AUGUSTA, Maine — Baked or smoked? How patients use their medical marijuana determines their tax rate, according to a recent opinion from Maine Revenue Services.
After Mainers approved medical marijuana, lawmakers decided that marijuana sold for medicinal purposes would be subject to the 5 percent state sales tax. Now Maine Revenue Services has issued an opinion that prepared foods such as brownies that include medical marijuana will be taxed at the higher 7 percent rate. This has many questioning the ruling.
“It again shows how disconnected some people in the taxing department are from the general will of Maine people,” said Paul McCarrier, board member of Medical Marijuana Caregivers of Maine. He said medical marijuana is just what it says it is — a medicine — and should not be taxed at all.
McCarrier said for some individuals, eating foods that contain medical marijuana is the best way for them to use the medicine. He said smoking or using vaporizers does not work for everyone and patients should not have to pay an extra tax in order to use medicinal marijuana.

"Heh, I am Happy just smoking it with out paying any Taxes, either way this is a Divided Issue, on one Hand I am glad that they are helping their economy by taxing and on the other hand I agree that Medicine should Not be Taxed, what are your thoughts???

There are so many ways that the economy can be helped besides taxing medicines. Our economy has become so comfortable with running itself on the backs of the needy that there seems to be no other option. Labor should not be taxed, interest income should. Labor built this country,not wall street gambling, but when the wealthy make the laws, don't expect any sympathy from them regarding our issues, it's just easier to put the world on our shoulders and tell us "carry on"!

How can a state tax something which the fed considers illegal?
The fed supercedes and trumps any state law.Really, this stuff needs to be sold as a "controlled substance" and not be illegal.

The problem with "tax the hell out of it" is that it could still be too expensive for people to afford legally thus the Cartels will still have a market and the associated crime and violence will continue. A comparative tax close to what other like items are taxed, such as alcohol, would be more prudent.

This is what we have all been saying for years. Tax it.Tax it. Tax it.
In Oregon, medical marijuana dispensaries have not yet passed. However, in spite of that, the overproduction of cannabis in this state had forced the price of an oz of cannabis from its high of $500 once to between $125 and $150.
This undercuts the Drug Cartels from Mexico and down south...they can't compete with their overpriced product and their inferior quality. This is becoming a proven strategy to battle the cartels and why legalization at the national level is the best option.
REPEAL THE MARIJUANA STAMP ACT!!!

There shouldn't be a disproportionate tax on the medical marijuana. That's not fair. Medicine is medicine. Tax the rich! I just wish the rest of the states would catch on to medical marijuana!

All things considered the residents of Maine should be grateful they're able to buy it at all. Most states don't allow it.
But I disagree with the tax on it going to the consumer. It's a commodity - it SHOULD be taxed, but the suppliers should be the ones paying it - not the patients.
Course, it works out the same way as far as how much you're paying; still it IS medicine and the patients shouldn't be taxed.

I am happy that marijuana is available to patients.
IMO if marijuana is sold as a medicine I don't think it should not be taxed.

When they tax you form it they can not arrest you for it because that is what makes it illegal. Not paying the tax. so in short they are doing it a favor without knowing it.

You are quite welcome Lisayou and I agree... I wouldn't mind paying up to ten percent, there are people that cultivate and lend much help to the Dispensaries, especially here in Denver... I just want the taxes to be paid toward the workers, they too are farmers... =)
