Officer convicted for repeatedly beating motorist with a metal baton in his driveway

James Mandarino, described in court as an exemplary officer during his 15 years with the Streamwood police force, was convicted Wednesday by a judge who said he watched the video footage 50 or 60 times before ruling.
“Any rational analysis (of the video) will show that the conduct of the defendant was wrong, just plain wrong, unprovoked, unnecessary and unacceptable,” said Cook County Circuit Judge Thomas Fecarotta Jr., who found Mandarino guilty of aggravated battery and official misconduct.
The video showed Mandarino hitting motorist Ronald Bell with a metal baton 15 times after tailing Bell to his Streamwood home on March 28, 2010.
Bell’s brother Stacey said he believes every squad car should be equipped with a camera. If the beating hadn’t been caught on tape, “things would have turned out very differently,” he said after the verdict was announced.
Mandarino could face probation or up to five years in prison when he is sentenced April 25. He will be allowed to stay out of jail on bond until then, over the objections of prosecutors.
Defense attorney Richard Beuke had argued that Mandarino followed proper police protocol during the stop because Bell and his passenger, Nolan Stalbaum, appeared intoxicated and acted aggressively. Both men have maintained they were neither drunk nor combative.
The judge said he did believe that Bell and Stalbaum were intoxicated and not entirely truthful about their actions that night. “But if a picture speaks a thousand words, the video speaks a million,” Fecarotta said.
Defense attorney Ed Wanderling said he was disappointed in the verdict.
“We believe the evidence created reasonable doubt to find Corporal Mandarino not guilty,” Wanderling said. “We're glad the judge believed Mr. Bell and Mr. Stalbaum were liars, and this knowledge should have been an indicator of what occurred throughout the incident.”
Wanderling accused the news media of improper reporting in the case and of acting as publicists for the state's attorney's office. Beuke, the lead defense attorney, did not comment.
Assistant State’s Attorney Mike Gerber said the verdict “sends a message that these types of offenses against unarmed civilians are a breach of the public trust and will not be tolerated.”
Mandarino testified during the five-day trial that during the traffic stop, he feared for his own safety because Bell and Stalbaum did not remain in their vehicle until backup arrived.
Stalbaum acknowledged in testimony that he did not obey Mandarino’s orders to get back into the vehicle. He said Mandarino used a stun gun on him.
Prosecutors asserted that Mandarino “lost his discretion and snapped” and had no cause to use the baton against Bell.
In ruling, Fecarotta said Mandarino used the metal baton as a deadly weapon.
“There's no doubt that the baton was used as a club with full force, striking Mr. Bell in the head, the back, the forearms,” Fecarotta said. “If you look at the video, Mr. Bell is on all fours. That's when the beating started.”
Bell suffered a head injury, and his brother said Wednesday that Bell has had headaches ever since.
Bell was charged with traffic offenses in the incident and Stalbaum was charged with resisting arrest, but those charges were dropped.
The two men have filed a civil lawsuit against Mandarino and the village of Streamwood.
A number of off-duty officers attended the trial in apparent support of Mandarino. Some officers also participated in a fundraiser for Mandarino in June, though both the Police Department and the police union said they did not host the event.
Streamwood police Chief Al Popp issued a news release following the verdict.
“While this incident was very unfortunate for all parties involved, the actions of the administration of the village of Streamwood were initiated to underscore the importance of public trust and individual accountability in daily operations,” the release said.

Abuse of power is nothing new to the police. Trained to THINK they are the law creates a power trip in many individuals. I understand an adrenaline rush but they should be trained to stop it dead in it's tracks. Such abuse also seems to some a right conferred by a badge. They are not screened to be stable indivuals and many are unsuited for the position they have. Jail is the proper place for such people. GO DIRECTLY TO JAIL,DO NOT PASS GO, DO NOT COLLECT $200. I like how he was described as being an exemplary officer. Who is doing the evaluation? One of his wolf pack who goes along and doesn't dare ruffle the feathers of this officer? Police departments all over the country are corrupt and this is a prime example of "I wear a badge and a gun so I can do what I want" attitude. This guy is just a professionally paid bully. Well, they just love some pork in prison. To clarify, I know there are some good and decent officers, this jerk and those like him are not even in the same league.

The sad thing is, this guy will probably never see jail time, police and prosecutors tend to look out for each other more often than not, that kind of thing goes on all the time here in Austin, it's become no big deal, as a matter of fact, last year, a cop shot (nine times) and killed an unarmed kid, he was put on administrative leave for a year, and is now back out on the street, how's that for justice.

