Halle Berry wants to move to Europe with Oliver Martinez and daughter

Halle has not been granted a restraining order against Gabriel from seeing their daughter.
Oscar-winning actress, Halle Berry is paying her ex-boyfriend Gabriel Aubry's legal fees - after an ongoing custody dispute over their three year old daughter Nahla.

Radar Online report the parents appeared in a Los Angeles courtroom on Monday, (30.01.12) - after their nanny made allegations that Gabriel pushed her while holding the child.

Though Gabriel has denied such accusations he is under criminal investigation for battery and child endangerment.

Gabriel spoke with police and social workers from the Los Angeles County Department of Children & Family services and it has been concluded the whole family will undergo counselling.

The model's legal fees are now being paid by his former girlfriend.

A source revealed: "Halle has been ordered by the judge to pay Gabriel's legal fees. It's not uncommon in custody dispute cases when the parents aren't married, to have the person that earns more money, pay for the other side’s legal bills. It's so that both sides will have a level playing field, and fees in custody disputes are racked up very quickly.

Hollywood actress, Halle Berry has been formally interviewed by the police - after her nanny claimed that the Oscar-winning actresses' ex-boyfriend, and father of her baby, Gabriel Aubry, pushed her while she was holding their daughter, Nahla.

Radar Online previously reported the nanny says that last Wednesday, (18.01.12) she went to pick Nahla up at school - but was not there and questioned Gabriel over why she did not attend when she found them at home.

A source told Radar Online: "Gabriel and the nanny got into an argument because no one alerted her that Nahla didn't go to school.

The source went on to claim that the Canadian model allegedly verbally abused the nanny, before things took a turn for the worse.

Adding: "She picked up Nahla to leave and Gabriel yelled at her and shoved her out the door so hard that she hit the wall - while she had Nahla in her arms!"

It has been suggested that Halle Berry is trying to flee the US in fear for the life of her and her child.

The actress is one of a number of celebrities that were threatened by Robert Hoskins, an unstable man who has recently escaped from a mental institution.

Hoskins previously threatened to “slit her throat”, something which will strike a chord with Madonna, whose bodyguard actually shot the stalker when he trespassed on Madonna’s property back in 1995 after he made the same threat to her.

Berry was also targeted by another stalker, who recently breached security on her property, and friend have suggested she no longer feels safe living in America, and she is worried that her daughter’s dad Gabriel Aubry is flaunting her too much in public and also putting her at risk.

She is now trying to get a judge to allow her and her daughter to move to France, but the request is being blocked by Aubry.
