Ohio Attorney Files Motion to Lift Stay in Ohio Case of King Lincoln Bronzeville v Blackwell
At a press conference this morning in Columbus, Ohio, Cliff Arnebeck, lead attorney for the plaintiffs in the case of King Lincoln Bronzeville v. Blackwell, announced that he is filing a motion to "lift the stay in the case [and] proceed with targeted discovery in order to help protect the integrity of the 2008 election."
One of the more delightful and interesting quotes comes from Arnebeck, concerning what he expects to discover as the stay is lifted: "[W]e anticipate Mr. Rove will be identified as having engaged in a corrupt, ongoing pattern of corrupt activities specifically affecting the situation here in Ohio."
According to Arnebeck, his expert witness, Stephen Spoonamore, "works for credit card companies chasing data thieves, identity thieves around the globe, and also consults with government agencies including the Secret Service, the Pentagon, and the Federal Bureau of Investigation in criminal matters. [He's] really one of the top, and in fact the top private cop in the world on the subject of data security.
"First, some background. The King Lincoln Bronzeville v. Blackwell case was filed on August 31, 2006. At issue was "whether the rights, privileges, and immunities guaranteed to Plaintiffs by the Civil Rights Act, and the First, Thirteenth, Fourteenth, and Fifteenth Amendments to the U.S. Constitution have been violated by the past and ongoing conduct of Secretary of State J. Kenneth Blackwell in connection with past elections in Ohio."
A stay was previously entered into on joint motion of the parties, Ohio's Secretary of State Jennifer Brunner and the plaintiffs, to support settlement discussions in the case. "At one point," Arnebeck noted this morning, "this was interrupted when the Secretary wanted to bring all the ballots that had been ordered preserved by Judge Marbley, bring them in to one location. When the ballots came in, there was significant omissions and reports of the destruction of some of the ballots."
The BRAD BLOG reporter previously on some of some of the ballots missing from 56 of Ohio's 88 counties, despite the federal court order.
Arnebeck explained that part of the reason for the stay, at the time, was to allow the Ohio Attorney General to proceed first, as provided in Ohio House Bill 3 which states, in part:
...the attorney general may initiate criminal proceedings for election fraud under section 3599.42 of the Revised Code which results from a violation of any provision of Title XXXV of the Revised Code, other than Chapter 3517. of the Revised Code, involving voting, an initiative or referendum petition process, or the conducting of an election, by presenting evidence of criminal violations in question to the prosecuting attorney of any county in which the violations may be prosecuted. If the prosecuting attorney does not prosecute the violations within a reasonable time or requests the attorney general to do so, the attorney general may proceed with the prosecution of the violations with all of the rights, privileges, and powers conferred by law on a prosecuting attorney, including, but not limited to, the power to appear before a grand jury and to interrogate witnesses before a grand jury.

Back in my day, tampering with a United States election was treason. Wonder if that law has been changed? Outing a covert agent wasn't treason, how about tampering with an election?

Elections are the essence of a democratic republic. Any effort to steal or defraud the ballot process should be considered treason: it is an attack on democracy itself.

These crimes should energize us into immediate action. What we have here is a process that generates mounds of snooze material! -
Maybe as people are less able to shop and travel, they'll take a look at issues they have been too busy to pay attention to. Accountability Now is the answer. This has been another Friday News Dump. It may get covered, but everyone is too busy on the weekends to pay attention. By Monday, it's old news. 'Move along, nothing to see here' it's old news.
I can't understand how media declares something as 'old news' just because it was reported. Is reporting now the new criminal justice system? If mainstream media decides they have covered it, there is no need for real justice? SAD! SAD! SAD!

