Police officer who had sex on duty won't face charges

"At this time we don't believe that any criminal acts occurred," New Mexico State Police Sgt. Tim Johnson said in a statement.
He said the officer involved in the encounter was currently on paid administrative leave and that the case was still "in the disciplinary process" in the department.
Johnson told Reuters that after speaking with the woman, investigators decided the trooper hadn't broken any laws. (BUT IF A CITIZEN WOULD HAVE DONE THE SAME THING, HE/SHE WOULD HAVE BEEN ARRESTED FOR PUBLIC INDECENCY)
"This officer made a horrible personal decision that will obviously reflect poorly on the whole organization," he said.
"The New Mexico State Police is very embarrassed by this incident and will work tirelessly to restore our good name and earn the trust of the citizens back," he added. ( WHAT A FUCKING JOKE!!)

Near some town called Breckenridge, if I recall. I was pregnant and had to pee. My husband and I were on our way to Mobile, Alabama, where he would begin teaching at the Univ of South Alabama. The road was two-lanes, deserted (we thought) and so we did what we had to do. A state trooper came up behind us with lights flashing . . . this was in early 1984. My husband was in the trooper's car for the longest time. I didn't know what the heck was going on. Finally he came back and said that he almost had to go to jail for peeing by the side of the road. Luckily, he talked his way out of it. So when did bodily functions become felonious deeds?

"Police officials would not comment on whether the dismissal was an indication whether the officer was on duty at the time of the incident.
The dismissal came days after investigators said the officer didn't commit a crime. Officials were assured the sexual encounter was not in exchange for anything related to his position as a law enforcement officer."
I think dismissal is harsh. How do we know whether it was his ovulating girlfriend that had to be schtupped right then to get pregnant because she wanted a baby because her biological clock was on the fritz? Okay, I am stretching it, but we don't know.
Well, the decision has been made.

The citizens of Santa Fe should demand that this cop gets charged with the same crime that they would be charged with, if they were caught having sex in public. Historically, the code of silence that is alive and well in virtually every police force in this country has been the abiding cancer within our society. Unless this cancer is eventually removed, we cannot ever achieve a society that is worthy of a civilized nation. That those who "protect and serve" are so readily willing to demean our societry and its people is one thing, shame on them. That those who are in authority over them are unfaithful to the discharge of their duties is quite another. The failure to punish wrongdoing has NO currency in a just society and nothing is more important to the administration of justice than a firm hand on lawmen who break the law. There must never ever be any allowance for it. That officers of the law are more than willing to disobey their oath is no
surprise, that they pay no penalty always is. - 9 months ago

2. An armed, officer of the state should not be accepting consensual sex (which should certainly be considered bribery of a police officer).
3. If cops are allowed to have sex on duty, then we very quickly will see spikes in vulnerable women being victimized by bad cops taking advantage. The good cops will wonder why it is getting even more difficult to get witnesses and victims to trust police.
4. Cops don't get to use their badge to get sex. Save it for after work.

So you think that he is a cop who is 100% on the level, except that he just happens to screw women while on duty and in public. I am sure that he draws the line at dereliction of duty, getting paid good money to not work. Do you get it that a cop who would do this is in all likelihood out of control in many other ways? I am not a prude or a wacko who thinks that sex is bad: this is an issue of a cop who does not have a problem lying to his bosses, lying to the public, committing crime in uniform... but we are all supposed to keep paying his salary, keep dropping to the ground when he pulls his gun that we pay for, and trust that he knows where to draw the line? HE THINKS THAT HE MAKES THE RULES, AND HE THINKS THAT THE RULES ONLY APPLY TO YOU AND ME, NOT HIM... and guess what: sounds like his fellow officers and the DA all agree. 3. Cops are human like everyone else. No, they should not be allowed to have sex while on duty and i will bet this particular police officer never will again. Again, assumption that he knew the woman. If he did not, then that is another story.
