Santorum was asked by Meet The Press host David Gregory about the Ninth Circuit Court of Appeals finding Proposition 8 unconstitutional and whether he would seek any change if the highest court ruled in favor of the LGBT community.
“I would do the same thing I would with Roe v Wade, which I would seek to try and overturn it,” he said. “I think judicial tyranny is a serious issue in this race and this country. And we need judges who respect the people’s voice. Let the people decide with respect to what the constitution says, if in fact they would go through a constitutional amendment process.”
Santorum earlier this week slammed the Ninth Circuit’s decision, calling it “another in a long line of radical activist rulings by this rogue circuit.”
Unfortunately for Santorum, his effort would be futile. No president can overturn any Supreme Court decision.

Candidates are cute at that age. They believe that they know the system better than the framers of the constitution, then call the appointed officials spelled out in the constitution "tyrannical". But they believe it's okay to do something like, "overturn" a judgement on a whim just because they're president, not realizing that such a power would make off-set the balance and thus make them a tyrant.
The most dangerous part about this whole scenario, is the people who believe him.

The old rule of thumb for lawyers is, "If the facts are favorable to your case, argue the facts. If the law is favorable, argue the law." If neither are favorable you have to do a song and dance and try to charm the jury.

In Santorum's mind the Constitution only applies if you are 'straight' and a 'man'. He might have also said and 'white'. In that particular case you cited, the SCOTUS did not issue a ruling. You may be referring to another case. The difference here though is that you are thinking of required government enforcement. In the case of Gay Marriage there is no enforcement neccessary.

I'm just nit picky..lol..you can ignore me. I know the case you are referring to though and I don't think it applies. In the case you were referring to, Jackson was forcibly removing Natives, the SCOTUS told him to stop and he said no. In the case of Gay Marriage, the SCOTUS would not be telling the government to DO anything actually. Marriage is also not a Federal Issue at all, it is a State issue. The only reason it is being heard in a Federal Court is because a ban may be Unconstitutional.
