Cuban rocker deemed government threat on trial today

Cuba is to charge a punk rocker today with "social dangerousness" because his songs denounce and deride the communist government. Gorki Aguila, lead singer of Porno para Ricardo, faces up to four years in prison for openly defying the revolution and scorning Fidel and Raul Castro as "geriatrics". The 39-year-old has been in police custody since Monday and was due to appear at the Playa municipal court in western Havana to be charged with subverting "communist morality".

Police arrested Aguila at his home where he was completing a new album provisionally called Geriatric Central Committee, a reference to the ageing leadership. Formed 10 years ago as part of an underground music movement, Porno para Ricardo is banned from official airwaves.

      Gorki: Imaginate, de un juicio politico tuvieron que hacerme un juicio por conducta antisocial, por hacer ruido, etc, gracias a la enorme presion internacional y la verdad en la mano, y el abogado Henry Rosello, un valiente, gracias a eso pudimos derrotarlos....       "Words (almost) fail me. Cuba’s detained a singer from a rock band and is reportedly set to charge him with the super-vague offence of “social dangerousness” or “subverting communist morality”. Ok, it might seem ludicrous (it is), but Gorki Aguila from Porno para Ricardo is in detention and he could get jailed for up to four years. "

    • As I write this punk rocker Gorki is in the midst of a closed door trial for "predilection to social dangerousness." In a show trial with equal parts Stalin and Kafka.

    • Reports coming in that the trial is closed door and diplomats and friends of Gorki were barred from attending the trial that was still going on as of 1:30pm.

    • Human Rights Watch in their report Cuba's Repressive Machinery describes it as follows:

      Dangerousness

      Cuban law defines dangerousness (el estado peligroso) as "the special proclivity of a person to commit crimes, demonstrated by conduct that is observed to be in manifest contradiction with the norms of socialist morality." Signs of dangerousness include "anti-social conduct" or general behavior that "perturbs theorder of the community." The law states that "mentally deranged [persons] and persons with retarded mental development" are guilty of dangerousness if they represent a threat to the "social order" or to the security of others.79 The breadth of the dangerousness law permits Cuban authorities to employ it for politicized or discriminatory reasons.

      If Cuba determines that someone is dangerous, the Criminal Code allows the state to impose "pre-criminal measures," including surveillance by the National Revolutionary Police and reeducation for periods of one to four years. The state may detain the person during this time. The law also provides for "therapeutic measures," including detention in a psychiatric hospital, that are continued "until the dangerousness disappears from the subject."80 The open-ended nature of this punishment affords the state extraordinary authority to abuse the rights of political opponents and the developmentally disabled.

      Basically its a thought crime or pre-crime if you saw the movie Minority Report where the government is able to see into the future and like Bush's preemptive wars we now have preemptive arrests.

    • Current had the story a few days ago as well, apparently Aguila is up for 'dangerousness' charges. From the 17 comments on the original thread, I'm still not sure what that actually means...
