Fair Use (the man was right when he said AP used photos by others without permission) needs to take precedence over this stupid AP photo controversy. If it's in the public interest, USE IT!
To the person who ranted about the company the President keeps (i.e., foreign leaders who do not agree with us), I would remind him of the folly of not talking with the enemy.

Courts will have to determine the extent of whether Shepard Fairey's graphical image is in violation of copyright law's specification of what the limitations are for Fair Use, specifically under item (c) in Section 113 - Scope of exclusive rights in pictorial, graphic, and sculptural works, which states:
"(c) In the case of a work lawfully reproduced in useful articles that have been offered for sale or other distribution to the public, copyright does not include any right to prevent the making, distribution, or display of pictures or photographs of such articles in connection with advertisements or commentaries related to the distribution or display of such articles, or in connection with news reports."
It doesn't look like AP's legal team can make an argument here.

I think the fact that he has purchased photos from AP in the past ruins his point. I think he shot himself in the foot buy buying one photo to use and then not buying the second one. Obviously he knew he had to buy the rights as he had in the past.

Current Controversy? Aren't there more important items that could qualify as a "controversy?" Well, here's an honest answer to the question:
Who will obey?
Not me. It is unDemocratic to put the man before the country regardless of party. Tired of the hero worship be it Bush, Obama, OR Reagan.

The difficult issue is that the AP doesn't use artistic photos for profit. Farirey used the image for his gain when the Obama campaign reimbursed him for his work, for an image that wasn't his (which he promptly donated elsewhere).
If the AP were to photograph other artistic works and sell them for profit as creations of the AP themselves, then they would be holding a double standard.

Actually they did use his and several thousand others' works for profit via advertising (most notably they used it to promote buying images from their image library, which contains photos of artworks without any of the artists' permission).
