The bank confused this man, Benjamin Lovell, with another Benjamin Lovell who works for a property management company.
The Benjamin Lovell being charged said he went to the bank and told them that he does not have a $5M account, but that they said it was his. So he did what any normal person would do and gave a way some of the withdrawn money (so sweet), spent some on gifts and blew most of it on bad investments.
Isn't that like everyone's dream situation, "oh no there is some extra monies in my account?" Note that you will have to pay for the bank's mistake with some court time.

dats wild kid...lol... dat man shouldnt be charged with anything... it was the banks fault or even doing it... an on top of that he tried to tell them he didnt have it... so thats a big mistake on the banks part... ya diggs...

I say after the guy made the bank of the error and they insisted the money belonged to him then they should eat the loss

Hopefully he can prove that he had conversations with the bank or with an employee of the bank regarding this.

yea, as far as I'm concerned, if the bank makes a mistake, they can eat it.
the man shouldnt be charged with anything except Common Sense.
