Kucinich, other House members file lawsuit against Obama on Libya military mission

Ten House members led by Rep. Dennis Kucinich (D-Ohio) are filing a complaint in federal court against President Obama for taking military action in Libya without first seeking congressional approval.

Kucinich and Reps. Walter Jones (R-N.C.), Howard Coble (R-N.C.), John Duncan (R-Tenn.), Roscoe Bartlett (R-Md.), John Conyers (D-Mich.) Ron Paul (R-Texas), Michael Capuano (D-Mass.), Tim Johnson (R-Ill.) and Dan Burton (R-Ind.) filed the complaint Wednesday at the U.S. District Court for the District of Columbia.

“With regard to the war in Libya, we believe that the law was violated,” Kucinich said in a statement. “We have asked the courts to move to protect the American people from the results of these illegal policies.”

The House members argue that the Obama administration overstepped its constitutional authority by authorizing the use of U.S. military force abroad without first receiving approval from Congress. U.S. forces have been involved in the campaign against Libyan leader Moammar Gaddafi for 88 days.

    • I'm on Dennis Kucinich's e-mailing list. I saw a different video than this one but the same premise. I agree with Dennis. I have always said it's time to end these damn wars. They are not about our freedom or safety. They make us LESS free and LESS safe. They are money makers for the MIC, Cheney, Halliburton etc. If we would stop these wars...our economy would improve, this country could start healing and we could finally take care of our own people.

    • As much as I don't like our presence in Libya, Dennis is wrong on this one. This is not something we decided to do on our own. This is a NATO mission and as such, it is a treaty obligation and circumvents the war powers act.

      I don't support war. Libya is a terrible idea. We're supporting rebels whose intent is unknown to us. The outcome is far from certain and has the potential of involving us in a larger conflict. We should not be there, but as I said before, our presence is a matter of living up to our treaty obligations. If we start picking and choosing which treaties we will support, then the idea of treaties becomes meaningless.

      I disagree. The War Powers Resolution states, specifically that a president must consult with Congress before sending troops into war and provide periodic reports on their status. In addition he can only do so in the event of:
      a declaration of war,
      specific statutory authorization, or
      a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.
      After 60 days the use of troop must be terminated with three exceptions and treaties do not seem to be one of the three.

      but it seems to me that Obama is in clear violation of this act. Congress should shut off all funding for this and at least censure Obama in whatever the strongest form Congress can employ. This guy in the White House bears watching. He needs to understand that he cannot continue to do whatever he wants. Making a mockery of the rule of law is not very presidential.

      Presidents have been sending troops into conflict w/o approval since the earliest days of the republic. There have only been 5 declared wars in our history. Every non NATO/UN conflict had congressional approval. All the other conflicts were based on UN authorizations and funded by Congress. Since the war powers act, these are the non-authorized conflicts we've been involved with:
      Lebanon 1978
      Gulf War 1990
      Bosnia 1992
      Liberia 2003
      Haiti 2004
      Libya 2011

      All of these were authorized by the UN and extended beyond the 60 day limit w/o approval.
      Although the text does not mention it, treaty obligations are the law of the land and as such, we are bound to them, end of story.

      It is not the end of the story. What is custom is not law. Failure to comply with the War Powers Act does not change from illegal to legal because it requirements are ignored. NATO, or any other treaty, does not trump U.S. law. Many who seek the destruction of our sovereignty and integration into a one world order think otherwise and work to push that on us but it is wrong. Obama is wrong on this and his arrogance is insulting.

    • Dennis Kucinich wants to take the president of the united states to court and you house democrats think weiner is your problem.there is some thing going on with this guy this is not the first time he has jumped into the news spot light.I would suggest taking the little fellow in my office and having a serious talk with him

    • SMH, as if we went in there alone, I thought we went in as part of NATO; we are part of NATO right? Why waste the courts time with BS, how about the Dem’s focus on these law changing Governors’ trying to kill unions and pass BS voter ID laws, destroying women’s rights and the crippling Economy. Come on guys stop with the dog and pony show get to the issues.

      The wars are crippling the economy. You cannot separate the issues of the wars and foreign policy from the economy. These issues are paramount, and in my opinion which of course many will disagree, issue of unions, voter ID laws are secondary compared to war and the economy.

You know the wars that had nothing to do with our safety? You know those wars where the leaders weren't butchering their own people? You know those wars where the U.N. didn't approve of action against?

      Congress approved of both of those wars, and at the time, justification for war was argued by many in Congress to be valid because Iraq had violated UN resolutions

      Also, Kuccinch was the main one leading the charge to hold Dick Cheney responsible for starting the Iraq war based on complete fabrications:
