The language of the NDAA has changed with regard to US citizens. It now says:
"Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens..."
Only problem with that phrasing is this: what are the EXISTING laws about US citizen detention?
I don't have the answer to that question, but I do know that we should evaluate and support this bill by Senator Dianne Feinstein: The Due Process Guarantee Act of 2011

You asked what are the EXISTING laws about US citizen detention?
1. There has to be a charge worthy of arrest. 2. you are allowed legal counsel. 3. The right to due process in a reasonable time.
You cannot be thrown in prison indefinitely and not get a trial. this violates the Constitution. Also the military has NO police powers inside the USA, per Constitutional decree. People need to learn their constitutional rights, and not just the Second Amendment, learn all your rights.And another thing... We the people need to fire everybody in Congress, Democratic and Republican. We need a new party that will work for all Americans. We need to elect people that knows how to get things done, and not argue with each other out of jealousy and envy, we need adults in Congress. Also everyone in Congress right now, need to be tested for drugs, just like anyone applying for a government job. And they need to be tested regularly.

Padilla was arrested at O'Hare International Airport on May 8, 2002, after arriving on a flight from Pakistan. Initially, he was taken to New York and held as a "material witness," presumably to testify against others.
The following month, he was transferred to a military prison in South Carolina after Ashcroft announced that the government had determined that he was part of an unfolding terrorist plot to explode a radioactive dispersion device, or so-called dirty bomb.
Padilla's lawyers subsequently filed a writ of habeas corpus saying that he was being illegally held. The Justice Department responded by saying that the detention was a proper exercise of the president's wartime powers. A decision is pending before a federal appeals court in New York.

And a speedy hearing is what the man is due. Take it to trial and be done with it. As the charges were filed by Ashcroft, it will more than likely end in an not guilty verdict. Then allow him to leave the country for good. With an apology for the foolish delay.

All of our representatives, with few exceptions, voted for this. Remember the oath they took to uphold the Constitution? Since we have existed since the writing of that ignored document without this "law" why do we need it now unless it is to be used in the future?
