Earlier this week, the Supreme Court denied review of the case of the Texas cheerleader who was suspended from her team for refusing to cheer for her rapist without comment. This means that a lower court ruling, which said that a cheerleader acts as a mouthpiece for the school and can thus be dismissed for refusing to speak, will stand. As an educator that has worked in public schools I see this just as another example of a school district that is not even remotely interested in teaching students anything, let alone the right thing. Why is this student allowed to be on any school-sanctioned team; as in you forfeit the right to participate due to your violent anti-social behavior? Unfortunately I have personally heard of stories where something has occurred between a male and female student and the administration lacks the intestinal fortitude to confront it properly.
And what does this say about the community as a whole? And where is the leadership? If I were an administrator of this school district, I would not be afraid to step on the toes of the entire community and not allow the student to play. Unfortunately it is easier to have him play than to have your house egged, have threatening phone calls wake you, or be taunted at public meetings. All things I saw my own parents go through when they questioned the management of the school district I grew up in (ie superintendent stealing money - for which he was later convicted - at another school district!). It is time to make people accountable for the actions.

The parents fucked up, the dad should have gone Seal Team Six on the rapist. The only line between justice and punishment when it comes to rape is this, when the court fails, fathers, brothers family members need to dispense swift justice. If that was my daughter, that little fucker would be buried in the desert and I would probably be in prison. I personally could not live with myself knowing I was so weak that I did not exact revenge on someone like that. Killing the bastard and going to prison does not sound that bad. Fathers of daughters hear this all the time when thier little girls become teens " you are going to need a shotgun when she starts dating" There is truth in that old statement. My 12 year old daughter has her black belt in karate my 9 year old is ready for her red belt, I am hoping they can take care of themselves and I am preparing them to fight if they need to. My 12 year old is attending rape prevention self defense with my wife. Fathers need to impower thier daughters but if some one hurts my baby I will hunt them down.

This seems just dumb. I don't see why this girl has to be taken to task because of legal nuance. He certainly assaulted her and whatever harm he did to her justifies her reluctance to acknowledge him in any way.

I sat here for a couple of minutes and tried to put all my thoughts into words, but I can't. This is just fucking ridiculous, and the guy who raped her is just fine, still playing basketball. So the convicted rapist can continue to play, while the rape victim get suspended for refusing to cheer his name. Do you smell that? It's America's democracy right there.

As to your question, it was a Federal Court, and the USSC refused to hear an appeal, which effectively upholds the lower Appellate Court's decision. It is a defacto ruling in essence the Supreme Court is saying it agrees with the lower court.

A Texas Court originally heard the case and decided in the School District's favor. The case was then appealed to New Orleans appeals court were they also agreed with the lower court. The U.S. Supreme Court denied the Petition for Writ of Certiorari. In laymens terms they refused to hear the case.

I read about this case awhile back on Alternet and I see it didn't end well. This is horrible! She rightfully refuses to cheer for her rapist but it's her that gets punished and has to pay the court costs? Frivolous case my ass! I shouldn't be surprised though that a Texas school would put the sports star ahead of anyone they would victimize. Texas puts all sports and sports people on a pedestal. Just look at the histories of anybody who plays/or played for the Dallas Cowboys.

I read a story of an 11 year old who was raped by several men and some of the people of the town are more worried about the men involved than the 11 year old. They stated that she "...dressed inapropriatly and got what she ask for." Now this incident with the cheerleader. What in the hell is going on with the minds of some of your fellow Texans?

I can only wonder what type of parents she has not to realize that something was wrong with there 11 year old after being gang raped by 15+ high-school students and adults..

Sorry, I feel like I was just being nit picky and I didn't mean to be. It is a fine line so I am sure the sentiment is the same. It is difficult to distinguish how evil money is from the love of money because (at least in my experience) everyone loves money to at least some extent. So the stigma naturally becomes attached to money. I think the sentiment of the original saying though was more to greed for an object rather than the object itself. Meaning, the object has no inherent value other than what we put on it and we should look to change ourselves and our obsessions and learn to not be so covetous.
Just my thoughts. Again, I am sorry for being a nit picker...:-)

Right. It was the U.S. Supreme Court that apparently allowed what most would call a miscarriage of justice. Texas courts would probably allow and urge concerned fathers to see to the training of their daughters in the use and carry of, say, a PPK.
