IN OCTOBER, if the Bush administration has its way with the Supreme Court, you will lose the right to sue a drug company if you are harmed by a medication that was FDA approved.
Apparently, this entire controversy sprang up over a woman who lost her arm to gangrene after she was inappropriately injected with a drug manufactured by Wyeth pharmaceuticals, then subsequently sued Wyeth, and won. Now the Bush Administration is challenging that decision and trying to create a blanket law which would make it impossible to sue a drug company whose product has been approved by the FDA.
Suing can get out of hand and is sometimes directed at the wrong agents (e.g. if a drug company is sued for the mistake of a nurse who administers an inappropriate drug) However, making it illegal to sue a drug company over a drug, solely because that drug was approved by the FDA, is preposterous.
Considering that agencies like the FDA and EPA are supposed to protect the health and safety of humans and the environment, but are more concerned (especially under the Bush administration) with industry interests, this law could be very detrimental to our right to be protected.
Just because the FDA says it is safe, does not mean it is. Hormones, biotech seeds, short-term tested foods and drugs - these are all things that the FDA gives its stamp of approval to. Not only should we have the right to know more about what is in our foods and the risks associated with those ingredients, but we should also have the right to challenge the (low-respected) approval of the FDA.

My doctor is an Integrative MD. He graduated Harvard and Columbia ..and took additionally Holistic course work to fill in where needed.

Big fucking surprise, the biggest drug pushers in the country, they should be able to afford to buy off the administration. Hell, I'd take a few million to refrain from telling everyone I know what a bunch of opportunistic, bottom feeding, greedy motherfuckers all these pharmaceutical corporate assholes are. And the sad part is they are using talented learned people to create the medicines that will be used to overprescribe America to death.

It may seem hard to imagine, since most of the folks who read Current.com are pretty savvy when it comes to things such as revolving doors between govt/corporations. But the sad reality is there are so many people who depend upon the medical system to solve their physical and mental issues with a pill. I deal with this all the time with my aging parents, who end up going to the doctor for health issues, and coming home with yet another sketchy pill, and the loop plays over and over. I try to explain to my parents the danger in taking these pills, (I have several horror stories they have endured), but they are so indoctrinated to believe in the medicine, big pharm, and the fda that they continue to participate. .

Although I'll be the first to admit that this country is getting swamped more and more by frivolous lawsuits, I see no reason why the American people should not be allowed their due process against any company that sells a potentially fatal product, and that should include the FDA. I hope the lawsuit puts the FDA's constitutionality into question. To just rubber stamp any drug as approved is detrimental to the American people, as is taking away the right to legal action against the company who manufactured it is moreso. But then again, I'm still trying to figure out how to get shitstains out of 300 year old parchment. Guess we'll have to see how this goes.

The Delaney Clause written by the FDA ALLOWS for known carcinogens (with nasty LD50s) in your food, along with irradiated foods with UNKNOWN chemical compounds.
And let's not overlook the obvious: aspartame. "Enjoy your adult onset diabetes!" But we've got a drug you can take for the rest of your life to deal with that slow death, so it's no big deal - as long as you have health insurance)
Eat organic, exercise and read labels.

-wrongful death

The bill is almost guaranteed not to pass, too many lawyers ranging from ambulance-chasers to high-level pros will make sure of that, because we all know that the legislative government is controlled by lawyers. They may be despicable mercenaries, or they may be heroic freedom fighters, but lawyers are firmly planted in the steel and concrete of the Eagle Empire.

He tried to sneak a similar thing into the "Patriot Act" that said parents of Autistic kids couldn't sue if it is proven the Mercury in the innoculations causes it. Luckily folks saw it and demand that it be taken out. God only knows what he'll try before he's out of there. Dang.

In all my years I have never witnessed an American Administration that was so anti people. They don't even try to hide it anymore. If it doesn't benefit big business or some suck up branch of government then they don't care. I can't wait for these pigs to be gone. -

First of all,we know Bush is about as honest as a grapefruit. Second, he would not be trying to do this if not for covering up the dishonest corruption that has continued to harm the American public for decades. I have been studying how the FDA has and continue to screw people. How many bad drugs need to do harm and be recalled, how much fake non food items need to hit the shelves and cause all sorts of problems in the giant rat known as the American public. Bottom line is that Bush is covering for the massive outpouring of lawsuits that are waiting to materialize as people start to wake up and question why their government not only didn't protect them, but actually did things to harm them!
