Love before the law: child custody set for overhaul - Society (2 Jul 10)
The idea is to introduce a presumption of joint custody over children, rather than the current presumption of a mother’s right to sole custody, according to a report in the Passauer Neue Presse newspaper.
Leutheusser-Schnarrenberger has told officials to draw up a draft to make the change, and intends to start it on the way to becoming law this autumn.
“Children should have the right that their fathers taken on responsibility and make joint-decisions over important things in their lives,” Stephan Thomae, family rights expert from Leutheusser-Schnarrenberger’s Free Democratic Party.
He said unmarried parents would share custody unless the mother – or presumably, the father - convinces a court to grant her sole custody over the child.
The Christian Democratic Union would seem to be in favour of the proposal, according to Ute Granold, who speaks on family matters for the parliamentary CDU.
“Living together should not be a prerequisite for joint custody,” she said.

I am a single custodial father who did not marry the mother. Not marrying her saved my butt. The reasons are numerous as to why I did not do so and I think more men should take into consideration what I did. After the fact.
At first I wanted to marry her, but she refused. This was a saving grace in disguise. For with all her bad credit, the emotional outbursts after our child was born and her general immaturity that started to take a toll very quickly. Then before my daughters first Christmas she had me falsely arrested and I didn't get out until after the first of the new year. This was the beginning of a long period of ups and downs. So after 11 years she decided she didn't want the kids, the responsibility of sharing in expenses because I had become disabled, and went to find out that the grass was not greener on the other side. But this time, because she had pulled this 3 prior times, was the end of the road for me. So no divorce. Just the battle of custody, which it was easy to prove she is an unfit mother, and child support.
So men pay attention to the early signs and don't "signs de paper."

I have been a feminist since the 60's. Feminists only strive for equal opportunity, equal pay for equal jobs, etc. My husband tells his friends, he is glad I am a feminist, because if anything happens to him (divorce or death), he knows I can move ahead with equal treatment. One man slammed a door to a restaurant in my face. I asked why did he do that, he said you feminists can do it all for yourself. My response said, manners, and plain consideration has nothing to do with feminism. In fact, I would hold the door for him. Men cannot control women, and women cannot control men. Equal is equal, like it or not.

Unmarried fathers get "automatic" joint custody? Why? Ex-husbands and unmarried fathers are notorious for absolutely no child support. People are totally unaware, custody and child support are totally separate.
Deadbeat dads hold it over the heads of the mothers who have an opportunity to get a better job other than where she and the child live, because it would interfere with "joint custody". If he could commit to having a child, why can't he commit to help financially raise the child? He doesn't want total custody, just someone who drops by when he feels like it, or calls to say is coming, and the child gets all excited, and he doesn't show. As a feminist I am so happy to see this! The only way to get past the stereotypical gender roles of our society is to make changes like this. I hate hearing stories about how hard it is for fathers to see their children, and mothers who make it impossible. This kind of legislation reflects a desire to make a better life for the children, not the parents. Yay!

interesting disclaimer..."if the father is willing and able" sort of makes me laugh, given that the anti abortion people seem to consider "willing and able" the default setting for the mother. should be interesting if it does come here, but I daresay our ongoing obsession with the whole abortion issue will muddy the waters.

That's a very good step in the right direction. Now they just need to fix alimony and child support laws to be equal for both partners. Get rid of this 'assumed' crap. If a woman can get sole custody and child support, why can't a man get the same? If a woman can claim that she would be terrible offset by a 'lifestyle change' from the divorce, why can they get a free check from their ex? Men have to fight 20x harder to get those same 'privileges'. There are many things I'm proud of that equality has given us, and many things that have progress well. But the area of divorce and child custody is still stuck in inequality la-la land.

Very cool. This is how I am trying to raise my daughter but I have had to fight and stay very aware of others perceptions. I get so mad knowing that my child can be taken from me over a lie at anytime.
