Judge Napolitano Voices in on New Jersey v Brian Aitken

Mr. Aitken, a 25 year old resident of New Jersey, was arrested for what the State of New Jersey has called “illegal possession of unregistered firearms” on January 2, 2009. According to all verifiable sources, it appears Mr. Aitken was abiding by the law and even went so far as to seek the advice of New Jersey State Police before being arrested for doing what he was told—even though State and Federal laws protect his right to possess and transport his legally owned firearms.
Surprisingly, Mr. Aitken has received no local or national media attention until recently; understandable when one considers the local media has had their hands full with the recent New Jersey Corruption Sting—which resulted in the arrest of mayors, state lawmakers, and other public officials.
Mr. Aitkens first national appearance began with Judge Napolitano saying, ““I am happy to meet you because you are a lover of freedom, and a defender of freedom, although your rights in the Garden State have not been upheld by the judicial system.”
The interview was most notable due to the Judges’ personal and professional connection to New Jersey. Judge Napolitano spent his career as a lawyer and Superior Court Judge in the same state that is trying to lock up Mr. Aitken for obeying the law. Add in the 11 years Judge Napolitano spent as a constitutional law professor at Seton Hall University and it’s difficult to imagine anyone could know the New Jersey State Law better than him. “Jersey is not a gun-friendly state,” said Judge Napolitano, “I can tell you as a former life tenured judge in that State, [New Jersey] is not a friend of the Second Amendment.”
Judge Napolitanos’ expert opinion? “They were legally possessed… I’m 100% on your [Brian Aitkens’] side.”

larryP - people get arrested all the time for no reason. It's never happened to me, but I'm not naive enough to believe it doesn't happen. If you look at the information provided (which is the one side) it says the police responded to a dropped 911 call... and he's not being charged with a crime associated with that call. It also shows that he was in the process of moving (not "fleeing" - he had nothing to "flee" from as no crime was committed)... which is a legal ground (one of many) to transport firearms in the state.
I don't know where he says anything about being a loving father and volunteering... but I do see that he has a son who he appears to love very much. I don't think that's been "upplayed" at all.

Now of course i wasnt there for the incident but i dont think police arrest people for absolutely no reason. "factual information" or not, we are only getting one side of this story (the side of the defendent of course). Downplay the fact the "verbal family argument" was actually serious enough for the police to be called in the first place, and the fact this guy tried to flee the scene (in his vehicle with the firearms) before police arrived and upplay you being a loving father and how you enjoy volunteering in your spare time. real original.

Yes Fox sucks, just like all mainstream news because it's all owned by the same people. This happens to be the only program worth any substance whatsoever, which is why it is only on the internet and not on Fox News channel itself. It's not nearly as edited.
Just because MSNBC spouts a lot of bull doesn't mean I discount everything that's reported completely. I take Fox with the same grain of salt. Try to use some common sense, again, and actually research the issue if you aren't completely mentally lazy. No valid arguments here, just more pettiness. Troll somewhere else where you people actually have some knowledge on something. All opposing comments here have been pretty infantile thus far.

Wow. bombastinator clearly has no understanding of freedom, and like many Americans, has no concept of the Constitution or Bill or Rights, because he clearly has not read these documents.
Freedom and gun rights go hand in hand, so the argument makes absolutely no sense - not to mention the incorrect usage of the term "doublespeak".
I'd like him to explain what exactly makes this guy is an "obvious nutjob"...? This is what "the left" does when they don't have a cogent thought to form into an argument. They feel indignant, and instead of using their heads and actually researching a subject, using the scientific method, or calculated discernment of any kind - they use petty attacks that have nothing to do with the actual issue.
How is imprisoning someone who has done nothing more than move from one area of New Jersey to another make the rest of the country any freer? OR safer for that matter (though only fools sacrifice freedom for safety)? Especially when he was licensed in the state and went through the proper channels to make certain he did everything right while transporting them.
I really wish people would research something before they mouthed off about things randomly on the internet as if they possess some knowledge that those of us who actually read don't. But then again, it just exposes the ignorance of some people. Luckily, not all left-leaners are so ignorant. And of course, the ignorance lies on both sides of this one-party, two-faction political system. Which is why I subscribe to neither of them. :)

its useless....
just educate the ones who are willing to listen to sanity versus those who find every niche to persecute and discriminate against. People like him who blindly protect corruption, fraud, and violence shouldn't be given much credence in the first place.
and to answer his question....NO, most people don't even know what freedom is let alone how to defend it.
...and people wonder why we are on the decline. The proof is right there in front of their faces yet they continue down the old slavery path.....just ignore this kind of hatred, violence, and theft and just move on to those who actually care about humanity instead of wasting time on those propping up failed politicians and failed party lines.

Obviously Mr. Aitken was backround checked before he was even able to purchase his licensed guns. If he was a so called "nut job" like bombastinator claims he is, then why was he even able to purchase them in the first place?
This story is sad because not only does Mr. Aitken face jail time for something that he is wrongly accused for, but he also isnt able to see child. Working in a classroom environment, I know first hand how much it effects a child when a parent is missing from their life. It saddens and angers me to know that Mr. Aitken actually wants to be a part of his life, but inaccurate accusations are holding him back from being with him.
If you listen to all the information, you can clearly understand that Brian did everything that he was supposed to do and then some upon bringing his firearms into the State of New Jersey. In my opinion, he did absolutely nothing wrong and abided by the law.
When are cops going to stop and get off their high horse and actually protect people from the real offenders of the law... and not innocent people like Mr. Aitken.

If Judge Napolitano doesn't think a crime was committed and he was a Jersey judge then it looks like a crime may not have been committed. In which case he should be free. Remember officers are not law experts and often make mistakes.

This whole thing is sad. I don't know who had the idea to charge him with all of that, but I sure hope that the charges are dropped, as he clearly wasn't trying to do anything illegal.

I don't know much about the case, but he seems like an honest guy who just wants to be able to live without fear of persucution... especially when he's just obeying the law.
Bombastinator - what makes you think he's a "weird political fundie"? I didn't notice anything he said in his interview as being extremist... or is it simply because he appeared on Freedom Watch?

So apparently he's some sort of weird political fundie and his connection to reality is a bit tenuous.
Well the cops do like to take guns away from obvious nut jobs when they can. I'm liking their behavior more and more on this one. There's the legal thing to do and the right thing to do.
At least this is real. Right wingers getting behind this issue aren't going to look droolingly stupid like the birthers. That whole thing is just sad.
