"Bachman wants to prohibit judges from enforcing Equal Protections!!!"

Rep. Michele Bachmann (R-MN) wants to completely strip judges of the ability to rule on the legality of same sex marriage.

“Something else that we can do to reinforce our pro-marriage, pro-life, pro-family agenda is to limit the subject-matter jurisdiction of the courts,” Bachmann said during a Monday speech in Pella, Iowa.

“At the federal level with what are called Article III courts, Article III of the United States Constitution, we can limit the subject matter that justices can rule on. We have it within our authority to decide what judges can rule on and what they can’t.”

James Madison, the "Father of the U.S. Constitution", along with many founders of this country, regardless of their religious or non-religious affiliations, knew keeping politics and religion separate not only preserves each, but helps them flourish: "The number, the industry, and the morality of the Priesthood and the devotion of the people have been manifestly increased by the total separation of the Church and the State."

    • Put down the foster care checks woman, stop reading "Curious George-A Christians Translation" to the current crop of indictrinated ninnies you are trying to raise "the right way".

      We have judiciaries to hear cases and come to decisions, for all of our benefit. If our courts are not allowed to make rulings on legislation in this country then we are lost, plain and simply lost! I do not have enough room here character-wise in this post to list all of the landmark decisions regarding legislations that have come out of our supreme courts.

      Our judicial system is needed as an important piece of our system of checks and balances, and pulling even one wheel off that machine means it will lean in one direction quickly and run our entire nation straight into the walls on either the right or left of the path we should be taking. I may not agree with some of the people who are sitting on these court benches but by god damn I sure see the reasons we have that bench for them to sit on.

      You pull one such moment of non-sensery over one of your "pet issues" and we are well on our way to becoming a single party fascist state. Judges are there to keep us all working within the framework of our own laws, you don't like something, you go after the laws, not the Bench! What next on the list of the "non-jurisdictual" rubbish heap? Anything to do with pregnancy/abortion I am sure, then gay rights, then womens rights? You have no idea the slippery slope you have ventured onto here young woman, and you're trying to play dirty pool in a world full of sharks used to swimming in murky waters.

      The only remaining question on this issue is, who the hell does she think is going to get to make these rulings if our courts don't? Any court matter involving family, marriage, and "LIFE" can't be heard by our courts...well that should save a ton of money considering thats got to amount to 60%+ of all court trials in the country have something to do with family and/or marriage, and since "life" is all encompassing...so now you want to make our courts just as impotent as every other well intended government agency since the beginning of our nation because you can't bring yourself to seeing the truth they have shared?

    • Here's a person with a law degree, and should at least sound intelligent, but just doesn't seem to understand that she live in the United States, not some third world dictatorship. You can't just arbitrarily decide which laws are worthy of the court's protection and which are not. And as soon as something like this is used against interests she favors, she'll scream bloody murder! Communists! Those people are out to destroy America!
      What a joke, I really hope she runs for president.

    • Umm ya so I just read article three of the constitution and I really dont see what gives congress the right to limit the cases that the supreme court can hear. Not one word about it. Am I missing something? Here you tell me,

      Article III.

      Section. 1.

      The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services a Compensation, which shall not be diminished during their Continuance in Office.

      Section. 2.

      The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;--to all Cases affecting Ambassadors, other public Ministers and Consuls;--to all Cases of admiralty and maritime Jurisdiction;--to Controversies to which the United States shall be a Party;--to Controversies between two or more States;-- between a State and Citizens of another State,--between Citizens of different States,--between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

      In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

      The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

      Section. 3.

      Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

      The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

      However, to even think to revise this to prohibit judges from enforcing equal protection goes against the very spirit of the Constitution and the natural rights of man (and woman). I think she would be better served if she stopped sticking her big biased nose into everyone else's lives and stopped abusing her office for her own personal agenda. People like her have no place in any government offfice in this country.

      Limiting the jurisdiction of the supreme court seems like exactly something that the founders of this nation would not have wanted to happen. Also if they are already going for this it means they have to be getting desperate, and know that if marriage equality makes it to the supreme court we will win.

    • I believe Congress's power to decide jurisdiction only rests with federal courts under the Constitution. Congress does have formidable influence over juridiciton regarding federal courts, and without jurisdiction federal courts cannot decide cases. On the state level I don't think Congress has any power regarding jurisdiction, but I would still hope there would need to be much proof provided to back up that certain equal protection cases at the federal level do not fall under cases relaying to the Constitution.To think she could change this simply based on her own biases is ludicrous and myopic. The Constitution IS about equal protection. I think she is grasping at straws really, though Congress does have the power on the federal level to undertake this. However, to do so would surely reveal their true colors. But then, as we already know some don't care about that in doing anything to assuage their own personal intolerances and hatred.

      I personally think the interpretation of Section two would limit her goals in the first 22 words:

      Section 2:
