Iran Set to Execute 18-Year-Old on False Charge of Sodomy

An 18-year-old Iranian is facing imminent execution on charges of homosexuality, even though he has no legal representation. Ebrahim Hamidi, who is not gay, was sentenced to death for lavat, or sodomy, on the basis of "judge's knowledge", a legal loophole that allows for subjective judicial rulings where there is no conclusive evidence.

Hamidi had been represented by human rights lawyer Mohammad Mostafaei, who has since been forced to flee Iran after bringing to international attention the case of another of his clients, Sakineh Mohammadi Ashtiani, a 43-year-old Iranian mother of two who has been sentenced to death by stoning for adultery. Mostafaei was due to arrive in Norway yesterday to begin a life in exile while continuing his campaigns on behalf of his clients, including Hamidi.

At the same time, human rights activist Peter Tatchell has written to the foreign secretary, William Hague, urging him to contact the chief justice of Iran and ask that the execution be halted.

"Ebrahim's case is evidence that innocent heterosexual people can be sentenced to death on false charges of homosexuality [in Iran]," said Tatchell, co-founder of the London-based gay rights group OutRage.

Hamidi was arrested two years ago in the suburbs of the western city of Tabriz in the East Azerbaijan province after a fight with members of another family. Three of his friends were also involved in the incident and were subsequently arrested. Later, the four were accused of homosexual assault on a man and of attempting to abuse him sexually.

A person convicted of homosexuality in Iran can be lashed, hanged or stoned to death. The law includes a variety of penalties for different acts: 99 lashes if two unrelated males sleep "unnecessarily" under the same blanket – even without any sexual contact. A boy raped by an adult man would also be lashed if the court decided that he had "enjoyed" the experience.

After three days in detention, Hamidi confessed to the crime, allegedly under torture. The other three were cleared of all charges when promised by officials that they would be freed if they testified against Hamidi.

    • I'm on board with how this is ludicrous, but I also find it ludicrous that the act of sodomy is being used like it's a stand-in for homosexuality. He is sentenced to death for attempting rape, not for being gay. But then the article continually comments as if his sexuality is what is in question here!

      I doubt his charge clearly (or remotely) translates to "homosexual assault" since the concept of homosexuality is relatively new in the Middle East, and definitely not legitimized among the fundamentalists who run the country. And while citing extreme barbaric laws is all well and good, unless a case comes up in which someone is actually charged under these laws, it seems like an unnecessary thing to include. As if it isn't already known that the fundamentalist government that the CIA helped put in place in Iran is horrific.

      If Hamidi is falsely accused of attempted rape, then this is clearly horrible. But trying to make this a gay rights issue is ridiculous propaganda.

      because of all of the western outcry, cases of homosexuality are changed to rape for appearances. most likely there was no rape but if he was killed because of homosexuality iran would be risking u.s. and british intervention. these cases are sadly very common.

      homosexuality has been around since there have been humans. even in the middle east.

      you can't assume Iran cares at all about Western outcry. if they did, they wouldn't be bothering with uranium. and their president wouldn't say all the stupid shit he does.

      homosexuality, at least in how it has evolved in implicit meaning, is a very new concept. it's the combination of personal being/identity and sexual desires, denoting everything from physical built to non-sexual interests. sexual attraction most likely exists along a bell curve of purely same-sex to opposite-sex attraction, but the idea of 'gayness' and homosexuality, BEING attracted to people of the same sex, is mostly a Western idea.

      Iranian views of homosexuality are loosely comparable to some Christian views of homosexuality, as they are against the 'lifestyle' (monogamy or promiscuity among men only, no reproduction), and the most 'liberal' among them argue that men should simply ignore their inclinations, get married to a woman and have kids. Except, of course, this view is much more legitimized in Iran, to the point that opposition to it cannot exist, and therefore it's more extreme.

      Why is this even allowed?? I'm sorry, but if any country out there had an embassy for Iran on their soil, I would hope they would close them down and send them to HELL!!

      This is not humane and if Iran thinks we are still living in the 40's, they need to be bar from all trades and help!

    • 99 Lashes is also a death sentence for the other guy, if he's raping young boy's then he is liking what he is doing.

      While rapists should be killed being killed for being homosexual is just despicable
