    • If she gets a good lawyer she can sue them for false arrest/malicious prosecution - what law did she break? She was not obstructing them in their work. She was on her own property. If the cop was that afraid of her camera, he shouldn't be a cop.

Most cops have dashboard video cams. (She could have said she was trying to be sure the cops weren't going to be accused of brutality)

Cops once gave my sister a ticket (thankfully, no arrest) for "eating cookies while riding a power mower" - dismissed, of course, but it cost her time & $$.

    • It's time we make a Digital Rights Act, that includes the following:
      1. The right to capture video or still photos of any action occurring in public view.
      2. The right to a search warrant before any search of my electronic data or devices, no matter where it is stored.
      3. The right to stream, download, or swap any file with completely content neutral treatment from my Internet Service Provider, or any intermediate hub, node, or network.
      4. The right to privacy in all net searches and web browsing, except the data that I willingly and knowingly choose to share.

anything else we need to add?

    • The cops don't want anyone videotaping them if they pull another Rodney King, or another multicop execution like the other day at a traffic stop - most of us saw the video.

Average cops would have been comfortable as stormtroopers and brownshirts in other times. They're not much more than zombie robots for the elite. Not normally capable of independent thought. They're not the enemy, they're tools.

    • What is wrong with the police? They are seriously being brainwashed into thinking they are not human as well. Knowing your own rights is also knowing the rights of others. Just like it's his right to feel safe, it's her right to be in her yard filming or doing whatever she pleases as long as she's not harming others.

If you don't like it do something about it.
If you don't like the police abusing their power yet you do nothing to challenge their abuses, then you are condoning these abuses.

Police Union President Mazzeo says he saw the video and that the woman, Ms. Goode was "clearly trying to engage the officers... creating danger, "it is a distraction..."

It certainly doesn't play that way on tape. She never said a word until spoken to!

    • This is so disturbing but not surprising given the facts of the way police consistently act. That was clear police intimidation. They were upset because she was recording their actions which could very likely have become fascist. Remember Oscar Grant and many other "unlawful" police actions.
They - or this particular cop- feels that whatever he says the public is supposed to do because he says so. People have individual rights dumb ass cop.

    • If the cops dont want everyone to film them, then we can no longer trust them. Their every action on the job is up for limitless scrutiny. If they dont want that then they shouldn't have become cops. It seems everyone forgets that every single solitary branch of government in this nation must be held accountable by the people, when we allow the government more power than the people then liberty is nothing more than a fond memory.

    • Videos substantiate testimony. Personally, I feel the police officer initiated the confrontation due to unreasonable expectations of compliance to authority. My opinion is that any digitized images of conduct that can be seen in public, should not be restricted. Anytime you are outside your private sanctuary, conduct yourself accordingly. Tho' standing near armed authorities with something in your hand, with adrenaline pumping, is risky.

I'm happy she did this, but people have to learn when dealing with law enforcement thugs not to turn anything into an argument ...it gives them ammunition to change the circumstance around. another words....keep it short ,sweet and simple.
I support her 100% ...but we need to learn how to say nothing more than necessary.

I think she did exactly that until he started physically coming after her.

If I was a jury member and watched this video, I would send him to prison, and I think most people would do that. I also think that they know this, and that is why they work so hard to keep their criminals...err, I mean officers out of court.

    • Just curious as to what happened later. Hopefully she was released and the arrogant power mad officers who arrested her were disciplined in an appropriate fashion.

I am, overall, a very dedicated supporter of our police forces, but this arrest was unnecessary and uncalled for. As far as I know we aren't under marshal law and if that lady didn't want to go in her house she didn't have to. She was not interrupting the course of their investigation nor interfering with an officer in the pursuit of his duty. When asked to step back, she did. If she wasn't released almost as soon as she arrived at the police station then I suggest she litigate against each officer individually and the department they work for as a whole.

    • First off, it was not the Rochester Police that did that, it was just one asshole.
Those assholes should be tested for steroid use.

This lady should file a civil rights lawsuit against those three pigs. The one is guilty of violating her rights the other 2 did not step in to defend her rights, so they are accomplices.

The fact that the one officer kept insisting that he "didnt feel safe" should be sufficient to fire him. This is the type of oinker that carries weapons to plant on suspects.

These three assholes are a disgrace to the Rochester Police Department and
no doubt will be sued in civil court.

well not necessarily. we've seen cases where video tapes are edited to only show a small segment of the interaction and it makes the cops look bad until the full truth is revealed later. SO I understand their concern and suspicion.

BUT, that doesn't matter, does it? Our entire form of government is based upon a simple notion: power corrupts, absolute power corrupts absolutely, so our constitution is there to curtail the power and authority of government officials.

Which is why you should be able tell a cop to fuck off without fear of arrest: freedom of speech prevails over their feeling of disrespect.

And citizens should ALWAYS be able to record and observe government officials in action. I wish EVERY presidential/congressional communication was made available via FOIA, every meeting with lobbyists should be recorded and available.

As much as I hate to admit it, Wikileaks probably did more good than harm.

So f- the cops, we WILL be recording them to make sure they are good boys and girls.

"You are not listening to our orders"

At what point, in a non-emergency situation, were cops given the right to order people around on their own property? Is this more of the misnomer Patriot Act in action?

