The modified alfalfa seed at the heart of the dispute has been engineered to be immune to Monsanto’s flagship herbicide Roundup. Monsanto intervened in a 2007 federal district court ruling that the Department of Agriculture’s approval of GE alfalfa was illegal. The Center for Food Safety (CFS) filed a 2006 lawsuit on behalf of a coalition of non-profits and farmers who wished to retain the choice to plant non-GE alfalfa. CFS was victorious in this case – in addition CFS has won two appeals by Monsanto in the Court of Appeals for the Ninth Circuit: in 2008 and again in 2009. Now, upon Monsanto’s insistence, the Supreme Court has agreed to hear the case.
“This is truly a ‘David versus Goliath’ struggle, between public interest non-profits and a corporation bent on nothing less than domination of our food system,” said Andrew Kimbrell, executive director of the Center for Food Safety. “That Monsanto has pushed this case all the way to the Supreme Court, even though USDA’s court-ordered analysis is now complete, and the U.S. government actively opposed further litigation in this matter, underscores the great lengths that Monsanto will go to further its mission of patent control of our food system and selling more pesticides.”
The federal district court required the Department of Agriculture to undertake an Environmental Impact Statement (EIS) assessing the impacts of the crop on the environment and on farmers; the first time the U.S. government had ever undertaken such analysis for any GE crop. The court permitted farmers that had already planted to continue, but halted any further planting pending the agency’s re-assessment. That the EIS was required is not in dispute; the legal issue is only the scope of relief while USDA analyzed the impacts of the crop for the first time.
In October 2009 Monsanto asked the Supreme Court to hear further arguments. In response, the Center and the U.S. government separately opposed that request the following December. USDA completed the first draft of the EIS in December 2009.
“Although we believe a further hearing is unnecessary, we are confident we will again prevail, as the lower courts have already three times determined,” continued Kimbrell. “We hope that this grand stage will further inform the public, policymakers and the media about the significant risks of genetically engineered crops and the vital need to protect farmers and the environment.”
Alfalfa is the fourth most widely grown crop in the U.S. and a key source of dairy forage. It is the first perennial crop to be genetically engineered. It is open-pollinated by bees, which can cross-pollinate at distances of several miles, spreading the patented, foreign DNA to conventional and organic crops. Such biological contamination threatens the livelihood of organic farmers and dairies, since the U.S. Organic standard prohibits genetic engineering, and alfalfa exporters, since most overseas governments also reject GE-contaminated crops.
“We trust the Supreme Court will uphold farmers right to choose their crop of choice and protect us from the constant fear of contamination from GE crops,” said Phil Geertson, an alfalfa farmer based in Idaho.

A 2009 study showed that the use of genetically modified crops, the vast majority Monsanto’s “roundup ready” crops, has caused over the last 13 years a dramatic increase in herbicide use, by 383 million pounds, and concomitant harms to the environment and human health.
The U.S. Department of Justice has undertaken an investigation of Monsanto regarding violations of anti-trust and monopoly laws and is set to hold public hearings in spring 2010.
Another 2009 study showed that, despite decades of promises and hype, GE crops do not increase yields.

Yes, but don't you think this may well open up more investigation into how BT corn, cotton, and GM soy were then approved? Also, the fact that it was not done properly should set off red flags regading its safety. I wish I had seen your reply sooner. Hope you come back to answer the question.

This case is not about the merits or demerits of GM alfalfa. It is about whether the Court of first instance (Federal District Court 2007) and the appeal Court (Court of Appeals for the Ninth Circuit 2008) correctly decided that the USDA did not carry out a proper Environmental Impact Study (EIS) or not. Both these Courts found that the USDA had erred in not conducting a proper EIS and ordered the USDA to do so. The chances of the Supreme Court overruling the judges of the two aforesaid Courts are really slim and it could be argued that Monsanto’s ulterior motives are frivolous and vindictive. However, this is typical of certain large Corporates who continuously take on the little man in expensive Court battles. Their aim is to bankrupt and wear down the less affluent opponent. It is commonly known as “grandstanding”.
In South Africa, Monsanto was twice ordered to remove a false adverts which claimed that no scientific tests had proved that GM foods were unsafe. The applicant proved that there were scientific studies which proved that GM foods were unsafe. Monsanto did not argue this but attempted to prove the “benefits” of GM. The Judges ruled that this was irrelevant because it was not the subject of the case and ordered the advert to be removed. So true, and sad. Monoculture is taking the place of biodiversity and many farmers' livelihoods are at stake due to transgenic contamination and the killing of the seed. Once the genie is out of the bottle it is hard to put it back. However, there is still hope that justice can be done regarding those who so irresponsibly and criminally took it upon themselves to turn this world into their personal petrie dish at the expense of our environment and our health. They have much to atone for.

These guys need to be controlled. For too long this company has been running roughshod over all the farmers and the consumers. Why should they own crops because the pollen got carried by the wind to non- monsanto crops. Their bovine growth hormone has been affecting the deveopment of children, and the FDA won't stop them. Our GOVT has to pay V.A. benefits for their Agent Orange use in Vietnam. We nearly killed off the birds with their DDT, Their corn causes organ failure in rats. So, in spite of all the bad press and the looming expiation of the "roundup ready" Patent, they will now come out with a new gene, and twist Dekalb and Pioneer's arm to force them to use it. This is our food we are talking about. This is our farmers' lives we're talking about. I say, check those FDA guys, to see what they've gotten from monsanto. Sooner or later they will mess up, and let the wrong pollen get away from them, and then we will really be sorry...

Exactly. They wouldn't have pushed the USSC for a patent and no labels if their intention was wholly altruistic. All they really have are their ties to DC, their bribery of other governments, their lies to the farmers of India, Latin America, and America, their bullying tactics, their bogus lawsuits, their deforestation, and their woefully inadequate and fake tests... and of course, their money which they think will buy them anything. How I wish we could see a sea of thousands of farmers from all over the world marching here as this case unfolds demanding justice. It is good to see that the wheels of justice still turn in the right direction. The outcome of this could change the direction of the sustainable food movement for the better. I am hoping very hard. Our environment and our health depend on it. And shame on the FDA for supporting these criminals, and that is just what they are... Agent Orange, DDT, Dioxin, PCBS, ... GMOS. It's time for this to end.

Samantha, the contamination of food is part of the strategy of the big corporates. They plan to have so much GM food that people will no longer have a choice. That is why it is so important for the ordinary American citizens to stand up and be counted. The big corporates have got the administration in their hands because the ordinary citizens have allowed them to take control. You need to let your politicians know that you want labeling. Once GM alfalfa is unregulated it will spread and comtaminate all alfalfa. Monsanto' s plan is that all American farmers should become monoculturists using RoundUP to make Monsanto's version of "no-till" agriculture the only system of farming in the USA. Read the USDA's APHIS report. They rely heavily on Monsanto and it's partner Forage Genetics Inc (FGI) research to reach their conclusions. You all need to vote against this.
