I decided to do a little research on this legislation. The Constitutional Authority it is based on is "provide for the common defense". Now that all sounds well and good but how can you justify a bill based on defense when section 1031 of the bill clearly defies the fifth amendment. Shouldn't a bill adhere to all aspects of the Constitution and Bill of Rights? The fifth:
"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation."
I know the government would abuse the term "public danger", using the presumed terrorist threat as a public danger but even in that case, per the fifth amendment, the accused would be afforded due process.

I read the roll call and that you voted yes on the NDAA bill. I am wondering if you are aware of what is contained in this bill or if you even read it. The sections on indefinite detention without due process and the powers it gives the president regarding them are the antithesis to what our country and its constitution have been based on for over 200 years. Therefore, in light of this vote I cannot and will not vote for you again. I cannot abide a Congress that is more concerned with their own aspirations than with the civil liberties of its citizens.

Jan: Why do you feel the Federal government is better positioned to enforce regulations on clean air, water ect than the state governments are? Is the Federal government actually doing that good of a job in its current state riddled with corruption and revolving door politics? Would we not be more capable to hold a state agency accountable for corruption and failure to maintain standards? Would not state agencies be more difficult to buy out as special interest would have to buy them 50 times over instead of just once? Is the Federal government as knowledgeable about what your states individual needs and requirements are? Just think about it for a second, we could still do everything we need to do (I am all for standards for clean air, water ect) just at the state level just like: The Fire department, police, ambulances, libraries ect. If there has been one thing proven it is that the Federal government is not very efficient at anything save starting unsustainable wars and curtailing personal liberty.

I feel that most commentators on this are missing the big picture.
This isn't just about Obama, it's about the agenda to give the executive, dictatorial or at least near dictatorial power.
This has been a long term step program that started with Bush the first,then through Clinton,followed by Bush the younger, and finally by Obama.
What we're seeing is not about one president. It's about the long term agenda of the people that control the institution of the presidency.
Every president since Reagan has shown fidelity in their speechs to The New World Order, so you have to ask, who are they laying the ground work for?
Once the executive branch aquires complete power, one president at a time,you can be assured that in the not too distant future,we will be duped into electing the one who was chosen to wield all of that power.
With all of the attention given to the Republican primary clown show, I'm amazed we even heard about this abomination to America.

They are all, with the exception of Ron Paul, in the back pocket of some corporate overseer leading back to the banking industry. The system of checks and balances is completely broken. The three branches of government no longer act as watch dogs keeping each other in check; they follow each other, marching to the same corporate drumbeat. Some people would have you think that President Obama has some sinister intentions or don't have ordinary law abiding Americans best interest at heart, and that isn't the case. He always put the American people first. Many people are blinded by their intense dislike for him, so their interpretation of his policies are always clouded. I worked as a Volunteer Coordinator for the Obama campaign in St. Louis. I spent hours going door to door, making phone calls, attending debates, house parties, etc., to ensure his election. I am by no definition a "hater" with an ax to grind. I even think many of his policies have been steps in the right direction, and he was certainly better than the alternative.
But no sane or honest person can look at this betrayal of clear and fundamental human rights as excusable. It is blatantly unconstitutional and unjustifiable in any context. Worse, it's unneeded and probably counter-productive to counter-terrorism measures (just ask the many experts who have come out in opposition to this measure). So dismissing this criticism of the President as partisan ranting is factually wrong, at the very least. I'm afraid it is also indicative of someone who puts loyalty to party before the truth. I hope that is not the case.

Thinking the way that you think contributed to the George W Bush Presidency. Al Gore would have received more votes if it hadn't been for those Americans who divided the vote by supporting a Third Party candidate who had no chance of being elected. Ralph Nader was the spoiler in 2000/2004.
I am very disappointed in many of the president's decisions, most of the ones you have posted including this one, however I know that he is a much better choice than his opponents.
I want to clarify my opinion on so-called haters, I don't mean that everybody that disagrees with President Obama is a hater, because they are not. Only those people who hate him because he is Black and want to see him fail, never give him credit for anything.

I didn't mean to suggest that everyone who critiqued President Obama on his decisions are haters, because that is not the case. You and anyone else have a legitimate right to voice your opinion.
I am not in agreement with this decision, nor do I agree with all of the president's decisions. I will not give up on him at this point, because I know that under different circumstances, he could be more effective.
My loyalty is with the party that represents the 99%. So far the Progressive/Democrats is the only political party who advocates on their behalf. Both parties are bad, but the Tea-Bagger/GOP is completely controlled by Grover Norquist/Koch brothers/ALEC.

Does anyone recall how George W. Bush completely IGNORED any law or policy that he deemed restricting the "power of the presidency"?
He just thumbed his nose at any attempts to corral his "dictatorial tendencies"!
This bill has NOTHING to do with limiting what a president wishes to do, since it is a president's option to choose which law he decides to obey, anyhow.
It's been this way since 2001.
Not one politician on either side of the congressional aisle denied GWB whatever he saw fit, under the cloak of protecting this Nation, to do...up to and including torturing human beings.
Jose Padilla was the precedent set for U.S. citizens to be arrested and held indefinitely for whatever charges the Bush Administration deemed necessary to toss Padilla under a prison and throw away the keys.
Does anyone here feel that this bill...that will be signed into law...would have prevented OR enabled GWB from doing whatever he wanted?
If we want this "soon to be" law removed and all the other laws that have to do with the Patriot Act or Homeland Security that tramples the rights of Americans, we had better choose more wisely who we want to wear the mantle of Commander-in-Chief!
