While I hate his lyrics, while it is true that with rights come responisbility, we cannot legislate responisbility, we cannot legislate morality. The first amendment does, in fact protect his right to say (sing...rap...) what he did. Personally I would hope that he (or anyone else) would choose a different "outlet".....again..hope cannot be legislated.
p.s....screw fox news...wish we could legislate them out of existance.....

On the other hand if we lived in a more intellectualized society, we would take this opportunity to laugh at this man for the insanity he so clearly demonstrates and use this episode as a guide on how not to behave. we would even encourage observation of this kind of fringe-ness to reinforce where we stand and why.

Technically speaking, this already HAS gone to the supreme court.
We have an established standard as to what actually is not protected speech. It was set back in the 60's with a case regarding the KKK.
This man didn't breach it. You need to have incited a true intent to commit unlawful action and for that speech to likely cause that infraction to occur. So it isn't even enough to say something like "let's start a riot," I need to actually CAUSE a riot for me to be prosecuted because of it.
By that standard, this man has not committed unlawful speech.

Once I had a cop tell me he was going to embareass me and my family because I was the biggest drug dealer in town. I actually was broke, and didn't even smoke pot at the time. I had just passed a drug test for a job. The officer no only threatened me, but my family as well. Im my opinion, if you cant eat it don't dish it out yourself.

You can think a cop is an asshole, but you can't just go to his face and tell him or her that. You can't tell a judge on a trial that he's full of shit. There's stuff you JUST CAN'T DO. Physically, yes, you can, but in reality, there are always repercussions.
You cannot threaten a person without repercussions. Cops are a different story because THEY are the ones who hold the power.
