The court agreed Monday to consider whether the protesters' message, no matter how provocative and upsetting, is protected by the First Amendment. Members of a Kansas-based church have picketed military funerals to spread their belief that U.S. deaths in Afghanistan and Iraq are punishment for the nation's tolerance of homosexuality.
The justices will hear an appeal from the father of a Marine killed in Iraq to reinstate a $5 million verdict against the protesters, after they picketed outside his son's funeral in Maryland.
A jury in Baltimore awarded Albert Snyder damages for emotional distress and invasion of privacy, but a federal appeals court threw out the verdict. The 4th U.S. Circuit Court of Appeals said the signs contained "imaginative and hyperbolic rhetoric" protected by the First Amendment.
The funeral for Marine Lance Cpl. Matthew Snyder in Westminster, Md., was among many that have been picketed by members of the fundamentalist Westboro Baptist Church in Kansas. Westboro pastor Fred Phelps and other members have used the funeral protests to spread their belief that U.S. deaths in the Iraq war are punishment for the nation's tolerance of homosexuality. One of the signs at Snyder's funeral combined the U.S. Marine Corps motto with a slur against gay men.
Other signs carred by members of the Topeka, Kan.-based church said, "America is Doomed," "God Hates the USA/Thank God for 9/11," "Priests Rape Boys" and "Thank God for IEDs," a reference to the roadside bombs that have killed many U.S. troops in Iraq and Afghanistan.
The case will be argued in the fall.
The case is Snyder v. Phelps, 09-751.

I am a Christian. These folks represent themselves to be Christians, and yet they are virulently anti-Christian. They represent the antithesis of what Christ was- (and is) pure love, manifested in the flesh. It is my sincere hope that this hate group will be brought to their knees and bankrupted by a judgement against them- it happened to the Klan (I read with great satisfaction about a Black woman who was given the deed to a building formerly owned by the Klan for use as a meeting house.) Let them preach their hate, it's a free country. We just need to make sure to encourage people that it falls on deaf ears and show people how best to respond to this kind of hate; by not even acknowledging it. I think psychologists have observed similar behavior in pre-teen children and teenagers: begging for attention, and lashing out by whatever means necessary to get it. Showing that their petty attempts influence or inspire hatred in others only fuels their fire. I think ignoring them is likely the best option.

I think they have gone too far. As a religious group, shouldn't their focus be on their God rather than harassing people of other beliefs? I myself, am not gay but I will choose to respect anybody regardless of their beliefs. This world is filled with different people. It just seems wrong to go to someone elses's funeral while there are grieving loved ones present, just to promote your own selfish agenda. Death isn't funny. What seriously gets me is the shirt that says "Godhatesfags.com". No one will respect a religious group that shows outward discrimination. Doesn't God love everyone?

As much as I hate these people, and I really really do, the last thing they need is more publicity. They said it themselves, they're happy about going to court. If they lose, they're victims, martyrs for free speech. And it sets a precedent for attack on any other group's or individual's free speech. If they win it will, in their mind, validate everything they're doing. While I can't imagine the pain of having a loved one die and then having this despicable bunch show up, ignoring them just might be the best choice. The less media attention they get the less their message is heard, making them obsolete. That being said, since it's happening anyways I hope they lose and go bankrupt.

I totally disagree with these guys and think their message is way off the mark and seriously disgusting--but fighting them on freedom of speech grounds is just pointless and is only going to embolden them to do more stupid stuff like this when they eventually win. (see Nazi's vs. Scokie, Illinois)
The much better defense is to do like the protesters in CA did a couple weeks ago. Fred and his gang showed up with like 70 ignorant haters holding poorly worded and ignorant signs and they were met with about 4000 people peacefully "protesting" them (and mocking them in their ignorance) with bigger and more sarcastic signs.
So instead of suing them -- make the first amendment work in your favor and protest them on a bigger scale or completely ignore them and don't publish/print anything they say -- thus denying them their 15 minutes and letting them crawl back under the rock where they came from.
