I can't believe this defense actually went through! Besides the fact that it is completely maddening by itself, have Italians never helped their kids get dressed/undressed? I do believe that some children will refuse assistance and parents do juuuust fine getting those pants off!
Also, does this law also apply to people rendered unconscious with jeans on?

So Italy has a justice system simmilar to Saudi Arabia how enlightened.

at first, i thought, "hmm...maybe he was innocent and she did consent." then, i thought again, "she still might've been coerced aggressively even if she took off her pants herself." is it still rape if she says, "ok" even if she didn't want to originally or regreted it after? is sexual rape, by italian law, only violent coercion?

That's a good point, pressrecord. I think that we'd need to know more about the case to understand its implications. Were the jeans ripped or the buttons popped? Also, I don't know the first thing about Italian law, but my understanding of rape is that if hesitance or a refusal to go any further is expressed at any time that it is no longer consensual. As you suggest, it might be a case of regret--she may have become pregnant and didn't want to face the consequences--but I still find it amazing that the fact that she was wearing jeans was enough evidence to overturn the conviction.

yes, the defense is stupid, yes, he should have been investigated...
But Saudi Arabia? She would have been raped again and killed if this was a fundamentalist Islam government.
