Obama quietly continuing Bush administration policy on detainee's right to trial

Change? More like changing his mind. What will be the excuse for a constitutional scholar's blatant disregard for a prisoners right to habeus corpus, especially when we know that some detainees have no links to Al Qaeda, terrorist organization or any intelligence other organizations.

"In a stunning departure from his rhetoric on Guantánamo Bay prison, President Barack Obama signaled Friday he will continue Bush Administration policy with regard to detainees held at a US airbase in Afghanistan, saying they have no right to challenge their detentions in US courts -- and denying them legal status altogether."

    • I have done the research and I will tell you they have plans to turn America into a very terrible place and Obama can't do a thing to stop it. The New World Order is happening. They are letting everyone fall into deep poverty first, so they are to weak to do anything to stop it. I have all the facts, it is real. I have spoke to the senator's office high official and they basically wanted to tell me, but could not. The Jews didn't believe it was happening until they were actually being gassed. Please let us not be so complacent. That is why they are not doing anything to help people they are letting America fall on purpose. I am not getting any help are you? And trust me I tied everything, and if I can't find help I would be doubtful others will find it. They have cut us off from all credit and so how can we have customers. The politicians and media have a get out of jail free card so to speak, they have been told they will be taken care of. Sure they will.

      The National Strike Day USA Revolution has begun. We are picking up many supporters for our National Strike Day.

      Now through peaceful means we can organize a cohesive protest by the people for the people. We must remember, this is a peaceful and educational movement to restore our nation to the original intent that our Forefathers outlined. Thus, our constitution, The Bill of Rights and the Declaration of Independence are such articles of Freedom left to us by our Forefathers to use to forge and protect us from what our politicians are doing to undermining the will of the people and alter our constitution to control the people. It will be stopped!

      It is a duty of a free people to continue to check government and in this case restore our constitution and the will of the people. .

      If you see people that act out of whack like this, they are either sick mentally or they are working under cover for our government. They are hiring CIA right on the radio now. How could anyone be against working to restore our constitutional rights? There are some sick people on this planet but I have compassion for them either way. We have to understand they have been poisoned by the wrong thought, i.e. dangerous ideologies.

      Were going to encounter this kind of negativity so we must remain steadfast in our determination to finish our peaceful war of Independence.

      Under Section III

      Closure of Detention Facilities at Guantánamo. The detention facilities at Guantánamo for individuals covered by this order shall be closed as soon as practicable, and no later than 1 year from the date of this order. If any individuals covered by this order remain in detention at Guantánamo at the time of closure of those detention facilities, they shall be returned to their home country, released, transferred to a third country, or transferred to another United States detention facility in a manner consistent with law and the national security and foreign policy interests of the United States.

      Executive orders are binding. So I don't see the problem here. The prisoners have the right of habeus corpus, and Guantanamo will be shut down within the year.

    • You have GOT to be kidding me. Obama might have the title of being a constitutional lawyer but he believes in a living constitution, he doesn't even understand how an economy works! If he would pick up a Ludwig von Mises book for ten seconds he would see the long-run effects of his statist centralized coercive Federal policies that usurp the 10th amendment! He abuses the commerce clause and has no idea what our foreign policy should look like, only what his "advisors" tell him. Give me a break, the constitution clearly states that all PERSONs, not just citizens, should have the right to due process! Obama is a fraud like the republicans! The politicians are just playing along with the game to keep a good name and to advance their careers!

      The executive branch ie executive orders are not above the constitution and are in and of themselves unconstitutional.

      The problem is that Obama, while promising change has done nothing different than Bush. I seem to remember that Current users cheered Obama's promise of the closing of Guantanamo.

      You didn't read the executive order did you? Because your comment has nothing to do with what i posted. They HAVE the RIGHT of Habeus corpus.

    • Prisoners of War do not have Constitutional Rights. Obama is a Constitutional Lawyer and very well aware of this fact. When P.O.W.'s are not fighting in a Conventional War, like fighting without uniforms or under a flag and targeting mainly civilians instead of military targets, the P.O.W.'s are not entitled to the Rights of the Geneva Convention either.

      mjsmith, they may not have all of the rights under the US Constitution, but prisoners of war do have the right of habeus corpus, as told by a US lawyer who represented a Kwaiti businessman.
