A prostitute gave birth and dad is forced to pay child support
source: http://www.news.com.au/heraldsun/story/0,21985,25963638-661,00.html
The married Melbourne man argues the child is potentially a breach of the Trade Practices Act.
He told a federal magistrate he shouldn't have to pay for the inadvertent offspring given the circumstances of the conception.
The accidental dad - who can be referred to only by the pseudonym Mr Lilley - told magistrate Grant Riethmuller he'd had "a consumer transaction" with the child's mother.
Mr Lilley argued an implied term of the "contract" between clients and sex workers was that women would take measures to avoid pregnancy.
Mr Lilley told the court he was not disputing paternity.
The prostitute - known only by the pseudonym Ms Logan - did not appear in court, and details of her employer were not publicly revealed.
The magistrate heard Mr Lilley initially contributed about $100 a week towards the infant's upkeep under an informal arrangement with Ms Logan. The matter spilled into court in June after he lost his $140,000-a-year job and fell behind in the payments.
Mr Riethmuller heard the man already had a child with his ill wife, and was struggling to support his family financially after taking a hefty pay cut in a new job.
The man used the legal action to question whether the sex worker and the Federal Government's Child Support Agency had any right to chase him for money.
In an affidavit, he argued the woman's basis for seeking support was "fundamentally flawed" given her job.
But in a ruling issued this week, the magistrate said the circumstances of the conception made no difference to the child's entitlements under the Child Support Scheme.
The man was ordered to keep paying $100 a week until a likely appeal to the Social Securities Appeal Tribunal.
The magistrate noted the door might be open for the dad to launch legal action against the owners of the brothel or escort service - or the mother individually - for damages.
Sex without a condom is illegal in licensed Victorian brothels and escort agencies.

Apparently NONE of you read the part where the man was paying $100 a week for this kid until he lost his job. If he felt like he shouldn't have to pay for the baby because she's a prostitute, why'd he do it before he lost his $140,000 job? He's only bitter now cuz he has no money and his wife found out. In this case, yes he should pay, or he shouldn't have started when the baby was born.

That's rather moronic. You're saying that just because someone initiates an altruistic act means he's responsible for continuing that act beyond the limits of his own free will?

Ah yes, what an evil stupid law-manipulating woman. She probably eats kittens and clubs seals too. What a bad woman.
Oh, wait, no - this is actually just yet another story where in fact, if anyone looks beyond the headline, the moronic man got himself into the mess.

The woman is solely responsible in this situation. If she can have an abortion by her lonesome then she can raise a child by her lonesome.

Fantastic.
"This is why abortion should be paid for. I feel sorry for the guy and I feel more sorry for the child."
But no one, I doubt, is refusing to let either of the actually responsible parties pay, so saying abortions should be "paid for" of course really just means another idiot liberal wants YOU to pay for it, so it's merely "free" to literally any bitch who feels like it's in her own selfish interest to get one (forget any questions of right to life for the kid of course, they never get that deep into personal responsibility, it's simply "discomforting" and they can't suffer that incivility)––and this even if the truly responsible parties may already have the money to do it; apparently, the liberal "feel-good" for these creeps like this feeling pregnancy is just an occupational hazard of some sort, is that free is good in any bad situation. But think about what hazards all other occupations suffer and make that all so "feel-good" free too then: perhaps sports players and mere enthusiasts too would appreciate getting free reconstructive surgeries for the "problems" they "inadvertantly" create in their bodies "doing their jobs" because it's "their" body, eh?
But (taking all the cake imnsho) feeling sorry for a child because he/she is not already dead by abortion takes quite a very special kind of character...the kind of class that continues to inspire our people to be such a stronger nation despite adversity, such that we're all so glad just to be "alive" (while we still have a right to be). We all have a right to be proud of abortion don't we? It sets us apart. Defines what it means to be "free" and makes the world respect us more than any other view we could take. Women's so-clled "health" rights first and foremost, right? Yes, absolutely, Fantastic.

I do agree with the notion that both are responsible; if it was completely consensual (both were aware no contraception was being used), I'd say 50/50 is perfectly just.
