There seems to be a lack of evidence to prove any kind of rape took place, and without that evidence, the US court system would not be able to use a "rape by deception" charge, nor would it need to in order "to get a palastinian muslim man a lesser charge than straight up rape" if the evidence, or lack thereof, did not uphold the straight up charge of rape.

Granted again, we have self-appointed our own right to judge the justice system of another nation based on how we define justice in our own nation, and God knows we don't always do a very good job of upholding the justice we are so quick to use to judge other systems, but in the end, the question remains, did a rape in fact occur?

but if a 3 day-old rape kit is what has "proven" this woman's allegations, then it isn't much of a case. If there is more to it than even that, well, we may not have access to that information, but from everything I've read, this is a straight up "he said, she said," which is why women should not leave bars with men they don't know, and men should not have sex with women they don't know.

no, not every case, not by a long shot. There are some that are clear convictions, usually appalling details, underage victims, but let's not go there. I get what you are saying, and I'm just saying the whole thing remains suspect, on both sides, and probably MOST rape cases end with the question, did a rape occur, and I think the other often unasked question is, do both parties involved agree and understand that a rape took place? By taking the plea, yes, he more or less sealed his fate, but you cannot assume he took the plea because he was guilty. Like I said elsewhere, our prisons are full of people who took pleas on their inept lawyer's advice, and were innocent of the crimes they were convicted of...DNA is rapidly changing that endgame, but this is definitely not a clear case.
