Arkansas Constitution prohibits the legislature from “limiting the amount that can be recovered for injuries resulting in death or for injuries to persons or property.” Now, if I were a “founding father” of the State of Arkansas and you asked me if that provision meant that the legislature could go ahead and cap “the amount that can be recovered for injuries resulting in death or for injuries to persons or property,” I’m pretty sure I would have said “no.” I mean, it could hardly be more clear.
