when i was in higschool, i worked as a summer counselor at a school for the retarded. i was showing a class how to fill out job applications and in one application one of the girls misunderstood a question. there was a tiny box next to the word "sex" that you would put m or f, well she wrote in very very small letters "scott thomas".

There is a double standard when it comes to sex and gender. With a retarded guy it is like "go buddy! That's great the poor guy is getting some." but if it was a retarded woman, most people I believe would be like, "That is horrible! Poor girl is getting taken advantage of." Even if the non-retarded person is benefiting from the sexual exchange and the retarded person does not technically understand consent, doesn't make it inappropriate in my mind. Unless, the retarded is averse to sex or it is somehow painful to them, why should they not enjoy that pleasure. Retards sometimes can't consent to what food they eat, where they live or myriad other things that they are not deprived of. Why should they be deprived of sexual pleasure?

Just because someone has the intelligence of a child should we treat them as a child forever? is the question. I don't think we should, they're trying to protect him from health risks they say he doesn't understand and is incapable of understanding but it's not the state's business to protect people from themselves. Again, because it's everyones own right as human beings to decide who they have sex with or what 'level of risk' to take while picking a sex partner. Plenty of people that have herpes S2 with high IQs have sex everyday. So why is it any different from depriving a person with a high IQ or a low IQ from having risky sex?

We all die eventually, a 100% mortality rate, how much fun or sexual risk we decide to take before that day comes is up to the discretion of each individual. If we get a disease, even a lifelong one, it will only be lifelong.

It might help if people actually read Mostyn J’s judgment (as opposed to an article in the Daily Mail which was itself a rip off of a badly written article in the Daily Telegraph) in this case before writing about it. When you read the judgment, you’ll discover that the man has not been banned from having sex. The local authority that cares for him has been instructed to put in place measures to prevent him from having sex. This is for his protection and for that of, for example, the 9 and 10 year old girls he touched up. The orders the court made are temporary and will be reviewed in 9 months once sex education work has been done with him.
