Cop who fatally shot handcuffed man resigns

I wish i lived in Oakland so i could break some cops windows or something!

The Bay Area Rapid Transit police officer who fatally shot an unarmed man on a train platform early New Year's Day has resigned. Protesters filled the streets after Oscar Grant was shot and killed when he was lying face-down on the platform.

    • I submitted an article on this. Someone beat Me to it. I will say that at the time, when I first shot the article in. There was very little information given. Only that BART Officers were called to the Train, it was reported as a fight on the Train. Then, an Officer had shot a suspect, while suspect lay on his stomach on the platform. The Man immediately resigned before Investigators could interview Him. The Family, has filed a wrongful death suit against Bay Area Transit. And they are seeking Criminal Charges be brought up against the Officer involved. This disturbs Me on so many levels.

    • Considering that a taser is usually carried on your thigh and your gun is carried at your hip I call bullshit on his "I thought I was using my taser" excuse.

      Either they have a complete shit training department or the cop was mildly retarded or both. Or he purposely shot the guy for unknown reasons.

      Let's hope they throw him in jail... but we all know he will get away with it.

    • The thing you have to keep in mind is that it was new years. This Cop was probably dealing with angry drunks and fights all night long. Not to mention he's probably been a cop for a while. In a city like Oakland your gonna be dealing with a lot of crap. Try to show some humility. What this Cop did was wrong but to be so ruthless in your calls for him to be tried as a murderer. Its pretty sad. Cops deal with a lot shit, thus there is gonna be an occasional accident. Hes a creature of his environment not an evil person. If anything it should be pity not anger we feel towards him.

    • This is old news. The BART policeman resignation was before the riot/protest happened.

      Seriously, why use violence against the Oakland police? Why destroy innocent people's property when they have nothing to do with the incident. The family and friends of Oscar Grant urged everyone to stop the violence.

    • this is some f****d up s**t. First this, then a few days later the cop in texas who shot a black kid for driving a "stolen vehicle" which turned out to be his dad's. Cops are going too far with their big heads thinking they're exempt from laws. I'm in Chicago and these cops up here do whatever they want. I saw a cop turn his lights on so he could drive through a busy intersection downtown and not stop and as soon as he passed through he turned them off. These pigs need to understand they work for the people, THEY WORK FOR US, not the other way around. I support these protests 100% and I agree totally that this man should be on trial for cold blooded murder. They should receive and even WORSE punishment than normal murderers because they are given weapons to protect. By violating their sworn oaths to protect the public they are traitors to not only their badge, but to the townships and cities they work in. We need to put these cops in their place STAT!!

    • I don't believe he was cuffed at the time he was shot (I could be wrong). Based on the best angle I saw, It looked like Oscar was face down on the ground and one officer had a knee on his head/neck. Then a different officer pulled his gun and shot him.

      There is one video that shows a handcuffed man kneeling down... last night I heard on the local news (I'm in the SF/Oakland area) that the cuffed man was actually someone next to Oscar. I doesn't mean they both weren't cuffed, but that particular station retracted their claim Oscar was cuffed at the time he was shot.

      Either way, it doesn't excuse what happened. BART ought to revise its plan, if it has one, on how to handle officer-involved shootings. The fact any of those officers were allowed to go home before giving statements is absurd. What other shooting with that number of witnesses takes 3 weeks (the time currently projected) to sort through?

    • I watched the video last night. The cop had no reason to shoot the innocent man laying on his stomach. He should be charged for murder!!!

    • Honestly, we're f'ed. Cops are people. People are flawed, ignorant, fearful, and imperfect. So unless robots police the streets, this is going to happen. Since there has always been poverty as a result there will be crime and thus cops, and this will happen again.

      I'm surprised this requires further explanation. Indeed, this act of senseless slaughter could very well have been an accident. In the heat of the moment the officer may have mistaken his firearm for his stun gun. In one of the video clips it appears almost as though the shooter himself is taken aback after his weapon is discharged. The incident calls into question whether or not BART officers should be equipped with stun guns only sans firearms. And although the loss suffered by the Grant family cannot be quantified, perhaps some measures can be taken to ensure that similar tragedies are avoided in the future.

