Gun Owners Refuse to Register Under New York Law

“Largest Act of Civil Disobedience in State History”

After Democrats in New York rammed a sweeping assault on the right to keep and bear arms through the legislature that failed to exempt police officers from the draconian restrictions, gun owners and even some lawmakers are planning what has been dubbed potentially the largest act of civil disobedience in state history. According to news reports, gun rights activists are urging everyone to defy far-left Governor Andrew Cuomo’s new registration mandate while daring authorities to “come and take it.”

Analysts say the legislation, passed in a frenzy last week in the wake of the Newtown shooting, represents the most brazen infringement on the right to keep and bear arms anywhere in the nation. Among other points, the so-called SAFE Act seeks to limit magazines to just seven bullets, require virtually all of the estimated one million semi-automatic rifles in the state to be registered with authorities, mandate reporting of patients who express indications that they may have thoughts about hurting themselves or others by doctors, and more.

Aside from being unconstitutional, experts on gun violence also point out that the draconian schemes are a bad idea: Studies have repeatedly shown that more guns lead to less crime, and the phenomenon is obvious across America — just compare Chicago or D.C. to Alaska or Wyoming. The mandated reporting requirements for doctors, meanwhile, have come under fire from across the political spectrum. Whether it will even be possible to enforce the bill, however, remains to be seen.

Preparations are already being made for mass resistance. “I’ve heard from hundreds of people that they’re prepared to defy the law, and that number will be magnified by the thousands, by the tens of thousands, when the registration deadline comes,’’ said President Brian Olesen with American Shooters Supply, among the biggest gun dealers in the state, in an interview with the New York Post.

Even government officials admit that forcing New Yorkers to register their guns will be a tough sell, and they are apparently aware that massive non-compliance will be the order of the day. “Many of these assault-rifle owners aren’t going to register; we realize that,’’ a source in the Cuomo administration told the Post, adding that officials expect “widespread violations” of the new statute.

Threats of imprisoning gun owners for up to a year and confiscating their weapons are already being issued by governor’s office, headed by a rabid anti-Second Amendment extremist who suggested before the bill passed that “confiscation” of all semi-automatic rifles was being considered. If tens or even hundreds of thousands of otherwise law-abiding citizens refuse to comply, however, analysts say New York would either have to start raising taxes and building a lot more prisons, or give up on the scheme that experts say will do nothing to reduce violence and that lawmakers say is aimed at eventual confiscation.

Activists involved in the state-wide boycott against the unconstitutional statute who spoke to the Post almost taunted authorities, saying gun owners would essentially dare authorities to “come and take it away.” According to the paper, leaders of some of the state’s hundreds of gun clubs, dealers, and non-profit organizations, citing the New York Constitution’s guarantee that gun rights “cannot be infringed,” are currently involved in organizing the resistance. Among the primary concerns is that, with registration, authorities would know where to go for confiscation, an idea already proposed openly by Governor Cuomo himself.

“They’re saying, ‘F--- the governor! F--- Cuomo! We’re not going to register our guns,’ and I think they’re serious. People are not going to do it. People are going to resist,” explained State Rifle and Pistol Association President Tom King, who also serves on the National Rifle Association board of directors. “They’re taking one of our guaranteed civil rights, and they’re taking it away.”

The NRA itself, while saying that it did not participate in organizing resistance to the law, admitted that it was not surprised by the open defiance among gun owners. “I will say this: Historic experience here and in Canada shows that when you try to force gun owners into a registration and licensing system, there’s usually mass opposition and mass noncompliance,” NRA President David Keene told the Post. “I think it’s going to be very difficult for the governor to get mass compliance with this new law.”

Throughout the short discussion on the bill, GOP legislators warned about the prospect of resistance — potentially resulting in violence. Indeed, even some lawmakers have already promised to defy the new unconstitutional statute. Republican state Assemblyman Steve Katz, for example, told his colleagues during the debate that the legislation’s attempt to re-define semi-automatic rifles as banned “assault weapons” creates “a new class of criminals overnight.” However, he also mentioned that he had no intention of complying with the arbitrary seven-bullet maximum demanded under the legislation.

“I leave my wife and three young daughters home alone for days at a time to represent my constituents here,” Katz said on the floor of the Assembly. “After what happened to the young mother in Loganville, Georgia who defended her two young children against an intruder, this bill will turn me into a criminal because you can bet that before I leave to do the people’s work, there will be more than seven bullets in the magazine of my wife’s firearm.”

