts. It was really a crazy world I lived in back then.

      By the time I had reached the age of 18, I had already had over 1000 sexual partners. Its no wonder that I contracted HIV. Being that sexually active teenager and with no education about being safe or all the myriad of STD's I could have been exposed to. Its a miracle that I didn't get killed.

      Both my parents were very religious and sexuality was not allowed to be discussed in our home.

      My ultimate rebellion against them and their religious indoctrination came when I was 16 going on 17. I met a really nice and handsome guy who was 22 and homeless so I brought him home to my parents house and announced that he would be living with me in my bedroom.

      Of course that didn't go over very well with my mother who wanted to throw me out on the street and disown me as a son for what she called "being gay". The funny thing was that I didn't have sex with this guy, I just wanted him to sleep next to me and hold me all night long. My father reacted differently. He didn't want me to leave home, and so he overruled my mother and eventually made an apartment for me out in the garage.

      My special friend ended up staying with me for about 5 months until he got arrested for stealing a stereo out of a car. Then I became a Jehovah's witness and when I saw him again, I told him I couldn't be his friend anymore, through tears in my eyes, because Jehovah wouldn't approve of our love. I have never seen him again. Although I often think about him and wish him well. I never did get his real name, I only knew his assumed name which was Israel.

      I was an extremely sexually active youth well into my mid twenties.

      The irony today is that I have ED due to the many HIV medications I have to take and so sex with my domestic partner is interesting. I can't take the Viagra or the other ED pills because they interact with my HIV meds and give me a huge headache and acid stomach. Its not worth taking those pills.

      After extensive counseling and personal reflection, I feel that I have no regrets about the past and cannot see what happened to me as a child as something evil. I learned from all those experiences and I have made amends where ever it was appropriate and possible.

      amydeanne -- Like you said, all kids are naturally curious about their bodies and bodily functions. I honestly do believe that kids want to sexually experiment. When I was a young child, I experimented on my own sexually, just short of masturbation. I do not, however, believe they should be "preyed" on by adults--including pedophiles.

      This is taboo ground here. We don't normally talk about kids' sexuality in Western society. It concerns me, though, because I know of the things that kids get into, and things like child pregnancy, HIV, and not so much rape (unfortunately that is as natural as sex itself) as coercion. When it comes to sex, just like drugs, kids don't know what they're getting into--and that's a problem, because kids are going to have sex regardless of how much our society shelters them from it.

      I have no interest in pursuing sex with kids; I am a grown man interested in other men (bears, if you're curious). I do however have the humanitarian interest in educating them and enabling them to make informed decisions.

      Sheltering kids from sex is risky and a flawed approach. If we expose kids to sex, then surely curiosity will lead more to have sex, even with adults. That is probably why we do shelter them, all in good intentions. But the good intentions fail; be keeping children ignorant we force them to enter sexual situations unprepared.

      We need to be less concerned with exposing kids to sex or prohibiting child sexuality, and more with educating them so that they are prepared for the inevitable--no matter when it comes. Scratch that--we can't just educate them. We have to train and condition them to approach sex rationally and safely, considering contraception and protection. This will involve experimentation, as it should... though I would definitely favor handing out condoms, lube, dildos and fleshlights over some kind of sex mentor. A sex mentor would have to be able to remain objective (we all know sex can get out of hand) and I just don't have that kind of confidence in humanity right now.

      As for pedophiles: we should tolerate the fetish but not the action. People are sexually attracted to kids. So what? We can't prevent that. It's probably as natural as the rest of sexuality. What we should NOT tolerate is when that fetish leads to rape, coercion, or molestation of children. Like I said, we are responsible for our accidents. A pedophile who slips should definitely be punished, sued--whatever. But we shouldn't alienate them, give them ridiculously long sentences, or castrate them; we should counsel them to control their urges and think of the children--even those who do consent.

    • One other thing you have to consider, false testimony, lynch mob mentality parents who don't care about the facts.

      Where do you draw the line at consensual sex?

      Think about the case of the 19 year old guy with the 16 year old mother who was sent to prison for statutory rape, when the two got married and had a baby. That was very recent.

      Under this law, he would be considered a pedophile and would have received chemical sterilization. Is that justice?

I didn't hear about that one, but it is as stupid as that girl in New Jersey being brought on child pornpgraphy charges for posting nude pictures of herself on the internet.     • I have to agree with Jubal about molestation and chemical castration. Molestation is about power and it is a specific mental illness. Chemical castration will not keep a pedophile from molesting a child. It will simply make it impossible for the molestor to have a hard on.
      Just because he can not physically have a hard on does not mean that the act of molestation can not still hold excitement for the pedophile.

      In the case of a true pedophile, the only thing that will keep him (or her, just not as frequently) from committing the crime is to isolate him in a situation where he does not have access to children. Unfortunately, this is jail or some kind of institutionalization in a psychiatric setting.

      What I don't agree with is the death penalty for molestation unless it resulted in the death of the child.

      Sexual crimes are about control, fear and torture, if the person is so inclined.

