Florida "Bong Bill" Passes
Selling paraphernalia will put retailers one toke over the line

Hey stoners, if you're in need of a bong or pipe, you'd be wise to buy one while you can.

A bill passed Wednesday will make it illegal in Florida to sell the drug paraphernalia in most head shops.

The so-called "Bong Bill" passed by the Senate and then overwhelmingly passed 115-0 in the House now heads to Gov. Crist for final approval.

The bill prohibits the sale of the items by businesses that don't make at least 75 percent of their money from tobacco sales or make over 25 percent from sale of the prohibited items.

Violators could face up to a year in jail.

The bill, sponsored by Rep. Darryl Rouson, of St. Petersburg, would go into effect July 1.

“I’ve been fighting the pipe industry for the longest, because it is all a part of the drug trade and the criminal enterprise that we know exists and destroys neighborhoods, families and order in our society,” Rouson said earlier this month.

The head shops aren't fooling Rouson when they say the pipes and bongs are used for legal tobacco.

“When is the last time you stopped at a red light and saw someone smoking a hit of tobacco out of one of these one-shooters or water pipes?” said Rouson.

Last year, Rouson also proposed HB 187, which calls for an extra sales tax on smoking paraphernalia, because he wanted to use the revenue for DARE (Drug Abuse Resistance Education) programs, that were being cut.

“Florida has a conscience and an awareness that marijuana and the smoking and ingesting of it is not healthy for an individual, nor is it healthy for public safety and the order in society,” Rouson said.

Looks like we won't be cracking this list anytime soon.

    • I love how the whole entire country is moving towards legalizing except florida. I live in Massachusetts and can smoke a bowl while i walk down the street with no problem from cops. I have an idea! get rid of these crapy laws and fines so the police and prison system can start worrying about REAL crimes like the thousands (probably millions actually) of homicides that go unsolved every year. Don't worry onemalefla, this bill wont last long.

      Hahaha i feel ya man, i didn't mean to devalue his comments. i simply wanted to give him a veiw of what may be the light at the end of the tunnel :) When u think of who lives in florida (senior citizens or so i've heard correct me if im wrong) its not suprising to see that they are falling a lil behind on the weed front.and i mean come on its a state that elected Jed Bush... let's not even get into the whole "recount" thing. The point is i feel you guys and maybe in the near future the nations stride toward legalizing will overpower the states fight against it. good luck waiting out the storm my fellow humans :)

    • It's just so shocking to me, that on one side of the country, California, my home state, people can be so open-minded. I'm sure as you all know, voting in nov. on marij. becoming legal.

      And theeeeeeeen, on the other side of the country, this bill passes! Can't you still buy "water-pipes" online anyways, or are they making it illegal for such items to be even shipped there?

      Stoners in Florida are still going to find ways to get bongs and pipes even with this bill passed, just a lot harder but will never fully stop anything. I mean, what are they really trying to do here? Stop people from smoking? Really?

      Here's what I see as the worst case scenario, people will buy rolling papers for rolling tobacco and everyone will be smoking joints again, but this bill is a complete waste of time.

      And my response to this statement:

      Well if a tobacco smoker actually did smoke tobacco outta a bong/pipe at a red light, and a cop see's that, well I bet they're gonna have a hard time getting out of that situation.

      Come on Florida, spend your time and money on things that really matter, like education!!! Whatever you think, you will not stop stoners from smoking and getting their stuff! Stoners will outsmart you!

      Eventually ordinary Americans will realize fact should not be 'spun', because it is dishonest. When facts are spun, the truth gets lost. It's time for everyone to counter their spin with facts. Eventually they will be too ashamed to lie in plain sight. Facts matter. The truth matters more. Spinning requires a certain amount of dishonesty. That should not be acceptable. Honesty must become a requirement.

    • I fail to understand how this bill will help the "pot problem". For one, in a time where the economy is in a troubled state, especially in the state of Florida which has one of the highest unemployment rates in the United States, why is government trying to remove a legitimate business? This creates two obvious problems: First, this is going to take away jobs and INCREASE unemployment. Second, good job Florida for getting rid of a TAXABLE enterprise. We all know that whatever the government can't tax, it makes illegal (See victim-less crimes).

      Brian_Green makes a good point in stating that this idea of prohibition actually creates a worse situation. This underground market feeds gangs with money, creates international cartel powerhouses and funds terrorism. The correlation to the speakeasies of the early 20th century should be case an point. I just don't understand why some drugs are considered socially acceptable, while others aren't. I'm not making an argument that marijuana doesn't alter one's state of mind, however, why are addicting drugs such as oxycodone so easy to get prescribed? Why is such a destructive drug such as alcohol legal? Or cigarettes, which extremely addicting and cause cancer so abundant? Yet, marijuana is still illegal. This whole idea of regulation in moderation is simply put: ill-conceived. Basically, you can't say you can do these drugs, but not these. Thats like saying, you can drink orange juice, but your not allowed to drink mountain dew (which also has a legal drug in called caffine.)

