More drug law insanity

We all need to support Charles Lynch, whose trial on drug charges is scheduled to begin July 22nd. Lynch ran a licensed marijuana dispensary in Morro Bay, CA, perfectly legal under that state's medical marijuana law. He was arrested last year on Federal drug charges and faces - get this - 100 years in prison. Why? Because he dispensed medical marijuana to a 17 year old, with his parents' permission (they went with him to get it, again as required by California law) for treating the symptoms of his bone cancer.

This is absolute insanity, and let's lay this insanity right at the feet of the people to blame: Justices Scalia, Ginsburg, Breyer, Souter, Kennedy and Stevens. Those six justices voted with the majority in Raich and upheld the primacy of the federal Controlled Substances Act over state medical marijuana laws. These are the justices who perversely decided that a constitutional provision giving congress the authority to regulate interstate commerce also gives them the power to regulate an activity that is neither interstate nor commerce.

Let's also place the blame on the Bush administration, which has zealously enforced the CSA against those following their own state law. The Supreme Court may have given them the authority to enforce the CSA over the laws of California, but the DEA still has the authority to put their resources into other areas and the DOJ still has prosecutorial discretion not to press such charges.

People are suffering from a myriad of diseases, and sometimes for the treatment of those diseases by chemotherapy, and that suffering can be reduced by using marijuana. This is all but indisputable. That we are allowing them to suffer in the name of the war on personal freedom drugs is cruel. That we are imprisoning those who seek to help ease that suffering is unjust and barbaric.

  • My mom has fibromyalgia and is afraid to get medical marijuana for this purpose alone. The federal government needs to respect the state laws and the people's needs. I also feel bad for the 17 year old, I would have rather found it through a friend than "incriminate" this man unknowingly.

  • This is truly a story worth talking about. Whether or not you agree or disagree with the politics, you need to recognize the scientific side of this issue.

  • This is absulutely disgusting and I don't see how this ignorance and injustice still happens in such a society. We have all the tools to become informed so why does the ignorance persist? Fuck the Supreme Court, I can't wait for each one of them to die and be replaced by someone from a different generation.

  • I don't know anyone who has been hurt by marijuana, no one at all. How is it our ridiculous president could have had a cocaine problem, back in his days as a "drinker" but a 17 year-old cancer survivor cannot have access to a harmless drug that eases his pain? What kind of morons do we have running this country...and the Supreme Court judges who are upholding this nonsense ought to be tarred and feathered. The DEA is a joke when most of us can watch really harmful drug deals taking place on our city streets on the hour, and the DEA can't figure that out, but they can come in and throw this man on the ground and cuff him, and now our legal system is threatening him with 100 years? This country is becoming the laughing stock of the world. We are ridiculous. Our president is ridiculous. Our representatives are ridiculous. Our law enforcement is ridiculous, and finally, we have a Supreme Court that is beyond ridiculous. Just how long has this war on drugs been going on...and once again, if we simply "follow the money" we can figure out real quickly that it is a war that was never intended to be won, but rather just another pretense to deceive the American people and separate them from their common sense and their Bill of Rights. I am so disgusted with this country, so disgusted with the shame Bush and company have forced upon us all. We look like the biggest idiots on the planet.
