In an unprecedented decision, India's National Biodiversity Authority (NBA), a government agency, declared legal action against Monsanto (and their collaborators) for accessing and using local eggplant varieties (known as brinjal) to develop their Bt genetically engineered version1 without prior approval of the competent authorities, which is considered an act of "biopiracy."
The journal of Nature Biotechnology reported:
"An Indian government agency has agreed to sue the developers of genetically modified (GM) eggplant for violating India's Biological Diversity Act of 2002. India's National Biodiversity Authority (NBA) is alleging that the developers of India's first GM food crop—Jalna-based Maharashtra Hybrid Seeds Company (Mahyco) partnered with St. Louis–based seed giant Monsanto and several local universities—used local varieties to develop the transgenic crop, but failed to gain the appropriate licenses for field trials. At the same time, activists in Europe are claiming that patents on conventionally bred plants, including a melon found in India, filed by biotech companies violate farmers' rights to use naturally occurring breeds. Both these pending legal cases could set important precedents for biopiracy in India and Europe."

Biopiracy is a growing crime worldwide. The number of indigenous and native species that are stolen, smuggled and sold is outpacing that of illegal weapons and drugs. The only other comparable crime would be counterfeiting which has also reached record levels. These are both corporate level, very well funded crimes with devastating consequences. Absolute power corrupts absolutely, now even life in the remotest places on Earth itself is threatened.

This has been in the works for months and they have also been doing this regarding drought resistant genes to profit from climate change. It's insidious. They knew what was required of them regarding consent (which they know they wouldn't have gotten) and also including the rights of the people who live there regarding compensation. The bastards.

GM is biopiracy IHMO. Claiming that a particular genetic variety is somehow your IP is like claiming that you are GOD, invented DNA and can prove that such a variety would never otherwise exist and that it will never contaminate any other crops. Setting up field trials and claiming contamination of non GM crops is not a crime, is like claiming that throwing stones and hitting someone in the head is their fault and not yours. If I came around to your house and punched you in the mouth then it would be very likely assault, unless of course I donated enough money to politicians, the local judiciary and spent around $20 Million on unscrupulous lawyers and knew the right people.
We all accept that spilling industrial waste into the surrounding environment is not responsible behaviour, but why is spilling genetically altered material any different? Are we somehow deluding ourselves that mutating living organisms so they can be doused in large quantities of poisons is vital to food security. I would argue that is in fact completely removed from anything to do with food security and more related to establishing complete and utter competitive dominance over a market by conspiring to deliberately set in place a process of IP poisoning.
The entire GM industry has degenerated into nothing but a complete farce which attempts to squeeze even more from the pockets of hard working people.
