The Constitutional Tribunal ordered that Pablo Cayo be given his job back as a janitor for the municipality of Chorrillos, which fired him for being intoxicated at work.
The firing was excessive because even though Cayo was drunk, he did not offend or hurt anybody, Fernando Calle, one of the justices, said on Wednesday.
Calle said the court would not revise its decision, despite complaints from the government.

Pardoning the first time would be fine, along with a lecture about responsilbility, because you so things that you wouldn't do when drunk. However, if this behavior becomes repetitive, he should be fired.

Well we already are prohibited to drink alcohol at my job, so if you come drunk they don't even let you in, and they don't let you come back either (if you see what I mean)

The cool side of me says right on man, drinking at work and getting away with it. Hell I've had a couple drinks with my restaurant coworkers behind the boss's back, but nothing crazy. But here I see a couple problems. One, what if this guy has a severe drinking problem? Shouldn't there be help for this guy if so. Two, if this guy were to have an accident involving himself and/or others, wouldn't the company be held responsible for knowingly employing a person who has a diminished thought capacity due to inebriation?

This really should be the decision of the court anyway. This employer wasn't discriminating or anything illegal, merely setting standards ensuring that the job required of his/her employee wasn't being deterred by anything. There's also the fact that an intoxicated person could also potentially, however unlikely, become more easily violent or disruptive. It acts as too large a threat to the productivity to the job regardless of however menial the work may seem.

Peru is going the way of the US. First workers had no rights now it seems employers have none. Drinking on the job should be a reason to be canned. Keep giving in and soon their jobs too will go the way the US jobs have, to Asia.