If rove is involved you know it is criminal and corrupt. This man has no moral value or ethics, so why waste tax dollars investigating any business that rove has touched, HE IS ALWAYS DOING ILLEGAL ACTS, wasting time and money on a man who has not a redeeming qualitity. This is an important story. If we don't learn from 2004 then we'll be doomed to see it repeated in 2008, won't we?
The media doesn't like this story because it requires actual effort to investigate.
The lonely reporter in a ruffled trench coat chasing down leads until 2am and intervewing people is loooong dead.
Today's modern idea of "journalism" seems to be to email the White House for a quote and then read their response on the air. Then they email the Dem leadership for a quote and read that on the air. They call it a day @ 10am and go play golf.
We need to dig up the old journalists of the 1940's, 50's and 60's so that they can replace the talking heads we have on the air now. -
LSHolly, I understand your frustration, but our opinion of him has no legal basis. We are a country who 'previously' used the 'Rule of Law' and the Constitution as our guide. Now media and public opinion means more than laws.
Executive Privilege has been used for everything which smells of illegality. I don't think George W. can use Executive Privilege for this one? Ya never know? We don't appear to have a criminal justice system that is functioning as it should.
Karl Rove tried to get Fitzgerald fired when he was investigating the outing of Valerie Plame. He didn't get in trouble? He snubs his nose at the American people and Dick Cheney's answer is 'SO'? George W. just says he's the 'decider' and that's that. No Accountability, no shame for their actions is making a mockery of our criminal justice system.
You can bet they will find the Constitution and the 'Rule of Law' if Obama get's the Presidency. Mainstream media will find their facts and we will move along as though they haven't done anything wrong for the past 8 years. No trial, no crimes? No accountability, no shame? -

Oh the journalists of yester years. I don't think it was the journalists themselves, it is the station owners and the consolidation of media ownership. Too few individuals control what is and is not reported.
Unfortunately, they are movers and shakers in corporate America, who have made large sums of money from this administration. The rich have gotten richer, the poor have gotten poorer. Journalists don't want to be unemployed, they report what they are told. Step out of line and they may not be employable for years to come.
It's time to hold corporate sponsors responsible for the spin they are paying for. We are paying for? We make the purchases which gives them finances to invest in political opinion. Money really does talk. Profit over politics would be the way to change mainstream media. We actually control the purse. Far too many people fail to realize 'power of the people' is real. We could change things if enough people cared. -
Some of the problem also lies with the fact that "interns" have replaced journalists.
I was watching a show on PBS a year or so ago and they were exploring the inner workings of a large news station -- and a shocking amount of the "news" was being researched by kids still in college. They relied mostly on internet searches and a few cursory phone calls and then passed it up the food chain until it was eventually read on the air by Katie Couric or whomever.
Oh! And now that we live in a 24hr news cycle you only have a few hours to research a story -- throw it on the air -- and then check your Outlook inbox for your next assignment. How are you suppose to get any really depth with only a few hours of research?
Is it really any wonder that the 2004 Election scandal (nevermind the 2000 election!) gets so little analysis?
No wonder Karl Rove isn't worried. Whose going to be digging through his trash with a flashlight looking for clues to his crimes? That type of journalism isn't really done anymore unfortunately -- but I wish it was. -
I want Karl Rove in jail as much as anyone, but the title of this post was very misleading. There is no whistle blowing, just accusations from people not involved in the alleged crime.

After reading this story i did research on the network news sites and tried to find recent articles on Rove's recent refusal to testify and the lack of conviction of congress that he should be compelled. Very little to absolutly none.Even interest in this article is waning on this site. The very most important thing to a democracy is the dependability of its elections and not a hit of suspicion on the tubes but let some harebrained , talentless heiress give a hint of juicy scandal they're all over it. This is juicy, sexy, exciting but no mention. this isn't media going for the cheap dollar getting easy ratings, it stinks of media manipulation manipulation.scary times

my fear isn't of Rove, satanic toad that he is, it is who is manipulating the media? Ready to jump on any rumor about Clinton but no mention of vote rigging. The only media covering it was BBC, which also covered Jessica Lynch propaganda and Tillman friendly fire scandal. Most things reported as breaking news often can be heard on BBC days ahead of U.S. It appears with better coverage less spin and more information.The most information , the best information about this country unfortunatly comes from abroad. It breaks my heart.

Folks, stay tuned for a "terrorist" attack to be staged by the neocons. They are most likely to set off a dirty bomb in some "who cares" city such as Detroit. Then we get to enjoy a state of natioal emergency and martial law. And ,oh yes, no elections this time.
I believe we ain't seen nothin yet.
