Ariz. Couple Sues Walmart Over Kids’ Bath Photos

In 2008, Lisa and Anthony “A.J.” Demaree took their three young daughters on a trip to San Diego. They returned home to Arizona and brought photos of their then 5, 4 and 1 1/2 year old daughters to a local Walmart in Peoria to be developed.

That should have been that, except instead of receiving 144 happy familial memories, Walmart employees reported the Demarees to the Peoria Police Department on the suspicion that they had taken pornographic images of their children. The police, in turn, called in the Arizona Child Protective Services Agency, and the couple lost custody of their daughters for over a month.

They were shocked. “Some of the photos are bathtime photos,” Lisa Demaree told ABC News at the time, ”but there are a few after the bath. Three of the girls are naked, lying on a towel with their arms around each other, and we thought it was so cute.”

A Maricopa County Superior Court judge ruled that the photographs were not, in fact, pornographic, and a medical exam revealed no signs of sexual abuse. The girls were returned to their parents.

But the damage had been done: The couple’s named went on a central registry of sex offenders, and “We’ve missed a year of our children’s lives as far as memories go,” Demaree told ABC News

      A-FRIGGIN-MEN!
      I used to go to the old stores (b4 they became supersized) b/c the stuff they sold was basically good (didn't fall apart the first time you washed them) and cost considerably less than stores like Penney's and Sears, but it's been years since I've gotten anything there that lasted longer than a couple of months so I quit spending any of my money there more than 5 years ago. And when I found out what kind of profits the family was making I decided I would NEVER add to their ill-gotten gain!

      I was actually born in AZ, but left as a baby ... I still have an aunt that lives in Phoenix, but haven't been back there since I was a teenager -- don't see any really big reason to ever return. Guess it was good that I got outta there while the gettin' was good :-)!

    • I think it's funny that essentially EVERYONE who grew up before the 1990s has pictures of themselves naked in the bath somewhere in their family photo albums.

      This new generation just doesn't appreciate a parent's need to embarrass their children in front of their future boyfriends/girlfriends. Too many To Catch a Predator episodes have made them realize that EVERYONE EVER is a pedophile.

    • Some people are just so frigging stupid. That's the scariest thing about this world -- not gangs, not white sharks, not natural disasters, but stupid people. They make this world suck. Those Walmart employees and the power given to them by overly-sensitive unthinking protect-the-children-by-instituting-fascism idiots make me sick to my stomach. It sucks that the world is so stupid that someone can be proud of themselves and think of themselves as the good guy as they are tearing families apart.

      It is like the "see something, say something" crap that comes from the government or the suspension of a student because his pastry happens to be bitten into the shape of a gun. There is a lot of noise from the Child Protective Service folk and police regarding kiddie porn. that and quite possibly that the employees, or the company, did not want to be seen as accessories to the distribution of kiddie porn by the government. I don't see this as a Wall Mart generated thing but a response to government. Wall Mart has better things to worry about.

      Any idiot with half of a brain could view the photos in context, and know them to be legit. However, that's not what you get at Walmart. They could've chose to handle the matter discretely for their customers, but I'm certain the Private Sector Giants had a "policy" that all employees had to abide by.
      It is the fault of the store that the police were involved and that these parents lost their children.

      Walmart does not have any law enforcement mandate, power or capability. They could have an internal memo refusing to process the photos or return them but I am fairly certain that the only reason for informing law enforcement was to mitigate any perceived culpability the company would become entangled with by returning the photos and saying nothing. It is the policy of CPS and law enforcement that the parents had this problem, not Walmart.

      This is obviously a government at work. Walmart does not have a dog in this fight otherwise.

      You are certainly free to believe what you wish, however, I suspect that the belief that it is the company is more a result of the hatred of Walmart than anything else. I'm going with the government as the bad guy in this case. Companies generally don't make policies such as this without a basis founded in some sort of legal liability.

    • This is terrible for this couple. What a terrible experience.

      It isn't their fault in any, way, shape or form, but honestly, I would never take naked photos of my kids to a developer. Have you ever seen "One Hour Photo?"

    • I believe the police were just being cautious by investigating this family, I'm sorry the family had to experience an investigation concerning their little girls, but bad things do happen in this world.

    • Those girls could end up scarred for life by the moronic actions of Walmart employees, cops, and the Child Protective Services Agency. They were not abused, until the authorities got hold of them. Now they've been abused for sure. I hope the parents win those lawsuits, big time.

      In addition to the anxiety of separation, I worry about the input of adult repression, guilt & sexual fears into these kids at such a young age, from strangers, in a cold, institutional atmosphere. The whole thing was unnecessary, and potentially very harmful.
