Seventeen years after DADT passed into law, the vote all but ensures that its repeal will become a reality before the end of the year. The vote passed by 63-33, with moderate GOPers like Scott Brown, Lisa Murkowski, Susan Collins, and Olympia Snowe voting Yes.
First of all, major props are due to Joe Lieberman, Harry Reid, President Obama, gay rights groups, and pro-repeal bloggers and commentators, all of whom played different but interlocking roles to make this happen.

I don't know why this was ever a Capital Hill process. This is a personnel decision that should have been taken care of at a lower level. That said, now that Clintons policy is history perhaps we can put this thing to bed.
My criteria for sharing a fighting position with someone is not who he/she sleeps with but will he kill the bad guys when the need arises. CAn I count on him to do what we have to to to get home alive and in one piece. I have no problem whatsoever with gays in the military. There may be a few problems at the lower enlisted levels but they will sort themselves out and go away with time. The only negatives I could see coming out of this would be a gay service member alleging discrimination if he was not promoted, get a good evaluation etc. That type of thing, using the status as a basis for discrimination complaints, will be bad for morale. Now, will we see an uptick in gay enlistments? If not, what is the purpose of all this noise? It isn't worth the effort just to admit, in formation, you are gay. PDA's are still not going to be ok in uniform. - 1 year ago

Hmm...the Title of the Bill "Repeal of the DADT" seems inaccurate. This is not a repeal of the DADT policy. It is a Repeal of 10 U.S.C. 654 which prohibits Gay persons from enlisting in the Military. I wonder if they will now amend Article 125 of the UCMJ. I hope so, as this will certainly be an Article that could be abused to circumvent this measure. It seems to me though, that the Ranking Members of the US Armed Forces are more than willing to comply with the wishes and the intent of the US Congress. So that is good.

At least that does show that some of his base has proof that he did what he set out to do and it's very hard to figure that this had anything to do with catering to corporations.
There have been homosexuals in every military since before the Greeks founded Athens, so it should be no surprise that there have always been gays in the US armed forces. Trying to hide them is just like sweeping dust under the rug, it never works for long.
Although I'm sure many will try to spin the hell out of it, how does that distract from other legislation? If they wanted to pick something to do that then why has the first responders bill been ignored? That certainly has a lot more potentential to distract than DADT.

but benefits does bring up a good point. with this repeal me and my fiance WOULD NOT get any type of veterans spousal benefits. no health care or base housing or child-parent recognition. there's a little thing called DOMA (you know, the thing that "marriage is one man one woman" obama didn't bring up since he's stepped in the white house). under doma we cannot legally be recognized. if she were to die in iraq right now i would get no compensation. actually; because obama had to wait for "procedural reasons"; i'd be the last person to know because she's too scared to put my name down under the "in case of emergency" contact sheet.

actually no. i was not referring to insurance benefits. either way with doma still in effect, military insurance will not even think about any type of benefits for lgbt couples.
the fight for the repeal has been going on since 1993 led by the service members legal defense network http://www.sldn.org and followed by the log cabin republicans. they are the ones who should be thanked for this repeal. also during these two years obama has done little to support dadt past saying it. yeah i support world peace but if it happened tomorrow i'm not going to run around telling people i made it happen. all i'm saying is give credit to those who lost their jobs, careers, and families for this repeal. give credit to those who raised money over the years and lobbied both sides; not just those who gave lip service for a cumulative 2 weeks

Article 125 - Sodomy
All that Article 125 does is lump homosexuals & beastaility in the same catagory.Forcible sodomy, nonconsensual sodomy and sodomy with underage men and women is already covered by UCMJ Article 120. When DADT is repealed, undoing Article 125 is another necessary step for the military to take to allow gay, lesbian and bisexual service men and women to serve honestly and honorably.
And for those who don't know it, 80% of the U.S. population engage in oral or anal sex, not just homosexuals. If that same percentage applies to the military (and there is no reason to believe it does not), then the vast majority of the military and retired military personnel (all of whom are subject to the UCMJ) violate Article 125.

I know Article 125 is, I am a Veteran. The time I served, I never knew anyone who was prosecuted under that article, and it is not limited to homosexual acts. Article 125 states that any sexual act other than vaginal is illegal and immoral and punishable by incarceration. Legally speaking heterosexuals who admit to having oral or anal sex, even with a female are guilty of violating Article 125, though no one I ever knew was ever prosecuted even though they bragged about such things incessantly.
What I was getting at is, how long before some bigoted Officer decides to prosecute someone under this Article. Now an Officer can ask if a soldier is homosexual and the soldier is required to answer, also, he now has to answer if asked if has engaged in any sexual activity with a partner of the same sex. This creates a dilemma that has not yet been addressed and could be abused.

Yes, they could. Don't get me wrong, I am in favor of allowing open enlistment in the military. I am a veteran and served with a gay man in the Navy. (I know the jokes will come roaring in now..lol..) None of us had any problems with him at all.
What I AM saying is that I am not too sure people have done the research on this issue. What the DADT policy did was prevent an investigation into whether or not a person was a homosexual without any evidence, whereas before the DADT policy they could. The DADT policy is not what prevented Homosexuals from serving, it was STILL illegal to be homosexual even under DADT. What DADT was was a sort of if you don't say anything, we won't either deal. Thus the name, Don't Ask Don't Tell. However, if one DID say something, an investigation COULD be launched and if a person were found to be homosexual, they were given an OTH Discharge.
So now, we have repealed DADT, however, under the UCMJ it is still illegal to engage in Homosexual activity. So now a gay soldier can be investigated whether they said anything or not. Now, I think this may just be a much ado about nothing, as the top military brass seem to be behind an integration. HOWEVER, there could be an overzealously bigoted officer that could prosecute or at least harass an openly gay soldier.
Read Article 125 of the UCMJ, you will see what I am talking about.
I am only trying to bring up the fact that DADT was actually a policy put into place to circumvent a law that persecuted homosexuals in the Military, and that law has not been removed. Now that DADT has been repealed some people are at risk of at the LEAST an attempted prosecution and harrassment under an existing Article in the UCMJ.
I want people to remember that when you join the Military, you no longer have constitutional rights. You swear them away and are then subject to Rights and Obligations under the UCMJ. Yes, the UCMJ grants rights and protections as well as laws on conduct and behavior. A soldier's new "Constitution" is the UCMJ.

I remember that too. They actually had us watch a film and it talked about how you could not be homosexual. I did serve with a coupe of gay guys, we knew it, but no one cared. Of course that is only my personal experience at one command. They could have very well suffered if they stayed in and were moved to a different command. We had a really awesome Captain though, and that may have made all the difference for my individual experience.

I still have the fear that SOME overzealous officers may attempt an end run and prosecute a homosexual soldier under Article 125 of the UCMJ..but I am not sure how many officers in Command Staff positions will be willing to even touch an NJP like that.