Who the hell do these BIG BABIES think they are? They have the right to order people out of their own yards because they....THE POLICE.... don't feel safe?

Hey guess what you ass-bag cops, every time you guys show up to harass or arrest someone, CITIZENS don't feel safe, which is WHY we are filming you every chance we get. This fucking cop needs his ass kicked to the curb, and if Congress doesn't get off of their inflated, over-sexed, over-paid asses and do something about this kind of police brutality and harassment, then come election time, they are going to get their worthless asses kicked to the curb as well.

Okay....So the police officer says: "I don't feel very safe behind me, with you standing behind me during a ROUTINE traffic stop."

I have NOT got to be the only one who felt that these police officers had some nefarious plans for the person that was stopped during this ROUTINE traffic stop.

I think, rather than witness MY OWN arrest....I would have went in my house and then called for, and DEMANDED that a Police Supervisor to come to the scene. I can't provide my help if I am behind bars...and sometimes it's not necessary to "take one for the team"...(voluntarily be arrested to make a political point)

This just smells. It stinks. It reeks. Someone on the Citizens Police Board should be investigating all and any previous police stops by the officer who arrested this woman.

I whole heartily support the police. When I have a burglar, or disturbance that requires assistance; I call the police and not a politician. I'm not stupid enough not to realize that "routine" isn't always "routine". Many major criminals, and fleeing felons have been caught during "routine" traffic stops. Police are very necessary, and an integral part of public service, and safety.

That said: These guys were up to no good. I really hope this lady's community does not take this crap lying down.

      It stinks.

I agree with you...if this is what scares police officers, I would also like to see how they respond when there is real danger, and shit hits the fan.

There will be no trial or jury, because this video as published is non-admissible evidence.

The enforcement officer calmly requested that the she step back and instead of querying why this was a problem she came back with "its my right" [to do this] and then continued to be provocative. It's dark, he is not to know if she has a camera or something nearby that could be used as a weapon.

The car driver didn't look scared or afraid of the officers who had stopped him, so I question the reasoning as to why she felt the need to video the events.

I agree with others who have already stated that if she had just stepped back when requested there would not have been any arrest. But she was adamant that she had to film this scene regardless of consequence - why was that?

There is also no information on the video as the history as to why this woman felt it necessary to film the officers doing their job, or reason as for the traffic stop. Therefore I conclude given current information that this film is either for personal gain or an attempt to have a gripe at the local law [for other reasons unknown].

Anyway, don't officials have to agree to being filmed?

If this video - which has been posted as an "its not fair" hadn't resulted in her arrest, would we be having this dialogue?

My husband and I have been living here for awhile. (it was 6 years on May 1st) We are on a month to month. We can't move because we can't afford to. The heat is included here as well. It's a good deal for the most part. That's why we are not going to fight him. We don't have the financial means to do it. It's BS, I know. This was the first year since we lived here that we got our rent raised. I think we were the only ones who did and you can guess why. If WI succeeds in recalling Walker, I won't be surprised if he raises our rent again. This is how juvenile this guy is and most Reps are.

Exactly. People often confuse 'freedom of speech' from Bill of Rights with the ability to say what/do what they want within exchanges with other private citizens. If the lease, or an employment contract places limits and we violate those limits, we are in breach, not victims of violation of Freedom Of Speech as defined in Bill of Rights.

That latter issue is between the state and the citizen, not citizens signing contracts.

Even if you are renting month to month, was there any sort of rental agreement with rules? Landlords do have some rights to place limits on what goes on in their property holdings in most places.

While I hate control freak landlords, it isn't a freedom of speech issue unless the government is the entity silencing you. And we know there is too much of that going on.

My suggestion would be to get a large poster and put it on your car or get some washable product and write RECALL WALKER on the side of your car in protest. Then look for a new apartment if possible..

This looked like illegal search and seizure to me. 3 cops for a traffic stop? 2 looked like they were having a great time going thru the "VICTIMS" car. I doubt that the guy was even formally arrested. This is the same state that enacted drug crime legislation aimed
directly at blacks, yet the feds have let them get away with this for decades.

People, the PIGS and the ASHOLES in Washington do not have your best interests in mind. WAKE UP.

      Buy guns and bullets.

No. Nothing in the lease and nothing was said, attilatheblond. We had signs in our balcony window for 2010 mid-terms and nothing was said. The Peace sign banner we always had on our balcony. There were no issues until the "Recall Walker" sign came out. That tells you all you need to know.

We can't afford to move, kgMA. But I do like your ideas. We both already have Recall Walker stickers on our cars.....he can not take that away from us.

Ok, so he is a jerk. Sadly, he is also the owner.

Hearing/seeing more and more of RW jackasses trying to push everyone. No real comfort, but I really think it is the sort of increase in bad behavior one sees whenever trying behavior modification program to change someone's behavior. Well, that and the fact that delusional people tend to REALLY defend their delusions in the face of facts that deny the validity of the delusions. The control freak RW nuts really thought THEY were America. They are not reacting well to the fact that the real majority is coming out against all the crap.

I truly hope your living arrangements sail smoothly along. I know the stress of not being able to afford a different place.