He concluded his plea for respecting gun rights with some quotes about the reason for the Second Amendment and New York state’s even more overt prohibition on infringements. The first one he read came from George Washington: “A free people ought not only to be armed and disciplined, but they should have sufficient arms and ammunition to maintain a status of independence from any who might attempt to abuse them, which would include their own government.”

As in the rest of the United States, law enforcement has also been speaking out about infringements on the right to keep and bear arms — especially after the SAFE Act was rammed through so hastily that, according to analysts, "oops," police officers are now in violation of the law too. New York sheriffs have become outspoken about the rights of citizens, as well, expressing serious concerns about violations of unalienable rights contained in the new state statute.

"This law has some issues pertaining to the Second Amendment," explained Putnam County Sheriff Donald Smith, one of many to express reservations about the new rules. "I'm deeply concerned in haste to pass the law, they may have missed the point on some of the mental health issues and are dealing with some ammunition and gun issues and law-enforcement issues."

Steuben County Sheriff David Cole, meanwhile, released a statement backed by the local police union criticizing the highly controversial statute as well. "These laws will now make it so thousands and thousands of law-abiding citizens, who go to work, pay their taxes, and [are] concerned about their children's future, will now be considered criminals if they choose to stand up for the Second Amendment rights guaranteed under the U.S. Constitution," Sheriff Cole noted, echoing widespread concerns being heard throughout the state....

You're going to have to start advocating for the building of mass concentration camps in New York to imprison all the resident that will not comply with this law, if you want to see this law enforced...

Millions of U.S. citizens incarcerated generations of families torn apart because a spouse or both parents in jail, ex-convicts unable to get jobs because they have a criminal record, unemployed ex-cons ending up on the welfare. It's destructive to the economy. The war on drugs and criminalizing possession of drugs is a failure. So too weapons.

      Criminalizing mere possession of Anything is destructive to society. The cost of policing possession crimes, and the unintended or unforeseen side effects outweigh any benefits.

      It's when you do something wrongful with the item you possess, that should be criminal.

      You have the same right to these things that everyone else has. The right to provide them. You do not have the right to have these things provided by the government at a cost to others. These are not inherent rights. They are things you provide to yourself and y our family as a result of your labors. Mandating other people to provide these things to you infringes on those persons rights.

    • In US v. Miller and DC v. Heller, the Supreme Court ruled that the government has the right to limit the type of weapons that can be for sale, who can own them, and where they can be carried.

      Justice Antonin Scalia, writing for the majority in DC v. Heller, "Like most rights, the Second Amendment right is not unlimited," he stated. "The Court’s opinion should not be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms."

      The NY law will pass the SC standard as set by the conservative court.

      It's a fundamental right so it gets strict scrutiny which means it is almost guaranteed to fail Constitutional scrutiny because it not even close to being narrowly tailored.

      Moreover the law is violation of the New York Constitution protecting the right to bear arms.

      Add in the fact that the law will get little-to-no compliance making it more of an embarrassment to keep on the books than anything else.

      I stopped sending money to the NRA some years ago and told them that the reason is that they are not aggressive enough in countering the anti gun b.s. There IS NO COMPROMISE in this matter. Gun owners have been the whipping boys for the left every time some moron shoots up the town. Gun control does not work. Punishing those who would not do crime and/or making many instant criminals for not begging the government for permission to own what is an inherent right is lunacy. The fact is , advocates of "gun control" eventually want all Guns Confiscated …Gov Cuomo even admitted it. They say that every "gun control" measure they support is merely a "reasonable" step that would not infringe on the 2nd Amendment rights of law-abiding citizens to shoot, hunt, or protect themselves from violent crime. Gun owners have learned the hard way that these Politicians can’t be trusted . Anyone inclined to trust these claims would be wise to study the history of firearms registration in New York City.

      NYC 1967 –Gun owners were told that the new Laws would not affect them , it was just for registration. Years later they took that list and started Banning & Confiscating them.
      Gun owners were lied to –they were forced to either turn them in to the NYPD or sell them.

      This law is a measure to stop the flow of assault weapons. Not a measure to confiscate them. But feel free to take to the streets and wave them around. It will make it easier to arrest your ass.

