Effert had strangled her hours-old son Rodney, he conceded. Dumped the body, wrapped in towels, into a neighbour's yard. Lied to police.
But she was, he said, no murderer. And indeed, Effert's life sentence, given yesterday, for second-degree murder, marked a novel turn for Canadian law -- the latest legal step away from special Criminal Code considerations for new mothers, and toward holding women who kill their babies in the emotional, hormonal hours and weeks after birth, fully responsible for their actions.

The people with money will hire attorney who will try anything to win the case and free their guilty client. But the innocent with no money can not even defend his/her innocence. I used to think if someone was accused of wrongdoing then there must be some evidence. It is not so. Many innocent are falsely prosecuted and guilty such as this “mother” who killed her newborn baby frequently will go free. I have ZERRO confidence in our justice system.

I know Iam extremely late to this but here gos any way I don't really have to much sympathy for new mothers who use a postpartum defense because I suffered post partum with all three of my kids it cost me my first husband because I didn't know what was happening I felt like I was losing my mind(i never wanted to hurt my children )I did want to hurt my self and I became obsessive.I called my family and doctor for help.that is why I have no sympathy you do not go mad .You do know something is wrong ,so call some one.

I agree; I, too, went into this deep dive about 6 weeks post-partum. I never wanted to harm my child, could never harm my child.
It was so strange because with the birth a I had such an exileration, I left the hospital feeling 10 years younger and healthier than before the C-section. People commented on the fact, only to have the opposite occurance in 6wks.
I think there has to be a tendency to this type of behavior that the hormonal changes may trigger but actually do not cause. - 2 years ago

Yeah, lawyers are the reason so much about are legal system s**ks today. Yes, he was only doing his job but really... she strangled the child. She got what she deserved.

It was just a lawyers ploy. They are bound by law to defend their clients to the best of their ability. If they don't they set up grounds for appeal or a new trial. His ideas are pretty bogus as most of us believe that murder is murder even when done by a new mother. But he has to play up the media and protest otherwise the family might come back and say he didn't defend his client to the best of his ability. It happens every day in courts across the country, we hear about it more because of the Internet.
We saw in the trial of Timothy McVeigh who admitted to the Murrah Bombing in OKC, Mr. Stephen Jones from Enid, Okla defend McVeigh to the best of his ability. I think it might have cost him a marriage and a practice, but don't quote me on that. However, he didn't take any of the appeals because he had done his part and McVeigh didn't want any appeals. He wanted to die and he got his wish.

Where is the justice? Could a new father present a defense that he was under stress, sleepless nights, and his wife whose "emotional, hormonal hours and weeks after birth" pushed him to the level of stress to kill his newborn? Of cource not... This is just as ridiculous... - 2 years ago