    • I agree with Nettle you cant do the hole eye for an eye form of punishment it makes way to many holes in the prosecution and what do we go back to cutting off the arms of crooks and killing every convicted murderer unless their rich. If we want to make the advancements of a modern society we cant govern by emotion. And whats to say he will stop maybe instead of rape hell move on to mass murder. what ever the case the only way we can effectively deal with crime is a better jail system and consoling. or maybe it's the only way possible only time will tell one way if it stops them i could care less

    • this bill isn't just promoting the chemical castration of pedophiles, but is also increasing prison sentences for those charged with raping and/or molesting a child. I see where people are coming from as far as saying its 'cruel and unusual' but think about the lives of these kids. they have to live with painful memories of their abuse day in and day out for the rest of their lives. anyone who hurts a child in that way deserves far more than just chemical castration in my opinion. and yea rape isn't just about sexual gratification but you have to admit thats a part of it as a whole, most sexual offenders get off on the power trip. so if their overall libido is lowered, then chances are they wont commit crimes of that nature again.

    • Jeez, that's so not cool. Pedos are sick and do horrible things to people, but it's not right to take away their balls, chemically or physically.

      1) They could have been falsely accused.

      2) I dunno about Poland, but we're not eye-for-an-eye. Most people here disagree with the death penalty because we don't want to stoop down to their level or we don't have the authority to take away a life. We don't really get to decide who gets their balls or not.

      3) Lock them up and throw away the key if you really think they can't be rehabilitated. Life in jail is really the best way to keep them away from kids.I know a lot of pedos who don't necessarily "get off" with using their bait and tackle.

      4) They are human. Even though they do some of the most heinous things imaginable, they are still people. They need help and can be rehabilitated. Also, not all pedos are repeat offenders. I saw a documentary about this guy in his 20s who felt estranged from people his own age. He started chatting online with a girl who was 15 and he ended up going out with her and dating her. Then the police busted into his apartment WHILE they were having sex for the first time and he was charged with pedophilia. Do you think that guy deserves to be castrated or would you give him a second chance with counseling and mental help?

      Back in the day, people talked about and looked down on gays and lesbians as freaks and they were shunned and mistreated and folks tried all sorts of things to try to make them "normal".. We've come a long way since those days, and rightly so. Most folks realize nowadays that gays are born gay, that it's not a choice they make, it's simply the way they are.

      Today, we look upon pedophiles as sick perverts worthy of death, similar to how we use to see gays. The things pedophiles do to little kids make us sick and angry, as it should because no one should be able to do those things to little kids. But I wonder, are pedophiles BORN that way, just as we have learned that gays are? Is it possible that, just like homosexuals, they have no control over their sexual desires, or who they are attracted to?

      If it's true that they are, indeed, born that way, then should we condemn them for anything except acting on their desires? Can, and should we, blame them for being "who they are"? We can hold it against them for actually making advances to young children, but should we have no compassion for them because they have desires they have no control over and have no outlet for?

    • Wow! While emotionally I'm all for this, this does seem to be a potential law that is in defiance of human rights acts. I'm not saying that they don't deserve something like this, but what happens when the law is passed and someone is wrongly accused? If it's found out later that they were not a rapist or pedophile, then how does the government apologize for something like that? And if you do set all emotions aside, while they are not "normal" people by any sense, they are still human beings. They just have something VERY wrong with their programming.

    • Yeah, I'm going to take the sexism side on this. This law only targets men, but they aren't the only ones to commit such crimes. I think Depra is a women's birth control hormone, so it would just make you more woman like, hormonally.

      With all the female teachers in the news for these crimes, I don't think that pedophilia is limited to men. There is definatly more to it than sexual desire, so it cannot be blanketly treated as such.

      No i understand that pedophilia is a major issue and that many offenders are in fact repeat offenders. However, that doesnt mean we should just go around chopping balls off. Thats a very barbaric and emotional response. Education is the key to solving the problem.

      Think about it this way. Do you know how many people are put in jail for crimes they didnt commit? What if you were picked up off the street, sentenced to jail time for a crime you didnt commit, put on a sexual offenders list that EVERYONE has access to and on top of that have your balls forcibly removed?

      Just making a point. I realize the article is about chemical castration which has nothing to do with a scalpel. Chemical may curtail, but there is no guarantee that it will stop them. This is a slippery slope.

    • I think it's something that has to be tried -- unlike, say, the introduction of Tazer guns -- I feel there is so harm in testing this method on individuals who have commited a horrific crime.

      If it fails, then we would need to move on to something else... but what?

    • Chemical castration will not work. Molesting is not about sexual gratification as much as it is about power over someone.

      You can still molest children even if you can't get your penis hard. You can use ramrods, or sticks, or simply just touch their genitals.

      You people need to really think about what you are advocating.

      Its much like the death penalty. Its not a deterrent to committing murder. Most murders are crimes of passion. The last thing on your mind when you are murdering someone in a crime of passion is "oh god, I shouldn't murder my husband, or my wife, I might get the death penalty", no you are thinking "that fucking bitch is dead, or that fucking dick is dead."

      wow, you have a good understanding of the criminal mind!
      I remember a case I helped my dad with in which the abuser used the end of a frying pan to sexually abuse a 5 year old. My dad quit his job after that.
      The perv didn't need his penis to be erect... He is mentally ill and castration will never solve that or deter such actions. I mean I'm from Texas and we have a pretty well known death penalty record, but we are still a state with high murder rates. These laws will never work.

      jubal, i agree that this will not control all urges or solve the problem entirely. i have heard quite a few people who have been convicted of this horrible act say that this is something they want done to them. some of them have had success. there have been a few (hard to watch) shows done on pedophiles where their discust with their own urges has lead them to do things like castrate themselves.
      i think it is really questionable do this to someone but just for the sake of discussion...