    • i've been following this story since day one as im sure a lot of interested people have been doing. who cares that the cop resigned? we knew that he resigned yesterday.

      also, i cant believe how many people think that the shooting was unintentional. if you see the video, you can see that there was no reason for the cop to even have his gun drawn, let alone have it pointed at an unarmed, handcuffed man's BACK.

      if i were an oaklander, i would still be in the streets.

      of course if a crackhead shoots up a head shop and kills a white girl right next to my house like last month, no one gives a shit.

      as terrible as this tragedy is, it needed to happen. how it manifests itself matters not, but we should have been rioting a long ass time ago. look at the bigger picture.

People weren't just destroying cop cars, they set innocent people's cars on fire and destroyed private property as well, how is that any better than cops attacking private citizens? I am not saying I am for the cops that did this at all, but what do people expect to accomplish by being mindlessly destructive? It only shows the police that brutal force is neccesary to stop idiots like that. Fight them legally and intelligently, it's the only way to really win. I thought we had evolved beyond caveman antics...

    • nobody knows why he shot him he won't speak to nobody and they haven't arrested him. the story i have heard is that there was a fight and bart police were called out. Oscar was trying to calm the situation down but they restrained him anyway. the person who was sitting beside him said that he was complying with the officers orders but he was begging not to be tazed, at least 3 officers had their tazers out including the officer who executed him. the reason why they decided to make him lay face down i don't know, but when the officer shot him he was laying face down with handcuffs on, there wasn't even a logical reason to taze him.

      i don't know if they will be protesting everyday but there will be one on the 14th at city hall at 4pm then a march to the bart police headquarters

    • This horrifying shooting death, while it should not go unpunished, may very well have been a tragic accident. Which raises a bigger question, should BART officers be allowed to carry firearms in addition to their stun guns?

    • The shooter's immediate reaction makes me believe it wasn't an intentional killing. Nonetheless, his actions should not go unpunished.

    • Intentional or not this is murder. You don't "forget" which deadly weapon you have in your hand. If you get too nonchalant about holding a gun or a tazer you shouldn't be in the job. Killing has become to easy and too palatable in this country, especially when it is done by cops.

    • im 100% positive that this was not an accident. there are a few very significant differences between a tazer and a handgun. foremost the weight difference. a trained cop would not make this simple mistake. and also why was the cop aiming the "tazer" at the victims spine? isnt that a potential spot that would cause extensive damage with a tazer? once again another mistake a real cop wouldn't make. and why would he need to taze a helpless victim in the first place? i sincerely hope the judge and jury do not give these dogs any leniency.

    • Soooo ... anyone know why he shot him? It happened like, a week ago. My outrage found out it's a week old, got confused and left. Anyone? I think the REAL outrage is why the national media have ignored this story for a WEEK! and the kid shot and killed in Houston in his own driveway in his own car ... National news?

      It is currently "under investigation" but, from what I've heard as an Oakland, ca resident the guy had ran from the cops a month prior with a gun and that is why they felt they had to pin him down and attempt to taser him resulting in his supposed accidental shooting. There was a fight on the bart train and they pulled several men off and handcuffed each of them, the last being the deceased. From what I've seen in interviews from witnesses he wasn't part of the fight or having anything to do with the rest of the men handcuffed. But as he sat with his hands up in a line against the wall with the others waiting for the cops to get to him I'm not sure what kind of problems he was giving the police but they decided to pin him down with two officers while the third stood above him, drew his gun (apparently thinking it was a taser regardless of the fact that the two weapons are very different in feel) and shot the man in the back later ending his life.
      The main thing I think is out of all the weird controversial stories of cops killing because of a high stress situation where quick thinking is crucial how can you deem such an act accidental? Perhaps negligent but, why the hell would it be a police procedure to pin a man down, bind is hands, and then taser him? No matter how you flip it, it doesn't add up to the cop being innocent of some degree of murder. These are the officers of the law deemed worthy of the position to enforce it to protectand serve the people from each other and themselves. How in ANY way are these actions, even if he were to have tased him, protecting anyone?

      Remember that story, I think it was in Alabama, where four black men disfigured and tortured a white man, in front of his wife, then raped the woman before killing them both? No, you don't remember it, because it wasn't anywhere in the news.

      People are quick to let their blood boil over when a minority is hurt, or worse, killed by police, but if it may encourage hatred toward the minority's race, then it is best left uncovered. Welcome to P.C. America. You are living in a product of your own complaining.

      I remember reading about that, and not seeing it in the news, it's a horrible situation, but this is vastly different. This is a case of a brainless jackass with a badge at best "making a mistake" that should have been prevented through basic training. I couldn't care less what color the victim was. I hate how somehow race factors into everything.