      Shutting down business is not the answer. Your shooting yourselves in the foot Florida; your killing your revenue in a State in dire need of economic help and your not solving the "pot problem".

      For an explanation, look at the average age of a Large chunk of the people that actually vote. Many of the younger people that would support "Legalization" just do not vote and the politicians know that.

      The bad part about the whole voting situation is that most of the young people who would vote for amendments regarding drug legislation are of college age or a little older (so they've probably had to leave the state due to a almost 14% state unemployment level). This means usually they live outside of their registered voting districts. So lets say, a bill is put up for ballot in a certain district like Tampa, but the person is registered in Daytona, they have to do a mail-in ballot. The same goes for elected officials, etc. And for these local elections, there isn't as much of reminders about mail-in ballots. I can't believe the bill passed 115 to 0. Yet Florida still lets walk-in clinics doll out xanax and oxycodone with an xray like they're candy.

      I Moved to Maryland now where Medical Cannibas is on the Ballot and was passed by the State Senate. Washington DC just legalized medicinal marijuana. I can't believe with all these states moving toward decriminalization, Florida, in its backward logic, decides to take a step in the exact opposite direction.

    • Why is it the wasted fringe of our society would like to go trough life in a semi consious mode. There is a very real possibility that many of the probems of our nation stem from the fact that when buisness almost revolves around the greasing of the corperate wheel almost invariably involves using the lunch beer or martini to sort of get things done. It might be considered a bribe but it does not bode well for the economy and the decisions being made under the influece. As a society we need to reevaluate the nessesity of using any type of drug in a buisness dealing. Mind altering substances cost more than the feel good to the indivigual.

      Because of Prohibition the Cartels have become so powerfull that they are now challenging the government for Power and Controle. If not for the backing of the U.S. the government of Mexico would have already fallen. The Cartels have more money than the Mexican government to buy weapons and pay for solldiers. Most of the Cartel bosses do not even use the drugs that they profit on and most of their street soldiers are not killing people because they are "high on drugs", they are doing it because they are "paid" to do it while the Cartel bosses continue to make billions from the black markets around the world that have been created by prohibition.

      It is PROHIBITION that has caused this, not the drugs themselves.

I do agree totally that Many drugs are very destructive but the war has only created a black market across the world that gives REAL terrorists a safe haven. Education and treatment will have better result as other countries have proved over the last 7or 8 years.

    • I often use a little one hit glass bullet, but we have several glass pipes and a big pretty glass bong. Some of our friends are using a vaporizer - we plan to make the switch soon.

      Many people blow glass in the pacific northwest, too bad Florida is so socially backward. Just another reason to avoid the deep South.

      I know you aren't asking me this question, but I thought I would respond anyway. Have you ever had a sip of beer? Have you ever had a social night out at the bar? What is the difference between drinking alcohol and smoking cannibis?
      As an occasional smoker, I can tell you, I enjoy spending a night in, watching a movie with some close friends and yes, smoking a joint. Nothing is missing from my life; I am a productive member of society. I am a full time student, and also hold down a full time job. I pay all of my bills on time, and out of all the pot smokers I know, I am the norm. We ALL have jobs and good GPA's. Not one of us is "weak-minded" or unhealthy.

      Florida is about like anywhere else, and different areas of the same communities have different views. I grew up in Florida in an area where people smoked on their front porches in plain view everyday without exception, where I literally as a teenager was walking down the street and was asked for a light from a complete stranger when I asked "you got a cigarette?" I got; "I don't have one but if you give me a light I'll pass this joint."

      On and on I could recount open minded, generous, interaction among many various types and colors of people...

      But hey let's forget every other state or area in the Union also has racists and closed minded bigots.

      Anyway, Florida being completely backwards and the "deep south" being all the things ignorant trolls like to call it.....

    • What seems obvious to me is that the state representatives in FL still seem to be under the impression that they can have an affect on marijuana use. As has already been stated, they can ban whatever they like. Stuff like this does indeed have an affect; but it's not an affect on marijuana consumption. All they're hurting is the legitimate businesses that are catering to it. Smokers and tokers will just switch. We have lots of experience. They've been trying to do this in various degrees for 30+ years. In spite of all their efforts, consumption has increased.

      The states have done it. The fed has done it. They refuse to observe the fact that it doesn't work. You cannot legislate away a thing the people want to do. The phrase; of, for, and by the people comes to mind.

      But the main error they're making is by labeling it bad, and a thing to be stopped. Nothing could further from the truth. All the attempts to curtail this have made it worse - not better. If this attitude had a grain of truth in it, then all these dire consequences to our youth would have already happened. I've not noticed any major changes - have you?

      If they want some changes then I have some suggestions:

      First is to realize that this prohibition "cure" is worse than the disease.
      2nd is to remove the unwarranted classification of marijuana as a schedule 1 drug.
      3rd is to release all prisoners, state and federal, that were incarcerated for marijuana.
      And lastly to allow the people in every state to decide for themselves, through the ballot box, just how they want marijuana handled in their state. No Federal restrictions.

      After that, if the Florida legislators want to do stuff like this then they get to deal with their own people. If they can..
