A trial challenging California’s Proposition 8, which bans same-sex marriage, began January 11. The two same-sex couples at the heart of the case are arguing that the ban is unconstitutional, and no matter what the outcome of the case in district court, it will likely head to the U.S. Supreme Court.

The outcome of the case is expected to set precedent for years and shape society in the same ways as landmark cases like Brown v. Board of Education and Roe v. Wade. It’s also expected to spark protests around the country.

Do you think banning same-sex marriage is unconstitutional? How do you think the case will turn out?

    • I don't really know how there would be a strong argument in favor of banning same sex marriages. The only thing they really have is the religious argument. Everything else - procreation, family structure, etc. is easily countered.

      The only reason it passed in California is because the mormons scared people into thinking that gays were going to corrupt children.

    • I can't imagine what argument could ever hold up in court in support of proposition 8. Civil unions are not equal to marriage, marriage is a government-recognized institution that functions separately from religion, gay marriage would not force any institution to do things against their will, and true equality can come only when everyone has the same right, and their unions are all called the same thing.

      The only thing I wish was said in Trace Watson's last point was that people are expecting to be protected from the people that their 'free speech' imposes limitations on. It's like the Republican senators wishing they had voted against allowing women to file charges of rape anonymously. What the fuck are they thinking.
