His PATRIOT ACT gave him to power to spy on Americans at will and without a court order.
His AUTHORIZATION TO USE MILITARY (AUMF) gave him the power to declare any person on earth an enemy combatant and any nation on earth a threat, and authorized him to use military force on his say so alone.
His MILITARY COMMISSIONS ACT gave him the power to torture anyone without consequence, detain indefinitely anyone without charge, without a trial in open court, without due process, and without the right to "habeas corpus", on his say so alone.
The 110th Democratic Congress and President Obama and the 111th Democratic Congress have not rescinded any of these imperial, draconian laws, the tools of a dictator retained and intact.
In fact, Congress/Obama have renewed these anti-American laws, as if they were expecting the return of another monarch.

Quite simply, yes. The imperial Presidency must end, and the above mentioned legislation must be found unconstitutional so it will not be attempted again anytime soon. Second best option is for it to be repealed, but this is difficult. Because even though a politician my criticize these imperial tools on the campaign trail, once in power they will not willingly give up these tools that enhance their power. If Obama won't do it, we need to find someone who will, and disperse power amongst the three branches of our government. (congress must be the government body that declares war.)
Also a good check on the imperial presidency would be to repeal the 17th amendment making Senators (with the power to make the budget) once again loyal to the states and by default antagonistic to the office of the presidency, providing a check on any tendencies or notions the president my have of national glory, imperialism, and military expansionism.

I do think we need to reel in some of the new executive powers, but I think we need a line item veto to cut out the pork

Good post. Having these laws on our books is simply unacceptable.

I'm for abolishing the federal government as a whole. It's not like anyone in Washington is actually paying attention to the Constitution anyway.