      • Assault weapon ban and definition of assault weapons. We believe that the new definition of assault weapons is too broad, and prevents the possession of many weapons that are legitimately used for hunting, target shooting and self defense. Classifying firearms as assault weapons because of one arbitrary feature effectively deprives people the right to possess firearms which have never before been designated as assault weapons. We are convinced that only law abiding gun owners will be affected by these new provisions, while criminals will still have and use whatever weapons they want.
      • Reduction of ammunition magazine capacity. The new law enacts reductions in the maximum capacity of gun magazines. We believe based on our years of law enforcement experience that this will not reduce gun violence. The new law will unfairly limit the ability of law‐abiding citizens to purchase firearms in New York. It bears repeating that it is our belief that the reduction of magazine capacity will not make New Yorkers or our communities safer.
      • Method of bill passage. It is the view of the Sheriffs’ Association that anytime government decides it is necessary or desirable to test the boundaries of a constitutional right that it should only be done with caution and with great respect for those constitutional boundaries. Further, it should only be done if the benefit to be gained is so great and certain that it far outweighs the damage done by the constriction of individual liberty. While many of the provisions of the new law have surface appeal, it is far from certain that all, or even many, of them will have any significant effect in reducing gun violence, which is the presumed goal of all of us. Unfortunately the process used in adoption of this act did not permit the mature development of the arguments on either side of the debate, and thus many of the stakeholders in this important issue are left feeling ignored by their government. Even those thrilled with the passage of this legislation should be concerned about the process used to secure its passage, for the next time they may find themselves the victim of that same process. Fortunately, the Governor has shown himself open to working with interested parties to address some of the problems that arose due to the hasty enactment of this law. We will work with the Governor and the Legislature on these issues.
      • Sheriffs understand their Constitutional obligations and the concerns of constituents Sheriffs and other law enforcement officers are not called upon by this new legislation to go door‐to‐door to confiscate any weapons newly classified as assault weapons, and will not do so.
      Sheriffs represent all the people, and we take an oath to uphold the Constitution of the United States and the Constitution of the State of New York. Sheriffs will continue to enforce all laws of the state and will protect the rights of all citizens, including those rights guaranteed by the Constitution of the United States and the Constitution of the State of New York.

    • My best bud is an ex-Marine who lives in upstate NY.
      We talk a lot about this issue.
      He understands that the Second Amendment is all about 'a well-regulated militia' and that semi-automatic rifles should not be in the hands of civilians.
      Yet he is refusing to register his guns.
      I try to explain that the Founders were referring to muskets and 'a well-regulated militia'.
      He agrees that automatic weapons shouldn't be in the hands of dumbfucks and told me that Chris Rock has the best solution: Make bullets for automatic guns so expensive that only the military (taxpayers) can afford them.

      Why do they plead out guilty offenders? Because there's been so many mandated sentences for very small (personal) quantities of pot, judges are forced by over-crowding (because of these "war-on-drug" lunatic policies) in prisons to throw these people back on streets. Then there's the numbers of mentally ill that have been thrown into the prison-system... that's an entirely other issue.

      The reason NY lawmakers didn't jump straight to assault weapon confiscation was a *strategic* one. They dialed back the severity of the legislation to give the pseudo-impression that it was more moderate---that they are merely asking you to registure, not confiscate, your assault weapon.

      However, once the weapon is registured, they know you have it. Registration was only phase 1 of their long-term goal: confiscation. If they attempted confiscation right off the bat, it would come accross radically extreme and nobody would comply. Merely requiring registration first allows them a foot in the door and a much easier shot at enforcement when confiscation comes down the road.

      I register to vote ,to be a member of a political party,to be a dues paying member of a union, my car is licensed and the insurance is paid I have driver licensed
      I must lock up things just to keep honest people honest
      yet the real thieves are stealing my retirement
      feeding poison to my children
      destroying my water supply
      forcing the less fortunate to work in deplorable conditions that some ass thinks that they don't like it then leave

      The major Drug Dealers/Gangs & Criminals are all there , and they can afford to pay top dollar ..and soon they’ll have the latest in Hi-tech Assault Weapons to chose from.
      Cuomo did away with the Grandfather Clause that allowed us to keep the Hi-Cap magazines we legally owned ..the State is now mandating that we sell them out of State.
      NY has no idea what people own so , imagine how many of those Magazines will also end up on the Streets ,with those Criminals.
      And they were all so paranoid about the NRA & “Gun Nuts”