A lot of people mistakenly believe that I'm a-the glass is half empty all the time person-I'm not, I'm a realist, and I firmly believe that it doesn't matter what President we have an office, the same draconian "leadership" is going to continue until the game is fundamentally changed.
A choice between an extreme right storm trooper reactionary government, and a more moderate so-called left-wing or Democrat controlled regime doesn't matter that much, because as I'm sure you and many other people have noticed, where the so-called left is now, has moved so far to the right in the past 30 years, that if someone from 30 years ago came out of a time travel chamber, most politicians that we call Democrats or lefties, (with a few possible exceptions being Bernie Sanders, Alan Grayson, Dennis Kucinich and Peter DeFazio) would be considered moderate conservatives to them, and they would be correct.
That is why I don't believe (amongst other reasons) that the elected president really matters very much as far as truly relevant bread and butter issues are concerned, the well-established plutocratic system demands now more than ever, that our "representatives" do everything in their power to protect and support the interest of their corporate owners (their reelection campaign bankroller's) first and foremost, the interest of the American public always comes last, and anything that is done in the public interest, is usually relatively small, and a token offering, crumbs from the table designed for appeasement and not the kind of sweeping radical reform that is so desperately needed in our society, can you see where I'm coming from?

You ask what system? A system for the people created by one man/woman, our President. As politicians continue to bend over for corporations and try to fuck us without lube, the changes you hope and seek are not going to happen until one man/woman steps up and decides that real changes are needed because this country was based on principals, not corruption.
I see 95% of our politicians corrupted and only caring for the rich and corporations, but there will be one day, when one of them will change and bring the justice and freedom back to this country.
The system i'm looking forward too is where we are all treated like equals, which doesn't happen today.

if I understand what you're saying correctly, you are believing that there was a much better time with greater freedom and liberty in America, that that was the intention of our founding fathers, and that it's just been a fairly recent phenomenon that we've become so corrupt, sorry, but those beliefs simply did not hold up to historical fact.
The late scholar, (who passed on two years ago) who was also a bombardier in World War II, wrote one of the best books ever written about the history of America, its title-not surprisingly- is: a People's history of the United States 1492 to present-by Howard Zinn, this guy, who was always very plainspoken and didn't come across as some kind of intellectual asshole speaking from an ivory tower, was brilliant, and everything in this book, is 100% verifiable and true, if you read this book, you will end up knowing more than 80 or 90% of the American population about what the hell is really going on, I consider it one of the greatest books ever written, and in my world, it would be mandatory reading for all high school seniors, and undergraduate college students.
The founding fathers, as this book makes abundantly and overwhelmingly clear, where plutocrats who believed and supported class stratification, and wanted nothing to do with democracy, again made abundantly clear not just through the historical record of the laws and their actions as individuals, but from the very own words of the founding fathers themselves.if you have any other questions, feel free to send me a message, take care.

This video was so distressing ! I am glad the guy had a friend there , because without that intervention , there was no sign the cop would stop wailing on him . I don't know why he snapped , I suspect he will be very sorry about it , in prison . Where he will have time to think about power and abuse of it . Some judges are alright .

Expecting a sentace of probation to 5 years in jail. What a crock. Here in Missouri, a 3rd time dui has a mandatory sentance of 10 years and you can't be eligiable for parole until 85% of the time is served. Pretty clear where this countries priorities are. Violence OK, drinking evil.

I used to hang out in this village as a teenager, very rural back then. We would park at some old graveyard and dare each other to walk through the tombstones. Never saw a cop back then, but this is a fucking pig, not a cop. I am so sick of this bullshit, either train these douche-bags, or get them off the streets. To give you some idea of how much things have changed, I grew up in the heart of a big city, me and some other10 to 12-year-old boys used to play a game called guns, that's right guns, we picked two teams, four or five boys and each team, one team was the hunter the other was the hunted, it was a variation on hide and seek, anyway, we each had these cool very realistic looking 38 caliber cap Guns, one team went off to hide, you were given a five or 10 minute head start (if you were the hiding team, your strategy was to set up a place for ambush) and then the hunting team started trying to find you, if he were found you could still run away, but of course they would be shooting at you, I have no idea how we work out the rules for what constituted a hit or a kill, but the point is, in the heart of the city, UA groups of boys running their ass off with something that looked like 38 caliber pistols going bang bang bang, and we did this for hours! I can imagine if kids tried to do something like that today, cops would probably come from all directions with guns drawn in a paramilitary stance screaming at the top of their Lungs for us to drop the weapon and get down to ground! probably shooting some of of the kids in the process, Jesus Christ this country has become crazy!
