I wouldn't be surprised if he spoke out against this unconstitutional form of surveillance in the coming days. But he has been very rigid in his views with regards to civil liberties--and those views do not make exceptions to Muslims or political ideologues. It's just sad that we live in such a polarized political climate where neither side refuses to recognize that the other side just might have a few right views.

I enjoy watching his show on occasion. When it comes to civil liberties, he has some really good guests (ranging from Dennis Kucinich to Ralph Nader to Ron Paul). I don't agree with all his politics, but I do enjoy hearing his views on the continued erosion of individual freedom in the United States--whether that be through the war on drugs or the war on terror.

He wasn't in any position to enter a judgment or in elected office. However, he has been a long outspoken critic of the PATRIOT Act since its inception. This speech is from 2004, and there are writings of his that mention his opposition to it from earlier.
(and don't take that as any endorsement for libertarians or Ron Paul)
